The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, April 19, 1978, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commis- sioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City I Manager Gesko, Acting City Attorney Coil and the Clerk. Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday, April 12, 1978, were approved as submitted. Open Bids - One 4-wheel drive loader for Street Department This was the time and place set for opening bids for the purchase of one 4-wheel drive loader for the Street Department. The affidavit for the "Call for Bids" was presented. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the bids be opened and read, and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Allied Equipment Co., Billings - $51,800.00 Billings Ford Tractor & Equip - 41,469.00 Buffalo Machinery Co., Billings - 63,170.00 Hall Perry Machinery Co., Billings - 39,803.00 Langer-Thompson, Inc. , Billings - 44,489.00 Tractor & Equipnent Co., Billings - 52,268.00 Western Equipment Co., Billings - 53,218.00 It was moved by Commissionr Vollmer, seconded by Commissioner Swanson, that the bids be referred to the Street Department for tabulation, evaluation and a recommendation to be made to the Commission on Wednesday, April 26, 1978. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner I Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none. Public Hearing - Zone Change (a) Thrift Station - M-l & R-5 to RO-l, Blk 3 & 4 Babcock & Davis Addn. & Blk 42 thru 45, N.P. Addn. This was the time and place set for a public hearing to consider .the request of Gallatin Thrift Stations, Inc. , for a zone change from M-l, Commercial-Light Manufacturing and R-5, Residential-High Density, to R-O, Residential Office District, approximately an eighteen acre tract bounded on the East by North Boradway, the North by East Fridley, the West by North Wallace and the South by East Lamme, being Blocks 3 and 4 of Babcock and Davis Addition and Blocks 42 through 45 of the Northern Pacific Addition. Planning Director, Paul Bolton gave a brief summary of the request of the Gallatin Thrift Stations, Inc. The Mayor declared the hearing open and several interested person were present to register their protests. Upon the City Manager's recommendation, it was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the hearing be continued until a decision is received from the Zoning Commission. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy, those voting No, none. (b) Lloyd Lemieus - R-3 to B-2-T, Southeast Intersection I Rea Road & U.S. 191 This was the time and place set for a public hearing to consider the request of Lloyd Lemieux for a zone change from R-3 (Residential-Medium Density) to B-2-T (Community Highway Business). The site is located at the Southeast intersection of Rea Road and U.S. 191 and contains approximately four acres. The Mayor declared the hearing open. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the hear- ing be continued on the above request until a decision is received from the Zoning Commission. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy, those voting No, none. ---- ,.t31 Public Hearing - Conditional Use Permit - Eugene Lennick, allow conversion existing house into shop - 323 Griffin Dr., to be tabled This was the time and place set for a public hearing to consider the conditional use permit requested by Eugene Lennick. The applicant seeks approval to convert an existing house into a retail shop for selling and installing fireplaces, stoves, fireplace accessories, carport covers, I patio covers and awnings. The house is located at 323 East Griffin Drive. The Mayor declared the hearing open. The City Manager advised the Commission that the ap- plicant had been operating a commercial venture for approximately the last six months. The Zoning Commission recommended tht the application for a conditional use permit be tabled until additional material has been submitted by the applicant. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the hearing on the request for a conditional use be continued until the Planning staff can work with the appli- cant in developing a workable site plan. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Public Hearing Commission Resolution No. 1953 - Intent to Annex Travel Lodge Property containing 2.97 acres During the regular meeting of the City Commission held on March 15, 1978, the Commission regularly passed and adopted Commission Resolution No. 1953 declaring its intention to extend the boundaries of the City of Bozeman so as to include 2.97 acres located in the East one-half East one-half of the Northwest one-quarter of the Southeast one-quarter of Section 11, T2S, R5E, MPM to the City of Bozeman and designated as the Travel Lodge property. This being the date for public hearing as set forth in said Commission Resolution No. 1953, affidavit of publication of Notice and the Clerks mailing certificate stating all property owners had been notified as required by law was presented. There were no protests on file and no one appeared to protest verbally. Public Hearing Commission Resolution No. 1954 - Intent to Annex the Main Mall During the regular meeting of the City Commission held on March 15, 1978, the Commission regularly passed and adopted Commission Resolution No. 1954 declaring its intention to extend the boundaries of the City of Bozeman so as to include a 39.46 acre parcel of land and desig- nated as the Main Mall property. This being the date for public hearing as set forth in said Commission Resolution No. 1954, affidavit of publication of Notice and the Clerks mailing certificate stating all property owners had been notified as required by law was presented. There were no protests on file and no one appeared to protest verbally. The Mayor declared the hearing closed and upon the City Manager's recommendation, it was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the City Attorney be instructed to draw up a resolution annexing the above property. