The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, May 17, 1978, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commis-
sioner MacNab, CommissionerVollmer, Commissioner Swanson, Commissioner Vandeventer, City
Manager Gesko, City Attorney Berg and the Clerk.
Commissioner MacNab opened the meeting with a prayer whereupon the minutes of the regular
meeting held on Wednesday, May 10, 1978, were approved as submitted. I
Decision - Re Conditional Use Permits
(a) Wm. J. Sebena, construct office and shop facilities
The decision on the request of Wm. J. Sebena, to construct an office and shop facility
to run an asphalt batch plant, having been deferred for a period of one week, was brought before
the Commission.
The City manager explained that the hearing was held on May 10th. Persons opposing and
affirming the conditional use permit were heard at that time.
The City Attorney stated the asphalt batch plant is an approved use within the M-2-T dis-
trict. However, this does not preclude conditions which may be attached to the permit, and
which must be complied with.
The City Manager stated the state does not have a noise statute, but that the city could
write an ordinance regulating noise. He further stated that if all the components are not in
operation at one time, then the operation is not run smoothly. The operation is as good as
the person running it. It could either run very well or it could run very poorly.
The duty of inspection and supervision is with the Department of Health and various City
Departments. Before the plant goes into operation, they must meet all of the requirements.
Commissioner Swanson inquired as to parking in this area. Attorney Sabol explained that
vehicles would be parked in front of the building, and the trucks and equipment would be parked
in the rear.
Mayor Sedivy said that according to all that had been discussed, the conditional use as
applied for is a permitted use in this zone. However, since there is a "T" designation, the I
Commission has the right to review the conditional use and to add amendments. He further
stated the applicant has added some covenants, and if violated, his operation will be suspended.
The City Attorney advised the Commission that Mr. Sabol submitted a proposed written con-
ditional use permit agreement to be attached to the conditional use permit. The City Attorney
said there are some amendments that should be added to these conditions, particularly noise,
odor and air pollution, to make them more specific.
Following an extensive discussion, it was moved by Commissioner MacNab, seconded by Com-
missioner Vollmer, that action be delayed on the request for a conditional use permit for--an-
other week in order that the City Attorney and the Attorney representing the applicant may
present the covenants in final form. The motion was carried by the following Aye and No vute,
those voting Aye, being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Com-
missioner Vandeventer and Mayor Sedivy, those voting No, none.
(b) Roger McCormick - racquet ball/health club and rental office space
Tract 4 Old Elks Property
The decision on the equest of Roger McCormick to construct a racquet ball/health club and
rental office space on an approximately two and one-half acre parcel of land having been de-
ferred for a period of one week, was brought before the Commission for a decision.
The Zoning Commission having reviewed the Planning; Staffs recommendation, recommended ap-
proval of the conditional use permit with the following conditions:
1. a. That drainage be directed to flow towards Haggerty Lane via the access easement. I
The proposed driveway entrance shall either have curbs and gutters or a paved
drainage ditch shall carry runoff to Haggerty Lane. Said drainage control mea-
sures shall extend along the northern boundary so as to collect all drainage from
the developed portion of the site flowing in this direction.
b. A berm or other suitable drainage control structures shall be provided along the
eastern boundary so as to control run-off from the proposed site flowing over lots
located in Tract 3 of the Old Elks Club property.
2. In order to provide safe access onto Haggerty Lane, the proposed access drive shall
have a gradient not to exceed three percent slope for a distance of fifty feet as
measured from the edge of the right-of-way.

3. a. Signage - (The type proposed by the applicant) shall not be greater than sixty square
feet in size nor shall it occupy greater than one-third of the frontage of any con-
tinous wall. As proposed, its length shall not be greater than twenty-one feet. Said
sign shall be indirectly lit.
b. One directory sign shall also be permitted on this lot not to exceed thirty square feet
in size, a maximum of eight feet above ground.
I 4. a. Landscaping plan shall be provided which will provide vegetative screening of the park-
ing areas from the residential areas to the west of the proposed site and soften the
the building, the parking area, and the building mass from Haggerty Lane. Of the eleven
space car parking area to the west of the proposed building shall have a ten foot area
just westerly of it set aside and landscaped with shrubs and trees.
b. The landscapted triangular area located at the northeast entrance shall be increased
in size an additional five feet and landscaped with shrubs and trees.
c. The indicated northerly parking area containing twenty-three spaces shall have an addit-
ional five foot area located along its western extremity and landscaped with shrubs and
trees.
5. The final site plan shall indicate measures to control erosion and sedimentation control
during construction. Special attention shoudl be given to erosion and attendant sedimen-
tation onto adjoining properties and Haggerty Lane. It is recommended that the Soil Con-
servation Service be consulted for assistance in the development of this plan.
6. The site plan as submitted shall govern with the modification as indicated in conditions
one thru five above.
7. Final site plan to be reviewed by planning board prior to issuance of a Building Permit.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission
approve the conditional use permit as requested with the above conditions. The motion was car-
ried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner
Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none.
Public Hearing - Conditional Use Permit - Michael J. Powers to construct petroleum products
I warehouse located on Lots 6 & 7 of May's Tracts. (To be tabled)
This was the time and place set for a public hearing to consider the request of Michael
J. Powers to construct a petroleum products warehouse located on Lot 6 and 7 of May's tracts.
The Planning Director, Paul Bolton gave a brief summary of the request and recommended the
request be tabled until such time as the applicant has obtained permission to use the adjoining
property owner's access in common or develop an alternative proposal.
The Mayor declared the hearing open.
Upon recommendation, it was moved by Commissioner Swanson, seconded by Commissioner Van-
deventer, that the hearing be continued until a recommendation is received from the Zoning
Commission. The motion was carried by the following Aye and No vote, those voting Aye being
Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and
Mayor Sedivy, those voting No, none.
Sabol - request the City to hold rehearing - Robert A. Foster Zone Change
Joe Sabol, Attorney for Robert A. Foster, appeared before the Commission to request per-
mission to hold a rehearing on the Foster zone change.
His basis for the rehearing were the following alleged violations:
1. The original hearing violated due process of law.
2. The State Constitution.
3. The open meeting law.
I 4. The right to a fair hearing.
To support and substantiate the violations and the request for a rehearing six areas of
alleged deficits and alleged deficiencies were given.
1. The May 2nd and 9th so-called secret memos from City Manager Gesko to the Commission.
2. The introduction of Joe Shouse's comments to the Commission by the City Manager after
the hearing was closed.
3. That statements in the memos were supported by fact, particularly with regard to ground
water and that the matter of ground water pollution is controlled by the Department of
Healt h .
4. That no full, true and accurate record was kept of any of the hearings before the Plan-

