The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, July 5, 1978, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commis-
sioner Vollmer, Commissioner MacNab, Commissioner Swanson, Commissioner Vandeventer, City
Manager Gesko, City Attorney Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the
regular meeting held on Wednesday, June 28, 1978, were approved as submitted. I
Decision - Zone Change Amendment - Southwood Properties - to permit professional and business
uses as a permitted use in B-1 zone pursuant to Chapter 18.42 of Bozeman Municipal Code
The decision on the request of Southwood Properties for a zone code amendment to permit
professional and business uses as a permitted use in Neighborhood Business Districts having
been deferred for a period of one week was brought before the Commission.
Clair Daines addressed the Commission stating the intent was to build residential type
businesses.
The City Manager stated the property has been zoned B-1 for some time, and a more com-
patible use with residential zones is being proposed.
The Commission concurred in the recommendation of the City Manager, and it was moved by
Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission approve the request
for a zone change amendment and instruct the City Attorney to draw up an ordinance to permit
professional and business uses as a permitted use in B-1 zones. The motion was carried by the
following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer,
Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none.
Public Hearing - Conditional Use Permits
(a) A. Visocan - Construction of two 18 unit apartment buildings located between Durston
Road, Villard Street, Seventh Avenue and Ninth Avenue. (To be tabled)
This was the time and place set for a public hearing to consider the request of A. Visocan.
The applicant seeks a Conditional Use Permit to construct two 18 unit apartment buildings on
approximately 3.98 acres of land located between Durston Road, Villard Street, Seventh Avenue I
and Ninth Avenue.
The Planning Director presented the staff report which recommended approval of the per-
mit with six conditions. He stated the parking requirements had been met but that additional
open space was required to meet the density requirement.
The Planning Director advised the Commission that there were a considerable number of res-
idents protesting this use because of the additional traffic, noise and erosion problems.
The Commission concurred in the recommendation of the City Manager, and it was moved by
Commissioner Vollmer, seconded by Commissioner Swanson, that the request for a Conditional
Use Permit be continued until such time as a new plot plan is submitted. The motion was car-
ried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner
Swanson, Commissioner Vandeventer, Commissioner MacNab, and Mayor Sedivy, those voting No, none.
(b) B. Ward & Son - Establishment of a store selling sporting goods, clothing and jewelry -
vacated Gallatin Equipment Bldg., located at 2320 West Main Street
This was the time and place set for a public hearing to consider the request of B. Ward &
Son. The applicant seeks a Conditional Use Permit to allow the establishment of a store to

sell sporting goods, clothing and jewelry located at 2320 West Main Street.
The Planning Director presented the staff report and recommended approval thereof with four
conditions.
Jim Cummings spoke on behalf of the applicant. He felt there would be no problems.
The Mayor declared the hearing closed and the City Manager recommended that action be de- I
ferred for a period of one week.
Public Hearing - Zone Map Change
(a) Eugene Graf - Rezone approximately l2l acres located in Section 24, T2S, R5E, from
AS to R-2. R-4, and TR. (to be tabled)
This was the time and place set for a public hearing to consider the request of Eugene
Graf for a zone change from AS to R-2, R-4, and TR. The site is located in Section 24, T2S,
R5E, and contains approximately 121 acres.
The Planning Director presented the staff report, and recommended that the proposed zone
map change not be approved pending receipt of additional information.
The City Engineer suggested that when the study is made of the proposed area, that a study

should be made to determine what traffic would be generated through the University from this
proposed development.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the re-
quest for the zone change from AS to R-2, R-4, and TR be tabled pending additional information.
The motion was carried by the following Aye and No vote, those voting Aye being Commissioner
I Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy,
those voting No, none.
(b) Vern Hancock - Rezone apprximately 7 acres of land being part of Block 4l and all of
Block 42 through 45, Northern Pacific Addition
This was the time and place set for a public hearing to consider the request of Vern Hancock
for a zone change from M-l to R-5, an approximately seven acre tract of land being p~rt of Block
41 and all of Block 42 through Block 45 in the Northern Pacific Addition.
The Planning Director presented the staff report which recommended th~t the, proposed change
be approved. He advised the Commission that a petition signed by approxi!li8tely 36 residents
supporting the change had been received. "-

The Mayor declared the hearing closed and it was moved by Commission~ Vandeventer, seconded
by Commissioner MacNab, that action be deferred for a period of one week. ~he motion was carried
by the following Aye and No vote, those voting Aye being Commissioner Vandevent:r~- Commissioner

Declaration of Intent - Far West Annexation
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the residents
fronting on Northwestern Drive be deleted from the proposed annexation area and the City Attorney
be instructed to draw up a resolution of intent to annex the remainder of the area as shown on
the map prepared by the City Engineering Staff. The motion was carried by the following Aye
and No vote, those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner
I Vollmer, Commissioner Swanson and Mayor Sedivy, those voting No, being none.
Contract documents - Engineering services for SID's 595, 596, 597 & 598, Morrison-Maierle, Inc.
The Contract documents by and between the City of Bozeman and Morrison Maier1e, Inc. , for
engineering services for Special Improvement District's 595, 596, 597 and 598, McChesney/Nelson
Area, was presented.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Contract
documents for the engineering services for Special Improvement District No's 595, 596, 597 and
598 be authorized and the Mayor and Clerk of the Commission be authorized and directed to sign
for the City of Bozeman. The motion was carried by the following Aye and No vote, those voting
Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Commissioner
Vandeventer, those voting No, Mayor Sedivy.
Resignation of William Nelson - Effective August l, 1978
It was with regret that the City Manager accepted the resignation of Police Chief, Bill
Nelson, effective as of August l, 1978. He further hoped that Chief Nelson's decision would
be in the best interest of both he and his family.
Traffic Safety Study - Ralph Zimmer
Ralph Zimmer, Vice Chairman of the Bozeman Traffic Safety Committee requested the Commis-
sion to ask the State Highway Department to do a Pupil Safety Program for Bozeman. Mr. Zimmer
I said that during this fiscal year $8,800 to $10,000 of federal funds are available to finance
part of the study. By 1980 the study could be entirely financed by highway planning and research
funds. He suggested that perhaps the study could be conducted over two fiscal years so that it
could be started and completely funded without local money.
Following Mr. Zimmer's report, the City Manager was directed to contact the Montana State
Department of Highways, and declare the city's interest iri:~this~study.Further questions should
be asked of the State, dealing with respective (State and City) cost schedule for completion
of study, possibility of total state funding, etc.

There being no further business to come before the Commission at this time it was

adjourned, and the motion was carried by the following Aye and No vote, those voting Aye
being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner
