HomeMy WebLinkAbout1978-02-15 39'0 February IS, 1978 Bozeman, Montana MINUTES OF THE MEETING OF THE CITY COMMISSION February 15, 1978 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, February 15, 1978, at 1:15 o'clock pm. Present were Mayor Sedivy, Com- missioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City I Manager Gesko, Acting City Attorney Coil and the Clerk. Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday, February 8, 1978, were approved as submitted. Consideration of Bids - 2-ton flat bed truck with hoist - Cemetery & Park Dept. The Commission was referred to the opening of bids for the purchase of one 2-ton flat bed truck with hoist for the Park and Cemetery Department. After tabulating and evaluating the bids, the Park Superintendent recommended that the City accept the bid of M & W GMC, Three Forks in the amount of $9,916.08 F.O.B. Bozeman, Montana, it being the best bid submitted and meeting or exceeding the specifications in the "Call for Bids". It was moved by Commissioner MacNab, seconded by Commissioner Vollmer that the award be made to M & W GMC, in the amount of $9,916.08. The motion was by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy: those voting No, Commissioner Vandeventer. Formal consideration of proposed Water Rates This was the time set for formal consideration of the proposed water rate increase. The City Manager advised the Commission he had met with representatives from Montana State Uni- . versity and had given them a report of the proposed water rates for their study. He further advised the Commission that many people regret seeing a proposed end to the water irrigation rates. They suggested that rather than eliminating the irrigation rate for five months, elim- inate the rate for May and June only. By charging double the present l2~ rate for water used I for July, August and September, the cost for irrigation purposes would be increased. A few wondered if their sewer rates would increase. Don Peterson from the Montana State University said they are still trying to put their figures together before coming up with a decision. He felt that if the rate is increased at the middle of a biennium it would be difficult to find funds to pay the increase due to their budgeting system. Dave Burgess of 1310 South Sixth Avenue stated he would like to contest the percentages which were quoted in the information/fact summary sent out with the February billings and the percentages being quoted at City Hall. Several other interested persons were present to express their concern over the water rate increase. Letters received from persons protesting the water rate increase were read by the City Manager. Following an extensive discussion, Mayor Sedivy thanked the public for their participa- tion on this issue and advised everyone no action would be taken at this time. The City Manager stated he would be pleased to appear before any group in order to clar- ify the problems connected with the proposed rate increase. Request for exception to placement of Mobile Home on existing lots A letter received from Carl P. Fillbach requesting a variance to park a 1978 Mobile Home on his lot located on the landfill road just south of ridger Creek was presented. Following discussion, it was moved by Commissioner Swanson, seconded by Commissioner I Vandeventer, that the request for a variance be continued for a period of one week for review and a decision by the City Attorney. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Request from State Solid Waste Management Bureau, to study solid waste disposal in Gallatin County. A letter received from the Gallatin County Sanitarian in regard to applying for planning monies to study solid waste disposal in Gallatin County was presented. The City Engineer said that at present the City of Bozeman has an adequate amount of ~_"_~._'__L_. 391 land and if the City accepts solid waste from the Bozeman City area only, the landfill site would be satisfactory for many years to come. He does not feel that the City should obligate itself to pay money for a study that the City really has no need for. If the study were made under a gran~ and at no cost to the City, then the city should participate in the study. Following discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner I MacNab, that the City Manager be instructed to address a letter to the County Commissioners advising them that the City will not financially participate in a county wide solid waste disposal study. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy; those voting No, none. Update on status of P.L. 566 Watershed Planning Program Study The City had requested a study by the Soil Conservation Service under the P.L. 566 Water- shed Planning Program to determine two things; one, a flood prevention program for the City of Bozeman; and two, a water storage and reservoir analysis for Bozeman Creek. As the study on the reservoir progressed and some initial costs were developed, it be- came apparent that the irrigation component which would have been partially supported by the Federal Government was too high to be realistic. The City Engineer recommended that the City Commission authorize the discontinuation of future studies on a reservoir for Bozeman Creek at this time. The City Engineer felt that the Soil Conservation Service should continue their flood protection evaluation and recommended that the Commission invite the Soil Conservation Service to meet with them in the near future, to explain the flood protection study and also the flood hazard boundary delineation study which they are doing under contract to HUD. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Com- mission authorize the discontinuation of future studies on a reservoir for Bozeman Creek; and that the Soil Conservation Service be invited to explain the flood protection study. The I motion was carried by the following Aye and No vote; those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy; those voting No, none. Authorization for Mayor to attend Congressional-City Conference Washington, D.C. - March 5-7, 1978 The Congressional City Conference is scheduled to be held in Washington, D.C. March 5-7, 1978, and the City Manager recommended that Mayor Sedivy be authorized to attend the conference. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that Mayor Sedivy be authorized to attend the conference and, it being in the public interest his expenses be paid out of the appropriate fund. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Com- missioner Vandeventer and Mayor Sedivy, those voting No, none. Application for Raffle License - Bozeman Sr. High School Drama Club - March 3 The City manager presented an application from the Bozeman Senior High School Drama Club, along with the required fee, for the purpose of holding a raffle on March 3, 1978. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commis- sion approve the application for the raffle license for the Bozeman Senior High School Drama Club. The motion was carried by the following Aye and No vote; those voting Aye being Commis- sioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy; those voting No, none.
