The Commission of the City of Bozeman met in regular session Wednesday, 17 October 1973, at
1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Lehrkind, Gommissioner Sedivy, Commissioner
Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney
Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were
had.
Minutes of the regular meeting held 10 October 1973 were approved as read.
SID Bond Sale - SID No. 525 - $6l,OOO.O~ID No. 526 ~ $95,000.00, SID No. 527 - $91,000.00, SID No.
528 - $7~06~-oo-;SiD'No:--5.29 - $69,000.00, SID No. 530 - $109,000.00, SID No. 532 - $l.8,000.00 and
SI_~.2.-. 533 - $21.,200.00
The City Manager stated that according to the affidavit of publication this was the time and place
set for the sale of bonds SID No. 525, 526, 527, 528,529, 530, 532 and 533.
The Mayor and the City Manager outlined the proceedure for conductinr, this bond sale and stated
that the amount of bonds to be sold for . each district would be the same as the advertised amount
and announced that the C{ty was ready to conduct oral bidding on the bonds of SID No. 525 in the amount
of $61,000.00.
The following bidders qualified by depositing with the Clerk of the City Commission the necessary
biel securi ty .

Following the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded
by Commissioner Lehrkind, that the bid of Arnold Benson of Dillon in the amount of 6.10%, it being
the lowest bid and best bid submitted, the sale of the bonds be awarded to Arnold Benson and the bid
security of the unsuccessful bidders bp returned and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer,
Commissioner Vollmer and Mayor Grabow; those voting, No, none.
The Mayor announced that the City was ready to conduct oral bidding on the bonds of SID No. 526
in the amount of $95,000.00.

The lowest effective interest rate accruing to the City of Bozeman offered as oral bids was
as follows:
Mr. Hufford of D. A. Davidson Co., Gt. Falls, being the only bidder, bid 6.7% as the lowes t
effective interest rate accruing to the City of Bozeman. The City Manager stated the bid of 6.7%
by D. A. Davidson & Company ,,yas acceptable. It was moved by Commissioner Lehrkind, seconded by
Commissionpr Vandeventer, that the sale of the bonds for Special Improvement District No. 526 be
awarded to D. A. Davidson & Company and the motion was carried by the following Aye and No vote: those

Mr. Hufford of D. A. Davidson Company, Gt. Falls, beinf the only binder, bid 6.7% as the lowest
effecUve interest rate accruing to the City of Bozeman. The City Manager stated the bid of 6.7% hy

in the amount of $73,000.00.

effective interest rate accruing to the City of Bozeman. The City Manager stated the bid of 6.7% hy

completed their study of the bids submitted for the construction of a sanitary sewer trunk line,
Figgins C, Graf's Third Addition, SID No. 525, for the construction of a trunk water main, Figgins
& Craf's Third Addition SIn 526, for the construction of sanitary sewer laterals, Figgins & Graf's
Third Addition SID 527, for the construction of lateral watermains, Figgins & Graf's Third Addition
SID No. 528, for the construction of watermains and sanitary sewer, North Twenty-First Avenue from
Beall Street to Durston Road SID No. 529, for the construction of paving North Twenty-First Avenu('
from Beall Street to Durston Road SID No. 530, for the construction of trunk watermains, Reminzton
Addition SID No. 532 and for the constructi.on of watermain laterals, Remington Addition SID No. .533
and having prepared a final tabulation of the bids recommended that the hids be awarded to Felton
Construction Company, Missoula, on the basis of their low hid in the amount of $339.959.80.
The Commission concurred with the recommendation of the engineers, also concurred in hy the
City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that Felton
Construction Company of Missoula be awarded the bid on the basis of their lov! hid in the amount of
$339,959.80 contingent upon the plans and specifications being approved by the State Board of Health
and that the bid security of the unsuccessful bidders he returned and the motion was carried hy the
following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind. Comm-

A letter received from C. & H. Manhattan Associates General Council requesting creation of
Special Improvement Districts for the installation of Sewer, water and paving at the site of the
New K-Mart located bett-Teen North Fi.fth and North Seventh Avenue between Hemlock and Oa, Street was
presente(l. I t ~-1as moved hy Commissioner Lehrkind, seconded hy Commissioner Vandeventer, that the City
Attorney he instructed to draw IIp the resolution of intention to create the Special Improvement
Districts for the construction of Water. Sewer and Paving at the site of the New K-Mart as soon as
the Ci.ty Staff furnishs the proper information. The motion was carried by the following Aye and
No vote: those votinG Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Voll-

A letter received from Paul K. Dudley, sales chairman of the Bozeman Civitan Club. requesting
permission to conduct a frui.t cake sale in Bozeman from Thankl1giving through New Years Day in an
effort to help the mentally retarded was presented. It W8.S moved by Commissioner Vandeventer, se-
conded by Commissioner Vollmer, that the request to conduct the fruit cake drive be granted and the
motion was carried by the followinG Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Vollmer. Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none.

In compliance wi th Chapter 16 of the Bozeman Municipal Code, the plumbing bond in the ar'oun t
of $5,000.00 ~~as presented. The Building Inspector had recommended approval of the bond and the City
Attorney approved the bond as to form. It was moved by Commissioner Vollmer, seconded by Commissioner
Sedivy, that the plumbing bond be approved and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Comm-
issioner Vandeventer. and Mayor Grabow;tlnose voting no, none.

Proclamation: "United N2tions Day" 74 October 1973
In accordance Hith the Governor of Montana, Mayor Grabm~ proclairrted 2lf October 1973 as "United
Nations Day" in the City of Bozeman and urged all citizens of Bozeman to observe'tTnited Nations Day"
and seek to promote understanding and support for the United Nations and its affiliated agencies.