ing Board, the Zoning Commission, or the City Commission.
5. That the City Commission failed, refused, and neglected to prepare written findings
in support of their decision to deny the request.
6. That the decision of the City Commission was arbitrarily and capriciously not sup-
ported by facts in the records.
Mr. Sabol summarized the above and requested that a rehearing be granted by the City Com- I
mission and that a record be kept of the rehearing and that written findings be prepared sup-
porting the Commission's decision which findings are to be passed on the facts contained in
the records.
The City Attorney asked whether this would be a change in the master plan or if the issue
is an amendment to the existing zoning ordinance. He was of the opinion that Mr. Sabol was
talking about a zone change. Mr. Sabol stated it would be a change to the master plan.
The City Attorney thought a rehearing might be allowd, but the City is not required to
keep a complete record. If Mr. Sabol wants a record kept of the rehearing it be at his ex-
pense. Mr. Berg stated that if a rehearing is granted the applicant, the nature of the pro-
cedure must be determined whether it be legislative or judicial.
Following considerable discussion, it was moved by Commissioner Vandeventer that the
request for a rehearing be denied. The motion failed for lack of a second.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Com-
mission delay action on the request to hold a rehearing for a period of one week to give the
City Attorney and City Manager an opportunity to study the legal points. The motion was car-
ried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner
Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy, those voting No, none.

This was the time and place set in Commission Resolution No. 1967, to hear protests to
the creation of Special Improvement District No. 595, watermain construction on Northwood I
Drive. Affidavit of publication of Notice and the Clerk's mailing certificate, stating all
property owners had been notified as required by law were presented. There were no protests
on file and no one appeared to protest verbally.
The Mayor declared the hearing closed and upon recommendation of the City Manager, it
was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that Commission Res-

stating all property owners had been notified as required by law were presented. There were
no protests on file and no one appeared to protest verbally.

Greg Morgan - Request interpretation of Zoning Code regarding Country Clubs
A letter received from Greg Morgan, requesting an interpretation of the Zoning Code, having
been delayed for a period of one week, was brought before the Commission.
The City Attorney having searched the laws pertaining to an interpretation of Ordinance I
No. 18.72.050 relating to conditional uses in a RS zone, advised the Commission that the phrase
"public and private parks and playground, golf courses and country clubs, other recreational
uses" relates only to an RS zone. The City Attorney further advised the Commission that an
outdoor running track and tennis courts and indoor activities such as racketball and handball
and a proposed lap swimming pool are common to country clubs in addition to golf.
Following discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner
MacNab, that the Commission concur with the interpretation of the City Attorney. The motion
was carried by the following Aye and No vote, those voting Aye being Commissioner Vandeventer
Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy, those voting
No , none.
Petition - Request to Create SID's Figgins 4th Addition
A letter received from Eugene Graf, Jr. , petitioning the City of Bozeman to create a san-
itary sewer and water mains improvement district to serve portions of Graf's First and Second
Subdivision, was presented.
The Commission concurred with the recommendation of the City Manager, and it was moved
by MacNab, seconded by Commissioner Vollmer, that the Commission acknowledge receipt of the
request for the special improvement district and instruct the engineering staff to furnish the
necessary information to create the district. The motion was carried by the following Aye and
No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner
Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none.
Petition - Request to Create SID's Figgins Phase 4 I
A letter received from Eugene Graf, Jr., along with fourteen other property owners
petitioning the City of Bozeman to create a Special Improvement District to serve Figgins
Phase 4, was presented.
The Commission concurred in the recommendation of the City Manager, and it was moved by
Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission acknowledge receipt
of the request for the Special Improvement District and instruct the engineering staff to fur-
nish the necessary information to create the district. The motion was carried by the follow-
ing Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commis-
sioner Vandeventer and Mayor Sedivy, those voting No, none.
Change Order for Senior Center
A change order on the construction of the Senior Center, as prepared by Douglas Rand,
Architect, was presented as follows:
Net Change in Contract amount $2,697.00
Net Change less Sherrick donation 497.00
Original contract amount 455,994.00
Proposed changes 2,697.00
Proposed revised contract amount $458,641.00
The City Manager concurred with the architect, also concurred in by the engineering depart-
ment and recommended that the change order be accepted as presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Change I
Order be approved and the Mayor and Clerk of the Commission be authorized and directed to sign
for the City. The motion was carried by the following Aye and No vote, those voting Aye being
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and
Mayor Sedivy, those voting No, none.
Consideration of Bids - Purchase of 42,000# Silicoflouride - Water Dept.
The Water Superintendent and the City Engineer having checked the bids on the purchase of
42,000# Sodium Silicoflouride recommended that the bid of Dyce Sales & Engineering Service Co.,
Inc. , Billings, in the amount of $17.70 per cwt. be accepted, it being the lowest bid and meet-