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Van- deventer, Commissioner MacNab, Commissioner Vollmer, and Mayor Sedivy, those voting No, none. I Public Hearing - Commission Resolution No. 1955 - Intent to Annex Steinger Property During the regular meeting of the City Commission held on March 15, 1978 the Commission regularly passed and adopted Commission Resolution No. 1955 declaring its intention to extend the boundaries of the City of Bozeman so as to include a .90 acre parcel of land and designated as the Steiner property. This being the date for public hearing as set forth in said Commission Resolution No. 1955, affidavit of publication of Notice and the Clerks mailing certificate stating all property owners had been notified as required by law was presented. There were no protests on file and no one appeared to protest verbally. Public Hearing - Commission Resolution No. 1956 - Intent to Annex Schaefer Jursnick Property - 3.30 Acres During the regular meeting of the City Commission held on March 15, 1978, the Commission I regularly passed and adopted Commission Resolution No. 1956 declaring its intention to extend the boundaries of the City of Bozeman so as to include a 3.30 acre parcel of land and designated as the Schaefer-Jursnick property. This being the date for public hearing as set forth in said Commission Resolution No. 1956, affidavit of publication of Notice and the Clerks mailing certificate stating all property owners had been notified as required by law was presented. There were no protests on file and no one appeared to protest verbally. The Mayor declared the hearing closed and upon the City Manager's recommendation, it was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the City Attorney be instructed to draw up a resolution annexing the above property. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Consideration of Bid - Two 4-wheel drive vehicles for Street Department The Commission was referred to the opening of bids for the purchase of two 4-wheel drive vehicles for the Street Department. After tabulating and evaluating the bid, the Street Superintendent recommended that the City accept the bid of Bozeman A.M.C. Jeep, Bozeman, it being the only bid submitted and equal- ing or exceeding the specifications in the "Call for Bids". It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the award be made to Bozeman A.M.C. Jeep, in the amount of $10,025.30 with trade-in. The motion was I carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Com- missioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none. Consideration of Bid - One 3/4 ton van type vehicle for Engineering Dept. - One 4-door sedan automobile for Building Inspector The Commission was referred to the opening of bids for the purchase of one 3/4 ton van type vehicle for the engineering department and one 4-door sedan automobile for the building inspectors. The City Manager advised the Commission that only one bid was received for the purchase of the van, and this was froma non-franchised dealer. There were two bids received for the purchase of the 4-door sedan, one of which was also from a non-franchised dealer. The City Manager further stated the warranty would be another consideration. He advised the Commission that he had not had an opportunity to talk with any of the dealers and recommended that the two bids be deferred for a period of one week for a decision. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commission defer their decision on the purchase of the 3/4 ton van-type vehicle and the 4-door sedan for a period of one week. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commis- sioner Vollmer and Mayor Sedivy, those voting No, none. Consideration of Construction Bids - Sewer & Water Main - Kagy Blvd. A letter received from Mr. James Cummings of Thomas, Dean & Hoskins, Inc., consulting I engineers for the City of Bozeman, was presented. Having tabulated and anaylzed the bids, Mr. Cummings recommended that even though the project did exceed the estimate, the city award the bid to White's Intermountain Construction on the basis of their low bid in the amount of $39,298.75, it being the lowest bid submitted and equaling or exceeding the specifications in the "Call for Bids". Mr. Cummings advised the Commission that the city had had some prob- lems with this contractor, however, the city administration had agreed to allow the firm one more chance to show their capabilities, and he felt this project would be as good as any to show their capabilities. The Commission concurred in the recommendation of the consulting engineers, also concur- --.-------- ,133 red in by the City Manager, and it was moved by Commissioner Vandeventer, seconded by Com- missioner MacNab, that the award be made to White's Intermountain Construction based on their low bid in the amount of $39,298.75 it being only slightly higher than the engineer's estimate and equaling or exceeding the specification in the "Call for Bids". The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner I MacNab, Commissioner Vollmer, Commissioner Swanson, and ~1ayorSedivy, those voting No, none. Commission Resolution No. 1960 - Intent to create SID 592, watermains Block 5, Figgins Addn. Commission Resolution No. 1960, declaring the intention to create Special Improvement District No. 592, for the purpose of construction and installation of a watermain on Langohr and Healy Avenues and across easements between same in Figgins Addition, as prepared by the City Attorney, was presented, entitled: COMMISSION RESOLUTION NO. 1960 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DE- CLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO.. 592 FOR THE PURpOSE OF CONSTRUCTION AND INSTALLATION OF A WATERMAIN AND APPUR- TENANCES TO SERVE THE ADJOINING pROPERTIES AND MORE SPECIFICALLY DESCRIBED AS FOLLOWS: A SIX (6) INCH WATERMAIN AND APPURTENANCES ON LANGOHR AND HEALY AVENUES AND, ACROSS EASEMENTS BETWEEN SAME IN FIGGINS ADDITION ALL IN THE CITY OF BOZEMAN, MONTANA.