HomeMy WebLinkAbout1978-03-29 il/~ ..., tJ March 29, 1978 Bozeman, Montana MINUTES OF THE MEETING OF THE CITY COMMISSION March 29, 1978 The Commission of the City of Bozeman met in regular session in the Commission Room, Munic- ipal Building, March 29, 1978, at 1:15 o'clock p.m. present were Mayor Sedivy, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager I Gesko, City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday, March 22, 1978, were approved as submitted. Consideration of Bids - 10,000 G.V.W. Truck for Water Department The Commission was referred to the opening of bids for the purchase of one 10,000 G.V.W. Truck with platform body with hoist for the Water Department. After tabulating and evaluating the bids, the Water Superintendent recommended that the City accept the bid of M & W GMC, Inc. withthe H-C-L Equipment in the amount of $7,321.51. The low bid of North Pine Auto & Truck Sales did not meet the specifications in the call for bids. Also a bid from a non-franchised dealer might cause warranty problesm. The Commission concurred in the recommendation of the City Manager, and it was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the award be made to M & W GMC, with the H-C-L Equipment, in being the best bid submitted and equaling or exceeding the spec- ifications in the "Call for Bids". The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commis- sioner Vandeventer and Mayor Sedivy; those voting No, none. Consideration of Bids - Two - 2~ ton trucks for Street Department After tabulation and checking the bids for the purchase of two 1978 dump trucks for the Street Department, the Street Superintendent and the Assistant Street Superintendent recommended I that the bid of M & W - GMC, Three Forks, in the amount of $21,853.36 be accepted it being the best bids submitted and equaling or exceeding the specifications in the "Call for Bids". The one bid that was lower did not meet the specifications in the "Call for Bids". The Commissioner concurred in the recommendation of the Street Seuperintendent, also concurred in by the City Manager and it was moved by Commissioner Vollmer, seconded by Com- missioner Swanson, that the award be made to M & W GMC on the basis of their low bid and equal- ing or exceeding the "Call for Bids". The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy; those voting No, none. Request for Waiver of License Fee - Gallatin Rural Fire Department Circus May 24 (2 shows) A request from the Gallatin Rural Fire Department seeking permission to sponsor a circus and asking that the license fee be waived was presented. The Circus is to be held at the Willson School on May 24, with an afternoon and evening show. The purpose of the circus is to raise monies to purchase additional rural fire fighting equipment. In as much as the Gallatin Rural Fire Department is a non profit organization they requested that the license fee be waived. Following discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the request for waiver of the license fee be tabled for a period of one week for the purpose of checking previous policies. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy; those voting No, none. I SCS Progress Report - #566 Flood Protection Plan - Watershed Planning Grant for Bozeman Area Flood Protection Study Walter Anderson, district conservationist and Robert Remer, river basin watershed planning staff leader of the Soil Conservation Service appeared before the Commission to give a progress report on flood protection and watershed studies for the Watershed Planning Grant. Mr. Remer said it had been determined that reservoirs on Bozeman Creek and Limestone Creek would be too costly for flood control. He stated the diversion channel would be a possibili(y. He further stated the SCS study will also be used in establishing the flood plain for the De~- partment of Housing and Urban Development flood insurance program. ~ iI.7 The Commission thanked Mr. Anderson and Mr. Remer for their extensive report. Consideration - Zone Code Change - Townhouse Standards The decision on the request to amend the zone code to allow Townhouse Development Standards in the R-3, R-4, R-5 and R-O zoning districts having beem delayed for a period of one week for I further study was brought before the Commission. After a thorough discussion, and upon the City Manager's recommendation, it was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Townhouse Standards as approved by the Zoning Commission be accepted and the City Attorney be instructed to draw up an ordinance to amend the zone code to allow Townhouse Development Standards in the R-3, R-4, R-5, and R-O zoning districts. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commis- sioner Swanson and Mayor Sedivy; those voting No, none. Request to reactivate revised parking ordinance, tabled in 1976. For application with Off-street parking ordinance In 1976, a revised Parking Ordinance was submitted to the Ctiy Commission. It was tabled, pending the outcome of two cases brought against the Parking Commission. Following discussion, it was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the proposed parking ordinance be removed from the table and remanded to the Zoning Commis- sion for review and a final recommendation. