The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, January 25, 1978 at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer,
Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, City Attorney Berg and the
clerk.
Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the reg- I
ular meeting held on Wednesday, January 18, 1978 were approved as submitted.
Absence of Commissioner MacNab authorized
Upon the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded
by Commissioner Swanson, that the absence of Commissioner MacNab from this meeting be authorized
in compliance with Section 11-3245, R.C.M., 1947. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Swanson, Commissioner Vollmer, Commissioner
Vandeventer and Mayor Sedivy; those voting No, none
Annexation Agreement - Maxey Ltd. - South 1/2 of Block 8, Stevens Subdivision
An Annexation Agreement by and between the City of Bozeman and Maxey, Ltd. , for permission
to connect the south 1/2 of Block 8, Stevens Subdivision with the existing water and sewer lines
of the City of Bozeman, was presented.
Mrs. Campbell, one of the owners of the property in question, was present to answer any
questions that might arise. She stated they were planning to build a seven unit condominium
in this area.
Following considerable discussion, it was moved by Commissioner Swanson, seconded by Comm-
issioner Vandeventer, that the Commission continue action on the request to connect the south
l/2 of Block 8, Stevens Subdivision for an on the ground inspection and further study by the
engineering staff. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Swanson, Commissioner Vandeventer, Commissioner Vollmer and Mayor Sedivy;
those voting No, none.
Discussion Water Rate Study I
The proposed water rate study as presented by Thomas, Dean & Hoskins, Inc. , at a meeting
on January 4, 1978, was brought back to the Commission for discussion. Thomas, Dean & Hoskins
Inc., had prepared the water rate evaluation to determine the changes necessary to finance
construction of the needed improvements to operate the City Water system.
The City Manager advised the Commission that after the City Commission accepts the proposal
for a water rate increase, it would then be sent to the Public Service Commission to be placed
on the agenda. The City Manager pointed out that if there are protests, the Public Service
Commission will then hold a public hearing to review the proposed rate increase.
The City Manager further stated there were three bases for an increase in the water rates.
They are as follows:
1. The Federal Clean Water Act requires that the City provide filtration
for the water.
2. Many of the old water lines must be replaced and other lines attached
to insure adequate fire protection in the community brought on by
growth of the City.
3. There has not been a rate increase for twenty years, and the cost of
goods and services has continued to rise.
Normally the monthly bills are sent out on postcards but the City Manager hoped the February
billings could be sent out in envelopes along with an informational sheet. It would be a con-
densed summary of the report.
The City Attorney said he did not know if there was any kind of frequency approach, but the
City must have some sound reason and actual, factual development for the increase in the water rates. I
Followng an extensive discussion, the Comrilission concurred with the recommendation of the
City Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that
the City Manager be granted permission to send the February water billings out in envelope form
along with a fact/information sheet regarding the proposed water rate study and the water rate re-
visions for the City of Bozeman. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Swanson and Mayor
Sedivy; those voting No, none.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission
concur in the recommendation of the City Manager and take official action on February 15, 1978

to consider and adopt the water rates as proposed. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner
Vandeventer and Mayor Sedivy; those voting No, none.
Appointment - Park Recreation Board Member to December 31, 1980
Mayor Sedivy announced his appointment of Erhart Hehn to replace Gary Tschache on the Park
I Recreation board effective January 1, 1978 and ending December 31, 1980.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission
endorse Mayor Sedivy's appointment. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer,
and Mayor Sedivy; those voting No, none.
Request from School Board re designation & enforcement of fire lanes, etc. Junior & Senior
High School
A letter received from Milton Negus, Superintendent of Schools, whereby School District No. 7
is desirous of establishing fire lanes and special parking spaces for the handicapped at the
Junior and Senior High School was presented. School District No. 7 requesting the City of Bozeman
to designate these fire lanes and parking spaces through ordinance thus officially recognizing
the existence of such.
The City Attorney questioned whether the present City codes gave the fire chief authority
to designate fire lanes.
The City Attorney instructed the fire chief that he would draw up an ordinance. He further
stated that the City Commission has the authority to regulate the movement of vehicles anywhere
in the city limits and that it will be in that way the ordinance will be drawn up.
EPA Grant No. l58-R0144 - $19,900.00 Engineering Costs to Thomas, Dean & Hoskins
A Grant Agreement by and between the City of Bozeman and the Office of Grants, Environ-
mental Protection Agency, Denver, Colorado, for the engineering services by Thomas, Dean and
Hoskins, Inc. , in the amount of $19,900.00 for the Sewer Rehabilitation project, was presented.
I It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Grant
Agreement be approved and the Mayor and the Clerk of the Commission be directed to sign the
Agreement for the City of Bozeman. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner Vollmer,
and Mayor Sedivy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Vandeventer, seconded by Commissioner Vollmer, that the meeting be adjourned, and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vandeventer, Commissioner Vollmer, Commissioner Swanson and Mayor se~vy; t~~_NO' ~one.
