The Commission of the City of Bozeman met in regular session \'ledne s day , 7 November 1973, at
1:15 o'clock p.m. Present ,Tere Hayor Grabow, Commissioner Sedivy, Commissioner Lehrk.ind, Commissioner
Vandeventer, Commissioner Vollmer, City Manager Fryslie, Assistant City rlanager Keyes, City Attorney
Berg and the Clerk.
Commissioner Lehrkind opened the meeting with a pra~rer and the follovTing nroceedings 1,Tere had.
Hinutes of the regular meeting held Wednesday, 31 October, were approved as read.

This was the time and place set for public hearing of Commission Resolution No. 1622 on vacating
a portion of West Beall Street lying bet1reen North Tenth and North Eleventh Avenue in the City of Raze..
man. Affidavit of publication of Notice and the Clerk's certificate stating that all property owners
had been notified as required by law was presented. There were no written protests on file.
Hr. Con McClurg and Mr. John Knapp were present to discuss the alley in ouestion and to register
their protests to the vacation of the portion of West Beall Street lying between north Tenth and lJorth
Eleventh Avenue.
Following a thorough discussion. the Commission concurred in the recommendation of the City Hanager
and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the protests be recorded
and the vacation of a portion of West Beall Street Between north Tenth and North Fleventh Avenue be
tabled for a more conclusive report by the City Staff. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Co~~issioner Vandeventer,
Commissioner Vollmer, and Hayor Grab01-T~ those voting No, none.
Canvass of Votes
Under the provisions of Section 11-3216, R.C.H., 1911{, and this being the first legal day after
the Clerk of the Commission had received the returns of the regular municipal election and the special
election held on Tuesday, 6 November 1973, the Clerk of the Commission proceeded to canvass said returns
so received from all the polling precincts. The results of the canvass 1rere as follows:

The City Manager checked the claims and found them to be true and lavful claims e.gainst the City'
of Bozeman and recommended they be approved and the Director of Finance be directed to issue warrants
in payment. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the claims be
approved and ordered filed and the motion was carried by the follmrinp: A.ye and No vote: those- voting
Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer,
and !1ayor Grabow; those voting No, none.