- -THE CONSTRUCTION AND INSTALLATION OF THE WATERMAIN TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, CAST IRON WATER- MAIN, VALVES, FITTINGS, HYDRANTS, SERVICE LINE STUBS, AND OTHER NECESSARY APPURTENANCES. Police Protective Association - Wild Woods Country Western Production The Police Protective Association requested authorization to stage a theatrical produc- tion (Country Western Show) in Bozeman in late May. The City Manager advised the Commission that the production would involve phone solicitations, as did Bud Purdy. Mr. Purdy suggested that police officers themselves make personal solicitations. The City Manager had not had an opportunity to discuss the proposed contract and recom- mended that the request be deferred for a period of one week for further study and a decision. Authority to Purchase 5,000 ft. Copper tubing - Water Department The Water Department has a need for 5,000 ft. of copper tubing and the City Manager re- quested authorization to purchase the copper tubing at an approximate cost of $4,000.00. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the City Manager be granted authorization to purchase ,the copper tubing. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner I MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy, those voting No, none. Water Department - Authority to Call for Bids - 42,000# Sodium Silicoflouride The Water Department has a need to replenish its supply of sodium silicoflouride for use as an additive to the City's water supply, and the City Manager requested that the pur- chase be authorized. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the purchase be authorized and the Clerk of the Commission be directed to issue a "Call for Bids" for the purchase of 42,000# of sodium silicoflouride to be opened May 10, 1978. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Request for approval: Designation of Municipal Band Director for 1978 season A letter received from Ralph C. Challender, Secretary-Treasurer of the Bozeman Municipal Band, stating the executive committee of the Bozeman Municipal Band selected Mr. Gordon Wickham as the director of the band for the 1978 season. Ir was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission concur in the selection of Gordon Wickham as band director, and the motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, and Mayor Sedivy, those voting No, none. First draft of proposal for CDBG Funds Having conducted public hearings regarding the use of CDBG funds, potentially available I for the 1978 allocation, the items specifically suggested were as follows: Rehabilitation of existing homes $200,000 Establishment of Local Housing Authority 25,000 Water 175,000 Sewer 175,000 Paving 175,000 There was a question raised by Keith Swanson as to whether these funds would be outright grants or low interest loans regarding the rehabilitation of the existing homes. The City Manager indicated that the grants would be low interest loans and that there -~~-~-_.~_. 4:3~ , e: .J would be some participation by all property owners benefiting by a special improvement district to that which was authorized for one block on Villard Street. The City Manager commented on the proposal from a philosophical viewpoint as to whether or not the city would wish to embark on a program which would subsidize special improvement dis- trict costs ina a neighborhood of presumably moderate income. I Bob Owen, Grant Administrator for the CDBG funds gave a brief explanation of the preappli- cation to date. The City Manager explained that continued input on the use of these funds would be welcome and the staff will be reviewing the preapplication during the coming weeks. Reappointment to Zoning Commission - John Braaksma to December 31, 1979 The Mayor announced his reappointment of John Braaksma to the Zoning Commission for a period ending December 31, 1979. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer that the Commission endorse the Mayor's reappointment of John Braaksma. and the motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Request to Conduct parade - Sweet Pea Festival August 3, 1978 A letter received from Tammy Hall, Parade Co-ordinator of the Sweet Pea Festival, requesting permission to conduct a parade on August 3, 1978, at 3:00 p.m. was presented. It was moved by Commissioner Vollmer, seconded by Commissionr Swanson, that permission be granted to conduct a parade on August 3, comemorating the Sweet Pea Festival. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none. I Raffle License Application - Bozeman Trap Association June 11, 1978 Sweet Adelines August 6, 1978 The City Manager presented an application from the Bozeman Trap Association along with the required fee, for the purpose of holding a raffle on June 11, 1978. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Com- mission approve the application for the Raffle License for the Bozeman Trap Association. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy, those voting No, none. The City Manager presented an application from the Sweet Adelines along with the required fee, for the purpose of holding a raffle on August 6, 1978. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Com- mission approve the application for the Raffle License for the Sweet Adelines. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vandeventer, Com":' missioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy, those voting no, none. Extension of Variance for Mobile home on property approximately 3/4 miles North of Rea School The request for an extension of a variance to permit a mobile home in as AS zone based on the hardship on those involved was presented. The property involved is a one acre tract of land in the SE~,.sE~, NE~, Sec. 8, T2S, R5E, I M.P.M. Gallatin County, Montana. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission grant the zone variance extension to permit a mobile home in an AS zone based upon the hardship on those involved. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. I Claims for March The payroll claims and the general claims for the month of March were presented. The City Manager had checked the claims and found them to be true and lawful claims against the City of Bozman and recommended they be approved and the Director of Fiance be instructed to issue warrants in payment. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the claims be approved. Letter of Condolence to Family of Elizabeth Johnston It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the City Manager be instructed to address an appropriate letter of condolence to the family of Mrs. Elizabeth Johnson, who had passed away on April 19, 1978. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy, those voting No, none.
