The Commission of the City of Bozeman met in regular session in the Commission Room, Hunicinal
Building, 21 November 1973, at 1: 15 0 I clock p.m. Present were Hayor Grabo,"T, Commissioner Sedivy, Com-
missioner Lehrkind, Commissioner Vandeventer, Commissioner Vollr1er, City Hanager Fryslie, Assistant
City Manager Keyes, City Attorney Berg and the Clerk.
Commissioner Vollmer opened the meeting with a prayer and the following nroceeclings were had:

The Commission was referred to the opening of bids for a new all metal building for the sanita-
tion department of the City of Bozeman on 14 November 1973. The bids having been studied in detail by
the C:Lty Enl"ineering staff, it was found that neither building met vrith the snedfications of the "Call
for Bids. ,.
After considerable discussion, the City Hanager concurred in the recommendation of the rit;.r Engineer
and recommended that the bid of Edsall Construction, Bozeman, in the amount of $22,920.00 and the Bid
of Harvey Construction, Bozeman, in the amount of $14,385.00 be re,1 ected. It "Tas moved by Commissioner
Sedivy, seconded by Commissioner Lehrkind, that they concur in the recommendation of the City Manager
and reject both of the bids that were submitted last week as stated above and the motion was carried
by the following Aye and No vote: those voting Aye beinp.: Commissioner Sedi v:'l, Commissioner Lehrkind,
Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none.

The Commission was referred to the opening of bids for a new tractor-mounted front-end loader
and backhoe for the cemetery department. The bids having been ana.l~rzed, the City Hanap.:er concurred
with the City Engineer and the Superintendent of the Cemetery department, recommending that the purchase
be awarded to Gallatin Equipment Company of Bozeman, Hontana, on the basis of their bid in the Mlount
of $5,200.00 with the trade--in , it being the lowest bid and eaualing the specifications as contained
in the "Call for Bids." In concurrence with the recommendation of the Cit~r !1anap:er, the City Enfdneer
and the Superintendent of the Cemetery Department, it was moved by Commissioner Lehrkind, seconded by
Commissioner Vandeventer, that the purchase of the tractor-mounted front-end loader and backhoe be
awarded to Gallatin Equipment Company of Bozeman and the motion was carried by the followinl" Aye and.

The request from John P. Scully of Drysdale, HcLean and Scully on behalf of Richard Hall, Sheridan,
1-!yoming, and Bruce Mecklenburg of Bozeman, requesting permission to place a car wash on the Hest 175
feet of Lot 2, Block 3, in Kirks Second Subdivision, havinp.: been referred to the City Staff and Planning
Staff for their recommendation was again presented.
Following an extensive discussion. the Commission concurred "rith the recommendation and it iTas
moved b:T Commissioner Vandeventer, seconded by Commissioner Vollmer, that Hr. Hall of Sheridan, 1"Tyominp;
be allowed to install a car wash in a B-2 Zone, this beinr: an interpretation by the Commission that it

The Certificate of the engineer of Thomas, Dean and Hoskins, Inc., on Special Imnrovement District
No. 520, stating the construction has been completed in accordance with the terms and stipulations given
in the plans and specifications was presented. The consulting eng5neers recommended that the work on
the paving improvements be approved and that unon the final acceptance by the Commission the application
for Gas Tax monies to pay the full amount due the contractor "rill be nrocessed. Final nayment and accep-
tance does not relieve the contractor of the responsi bi1i ty for negligence in faulty materials or "Tork--
manship to the extent or period provided for by la"T. The contractor has fUrnished a performance bond
equal to the contract bid to guarantee materials and worYJnanship for a period of one veal' commencing
upon final acceptance. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that as
recommended the proJect be accepted as completed and that the anplication for gas tax monies to nay the
imnrovements be forwarded to the Montana State Highway Department for processing. The motion ,ras carried
by the following ~ye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy,
Commissioner Lehrkind, Commissioner Vandeventer, and Hayor Grabow; those voting No, none.

The Commission concurred with the recommendation of the City Hanager, that they reschedule the
hearings on Commission Resolution Nos. 1631 and 1633, SID Nos. 531~ and 536, and it ,-ras moved by Com-
missioner Sedivy, seconded by Commissioner Lehrkind, that they reschedule the hearing to be held on
5 December 1973 in place of 28 November. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner
Vollmer, and Mayor Grabow: those voting No, none.

No, none, whereupon said resolution was declared duly passed by a majority of the whole number of members
of the Commission and the Mayor being present affixed his signature thereto in approval thereof and the
Clerk of the City Commission attested her signature thereto.

The City Manager commented on the reports and recommended approval thereof. It was moved b~T Com-
missioner Vandeventer, seconded by Commissioner Vollmer, that the reports be approved and ordered filed
and the motion was carried by the following ~ve and No vote: those voting Aye being Commissioner
Vandeventer, Commissioner Vollmer, Commissioner Lehrkind, Commissioner Sedivy, and. !{ayor Grabow; those
voting No, none.

The Street department has need for a ,1eep and the City Manager requested authorization to purchase
a 1974 Jeep from Solover Motors, Billings, in the amount of $3,540.00 as Quoted, it being the lovrest
artd best quote submitted, note being taken that this is snecial purpose equinment not sold in Bozeman.
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that authorit1T to purchase
the 1974 ,Jeep for the purpose of plowing side,-ralks from Solover Hotors in the amount of $3 ,5!~0. 00 be
granted and the motion was carried by the following Aye and No vote: those voting Aye being Commis-
sioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, and !~ayor
Grabow; those voting No, none.
