The Commission of the City of Bozeman met in regular session in the Commission Room, Mun-
icipal Building, January 11, 1978, at 1978, at 1:15 o'clock p.m. Present were Mayor Sedivy,
Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City
Manager Gesko, City Attorney Berg and the Clerk.
Commissioner MacNab opened the meeting with a prayer whereupon the minutes of the regular
I meeting held on January 4, 1978, were approved as submitted.
Open Bids - 1978 Van Wagon for Fire Department
This was the time and place set for opening bids for the purchase of a 1978 Van Wagon - 3/4
ton chassis for the Fire Department. The affidavit of publication of "Notice to Bidders" was
presented. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the
bids be opened and read, and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner
Vandeventer, and Mayor Sedivy; voting No, none.
The following bids were then opened and read:

The Commission concurred with the recommendation of the City Manager, and it was moved by
Commissioner MacNab, seconded by Commissioner Vollmer, that the bids be referred to the Fire
Chief and City staff for tabulation, evaluation and a recommendation to be made to the Commis-
sion on Wednesday January 18, 1978. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commis-
sioner Vandeventer and Mayor Sedivy; voting No, none.
I Safety Improvements - Kagy Boulevard and 19th Avenue
The City Manager stated that Mr. Gordon Larson of the Montana State Highway and Mr. William
Dunbar of the Bureau of Public roads appeared before the Commission on Wednesday, January 4, 1978
to explain the suggested changes for the safety factors of the proposed construction of Kagy
Boulevard and Nineteenth Avenue. He called on Mr. Van't Hul to explain the suggested changes.
Mr. Van't Hul explained that it was agreed by the State Highway Engineers and the City
staff that it would be necessary for the driving lane to be wide enough to allow a car to pass
if another car were stalled. It was also decided that the bike people prefer to ride along the
driving lane on a good surface. The pedestrians would be removed out of the middle and on to
the sidewalk to protect them. Therefore, as a compromise it was suggested that the driving lane
be widened to 17'. An 8' wide bike path would be located adjacent to the driving lane. In the
case of North 19th Avenue they suggested the parking be put adjacent to the curb, as the High-
way Engineers felt it was necessary to protect the roadway and promote drainage.
Mr. Andriolo voiced his concern for theintegrity of the Commission and the City engineer
and everyone involved with the proposal. He presented a proposed street plan designed by himself.
The City engineer pointed out that there were many hazards involved with the plan designed
by Attorney Andriolo.
Several persons were present, both for the suggested changes proposed by the Highway Depart-
ment and in opposition thereof.
Mr. Sedivy said the compromise was a safety problemmd that he was vitally concerned with
I the safety on Kagy Boulevard and North 19th Avenue.
After much discussion, the Commission asked for a five minute recess. The meeting was re-
convened, and there being no further comments it was moved by Commissioner Swanson, seconded by
Commissioner Vandeventer, that the Commission postpone any action on the safety improvements.
The Commission instructed the City engineer to research for anothe concept to be reviewed with
Mr. Andriolo and the local Highway officials. The motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer p Commissioner
MacNab, Commissioner Vollmer abstained and Mayor Sedivy voted no.

Discussion by City Engineer - Far West Annexation
Mr. Van't Hul of the Engineering Department gave a preliminary report on the engineering
cost estimates on the Far West Annexation. He advised the Commission that to provide municipal
water, sewer, storm drains and paving in the Far West Annexation would not result in any severe
design problems. He also presented cost estimates for the proposed project.
Mr. Sedivy thanked Mr. Van't Hul for his presentation and it was moved by Commissioner I
Vandeventer, seconded by Commissioner MacNab, that the Mr. Van't Hul and his engineering staff
continue with the study on the Far West Annexation. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Com-
missioner Vollmer, Commissioner Swanson and Mayor Sedivy; voting no, none.
Discussion by City Engineer - South Black Paving SID
The engineering staff reviewed a special improvement district to be created for the paving
of South Black Avenue from College to Garfield, Harrison and College from Tracy to Black, as
requested by the City Commission.
The City Engineer explained the proposed paving of that area and recommended that the Com-
mission consider the paving from College to Garfield as one package. This also includes three
cul de sacs and a portion of College and Harrison Streets between Tracy and South Black.
Following a discussion, it was moved by Commissioner MacNab, seconded by Commissioner
Vollmer, that Commission instruct the City Attorney to draw up the resolutuion of intention to
create the special improvement district as soon as the City staff furnishes the necessary in-
formation. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner MacNab, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; voting
No, Commissioner Swanson.
Vacation of Orange Street and adjacent Alleys - Commission Resolution 1929
Ordinance No. 999 Vacating Orange Street and Adjacent Alleys
Having continued action on the vacation of Orange Street and adjacent alleys for further I
consideration, Commission Resolution No. 1929 was again presented.
Following discussion, the hearing was closed and it was moved by Commissioner Vollmer,
seconded by Commissioner Swanson, that Ordinance No. 999 as prepared by the City Attorney be
passed and adopted, and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner
MacNab and Mayor Sedivy; voting No, none.

A letter was received from Morrison-Maierle, Inc., petitioning the City to create a sanitary
sewer SID to serve the Schaefer, Jursnick, McChesney and Wheat properties along Griffin Drive was
I presented.
The Commission concurred with the recommendation of the City Manager, and it was moved by
Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission acknowledge receipt
of the request for a Special Improvement District and instruct the City staff to furnish the nec-
essary information for creating the district. The motion was carried by the following Aye and
No vote; those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer,
Commissioner MacNab, and Mayor Sedivy; voting No, none.
An Encroachment Application and Permit - Meadow Way
Right-of-Way - Sewer Line Installation
An Encroachment Application and Permit for sewer line installation on Meadow Way right-of-way
by and between the Gallatin County and the City of Bozeman was presented.
Upon concurrence of the City Manager, it was moved by Commissioner Swanson, seconded by Com-
missioner Vandeventer, that the Encroachment Application and permit, having been executed by the
Gallatin County, be approved and the Mayor and Clerk of the Commission be authorized and directed
to sign for the City. The motion was carried by the following Aye and No vote; those voting
Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner
Vollmer and Mayor Sedivy, voting No, none.
"Call for Bids" - Truck Cemetery & Park Department
The Cemetery and Park department has need for a two-ton flat bed truck with hoist. The City
Manager requested authorization to Call for Bids for the truck.

missioner Vandeventer, seconded by Commissioner MacNab, that the purchase as requested be author-
ized and the Clerk of the Commission be directed to issue a "Call forBids" for the purchase of
the truck to be opened on February 8, 1978. The motion was carried by the following Aye and No
vote; those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer,
Commissioner Swanson, and Mayor Sedivy, voting No, none.
Engineer's certificate and recommendation of final acceptance - SID 570 street paving and storm
drainage improvements - Long Construction Also SID 561, 562 and 566
The Certificate of Completion of the street paving and storm drainage improvements by Long
Construction Company as prepared by Thomas, Dean & Hoskins, Inc., was presented. This final

acceptance does not relieve the contractor of his responsibility for negligence or faulty materials
or workmanship within the standard period provided for by law.
The City Manager concurred in the recommendation of the project engineers and recommended
that the projects be accepted and approved by the City Commission.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that as recommended
SID 561, 562, 566 and 570 be accepted as completed and the motion was carried by the following I
Aye and No vote; those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner
Swanson, Commissioner Vandeventer and Mayor Sedivy; voting No, none.
Contract Documents for Execution - Sewer Rehabilitation Project
The Contract Documents for the Sewer Rehabilitation Project, prepared by Thomas, Dean &
Hoskins, Inc., were presented. The City Manager recommended that the Contract Documents in the
amount of $204,735.25 as submitted by Gelco Grouting Service, Salem, Oregon, be approved.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Contract
Documents be approved and the City Manager and the Clerk of the Commission be authorized and
directed to sign the contracts for the City of Bozeman, and that Gelco Grouting Service be auth-
orized and directed to proceed with the sewer rehabilitation and repairs. The motion was carried
by the following Aye and No vote; those voting Aye being Commissioner Vollmer, Commissioner
Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy; voting No, none.
Consider Amendment to project cost for Garfield Culvert
The City Manager stated that due to the fact that the culvert under Garfield, between Tracy
and Black cannot be installed on the railroad right-of-way the construction has been delayed.
Since the project was not completed by January 1, 1978, the contractor is faced with addi-
tional cost for a manhole and since there is frost in the ground that will also add to the cost.
Therefore, the contractor wished to be reimbursed for these additional costs.
Upon concurrence of the recommendation of the City Engineer, also concurred in by the City
Manager, it was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the I
amendment to the project cost for the Garfield Culvert between Tracy and Black Avenue be approved.
The motion was carried by the following Aye and No vote; those voting Aye being Commissioner
Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy;
voting No, none.
Application for Raffle License - Delta Gamma Sorority - February 28
Bozeman Sr. Social Center - May 13
The City Manager presented an application from the Delta Gamma Sorority, along with the
required fee, for the purpose of holding a raffle on February 28, 1978.
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Commis-
sion approve the application for the raffle license for the Delta Gamma Sorority. The motion was
carried by the following Aye and No vote; those voting Aye being Commissioner Vandeventer, Com-
missioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy; voting No, none.
The City Manager presented an application from the Bozeman Senior Social Center, along with
the required fee, for the purpose of holding a raffle on May l3, 1978.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission
approve the application for the raffle license. The motion was carried by the following Aye and
No vote; those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson,
Commissioner Vandeventer and Mayor Sedivy; voting No, none.

Claims - December 1977
The Payroll claims and the general claims for the month of December were presented. The City
Manager had checked the claims and found them to be true and lawful claims against the City of
Bozeman and recommended they be approved and the Director of Finance be instructed to issue war-
rants in payment.