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Step 1 - EPA Grant Increase request - Engineers costs to update facilities plan and City effluent disposal on land The City Manager presented the Step 1 Environmental Protection Agency Grant Increase along with the anticipated breakdown of engineering costs as prepared by Thomas, Dean & Hoskins, Inc. I The engineering work is necessary due to some changes in scope of the facility plan to meet current requirements for environmental assessment and engineering evaluations and for the work that will be required by EPA to evaluate the disposal of sewage effluent by irrigation and rapid infiltration. The Commission concurred in the recommendation of the Ctiy Manager, and it was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission approve Step 1 as prepared by Thomas, Dean & Hoskins, Inc. , for an additional $28,700.00 to accomplish the necessary update for the Master Plan. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vande- venter, Commissioner MacNab and Mayor Sedivy; those voting No, none. Request to approve Plans and Specifications & authorize "Call for Bids" SID's 581, 584 & 585 Construction Bid Opening April 26, 1978 Bond Sale SID's 581, 584 & 585 May 3, 1978 Plans and specifications covering the porposed improvement in Special Improvement District No. 581 for construction and install~tion of paving on West Koch Street between 15th and 19th 3 .. ~. Avenue; Special Improvement District No. 584 for construction and installation of paving on 15th Avenue from Koch to College Streets and Special Improvement District No. 585 for construct- ion of Paving East Lamme Street between Broadway and Wallace Avenue, as prepared by Thomas, Dean & Hoskins, Inc. , consulting engineers, was placed before the Commission. Upon recommendation of the City Manager, it was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the plans and specifications as presented be approved, and I that the Clerk of the Commission be authorized and directed to publish a "Call for Bids: for the construction of Special Improvement District No's 581, 584 and 585 with an opeing date of April 26, and to advertise for bids for the sale of bonds for Special Improvement District No. 581 in the amount of $380,000.00, Special Improvement District No. 584 in the amount of $150,000.00 and Special Improvement District No. 585 in the amount of $77,500.00 to be received on May 3, 1978. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. Discussion - re vacation of alleys in Block 22 and 23 of Northern Pacific Addn. _~__ -----.L 418 Joe Sabol appeared before the Commission to explain that the maps of the City of Bozeman showed the Alleys in Block 22 and 23 of the Northern Pacific addition as being vacated. How- ever, no official ordinance describing the particular portion of the alley in question exists among the records of the City of Bozeman. Following discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, thatthe City Attorney be instructed to draw up the necessary resolution to vacate the I alleys in Block 22 and 23 of the Northern Pacific Addition lying between East Main and Babcock Streets, extending from the east line of Cypress to the west line of vacated Alysworth contin- gent upon the removal of the rubble from the area in which the house was moved. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy, those voting No, none. Reports: The City Manager commented on the report of the Director of Public Service for the month of February and recommended that it be accepted and ordered filed. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the report be accepted and ordered filed. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Commission Resolution No. 1959 - Expressing condolence to family of Phyllis Shearman Commission Resolution No. 1959 extending condolences and sympathy to the bereaved family and friends of Phyllis Shearman was presented. COMMISSION RESOLUTION NO. 1959 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, EXTENDING CONDOLENCES AND SYMPATHY TO THE BEREAVED FAMILY AND I FRIENDS OF PHYLLIS SHEARMAN. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that Commission Resolution No. 1959 be passed and adopted. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy; those voting No, none. Trophy to Bozeman Senior High School Hawks It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that a trophy be presented to the Bozeman Senior High School Basketball Team in recognition of their winning the State Basketball Championship. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy; those voting No, none. Adjournment There being no further business to come before the Commission at this time it was moved by Commissioner MacNab, seconded by Commissioner Swanson, that the meeting be adjourned, and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy; those voting No, none.