ing or exceeding the specifications as contained in the "Call for Bids".
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Com-
misson concur in the recommendation of the Water Superintendent and accept and bid of Dyce Sales
& Engineering Service Co., Inc., Billings, on the basis of their bid in the amount of $17.70.
The motion was carried by the following Aye and No vote, those voting Aye being Commissioner

Consideration of Bids - Purchase of 1978 Hydrostatic Drive Rotary Mower
The Park Superintendent having tabulated and evaluated the bids submitted for the purchase
of a 1978 Hydrostatic Drive Rotary Mower, recommended that the City accept the bid of Midland
Implement Inc., Billings, in the amount of $4,995.00 F.O.B. Bozeman, it being the lowest and
best bid submitted and meeting or exceeding the specifications as advertised in the "Call for
Bids".
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Commis-
sion concur in the recommendation of the Park Superintendent, that the award be made to Midland
Implement Inc., of Billings on the basis of their low bid. The motion was carried by the fol-
lowing Aye and No bid, those voting Aye being Commissioner Vandeventer, Commissioner MacNab,
Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy, those voting No, none.
Designate Robert H. Baab as Examining Land Surveyor
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission
approve the designation of Robert H. Babb as examining land surveyor for the City of Bozeman
in concurrence with the recommendation of the Board of County Commissioners. The motion was
carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commission-
er Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none.
I Proclamation - "Safety Awareness Days" - May 22 thru June 3
Several members of the Bozeman Junior High School appeared before the Commission in regard
to National Safety Awareness Days and to urge the adults, as well as, the young people to work
hand in hand in an effort to make Bozeman a more safe place in which to live.
Mayor Sedivy proclaimed the week of May 22 through June 3 as "Safety Awareness Days" in
accordance with Bozeman Junior High Speech Students and the Bozeman Police Department and urged
all citizens, young and old, to get involved, participate and support=all activities during
"Safety Awareness Days" and all year long.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission
endorse the Mayor's proclamation. The motion was carried by the following Aye and No vote, those
voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commis-
sioner MacNab and Mayor Sedivy, those voting No, none.
Easement Agreement - Eric Johnston - Water & Sewer Lots 17 & 18 - Imes Addition
An Easement and Right-of-Way Agreement by and between Eric Johnston and the City of Bozeman
for the purpose of constructing and installing and operating a water & sewer line ten feet in
width thereto upon and across Lot 6, Block 35, Imes Addition was presented.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Ease-
ment and Right of Way Agreement as recommended by the City Engineer, having been executed by
Eric Johnson, be approved and the Mayor and Clerk of the Commission be authorized and directed
to sign for the City. The motion was carried by the following Aye and No vote, those voting

Easement Agreement - Hester J. Norwood - Water & Sewer Lines - Lots 17 & 18, Imes Addition
An Easement and Right of Way Agreement by the between Hester J. Norwood and the City of
Bozeman for the purpose of installing, operating, using, repairing, replacing, maintaining and
removing water & sewer lines and necessary appurtenances thereto upon and across the northern
five feet of Lot 7, Block 35, Imes Addition, was presented.
Upon the concurrence of the City Engineer, also concurred in by the City Manager, it
was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Easement

Beer License Applications - Bozeman Softball Association - May 20-21
A request from the Bozeman Softball Association, for permission to obtain a City Beer I
License for the weekend of May 20-21, was presented along with the required fee.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Softball
Association, having met all of the requirements, be granted a license to sell beer on the dates
as stated above. The motion was carried by the following Aye and No vote, those voting Aye
being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer
and Mayor Sedivy, those voting No, none.
Adjournment
There being no further business to come before the Commission at this time it was moved
by Commissioner Vandeventer, seconded by Commissioner MacNab, that the meeting be adjoured,
and the motion was carried by the following Aye and No vote, those voting Aye being Commis-
