The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, December 21, 1977 , at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner MacNab,
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Attorney Berg, City
Manager Gesko and the Clerk.
Commissioner MacNab opened the meeting with a prayer whereupon the minutes of the regular I
meeting held on December 14, 1977, were approved as submitted. Santa Claus appeared and wished
everyone a Merry Christmas and Happy Holiday Season.
Open Bids - New Dual Tone, 3 Signal 128 Decibel 3 Phase Siren
This was the time and place set for opening bids for two (2) New Dual Tone Component Type, 3
Signal 128 Decibel; three (3) phase-sirens. The affidavit of publication of "Notice to Bidders" was
Iresented. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the bids be
opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and
Mayor Sedivy; those voting No, none.
The following bids were then opened and read:
Federal Signal Corporation, Santa Clara, CA - $11,438.26
Henry Wruck, Gallatin County Civil Defense Director having thoroughly analyzed the bid of
Federal Signal Corporation, recommended that the bid of Federal SignmCorporation, Santa Clara, -.
CA, be accepted in the amount of $11,438.26, it being the only bid submitted and equaling or ex-
ceeding the "Call for Bids".
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the bid be awarded
to Federal Signal Corporation in the amount of $11,438.26, it being the only bid submitted. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab,
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy; those
voting No, none.
Award Bids - Construction of the Senior Citizens Social Center
The Commission was referred to the opening of bids for the construction of the Senior Citizen I
Social Center on December 7, 1977 . Architect Doug Rand and the City staff having evaluated and
considered the bid submitted agreed that the bid of Edsall Construction was the lowest bid submitted.
After spending several hours reviewing the drawings and specifications with Wayne Edsall of
Edsall Construction, the Architect recommended that Edsall Construction be awarded the bid on the
following basis in the amount of $455,944.00.
Lowest building bid received December 7, 1977 - (Edsall Construction) $462,227.00
Plus bid alternate M for full length of building 22,850.00
Plus bid alternate K for quarry tile in kitchen and bathroom 5,500.00
Items negotiated out of contract by architect and contractor which
are mainly a revised heating system eliminating about 1/2 the car-
port canopy, changing the parking lot asphalt specs, changing basement
waterproofing specs, eliminating some equipment and minor structural
simplification - less 29,459.00
Waiving of city permit and hookup f~es less 5,174.00
$455,944.00
Following discussion and upon recommendation of the City Manager, it was moved by Commissioner
Vollmer, seconded by Commissioner Swanson, that the Commission waive the city permit and hookup
fees in the amount of $5,174.00 and that the construction bid be awarded to Edsall Construction on
the above basis. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and
Mayor Sedivy; those voting No, none.
The project will not be initiated until early March, and therefore interest on the bonds
through May is estimated at $6,608.00. I
Public Hearing - Commission Resoltion No. 1934 - Affirm or disaffirm Comm. Res. No. 1808 and Ordinance
No. 962 - Off Street parking.
This was the time and place set in Commission Resolution No. 1934 to determine whether the
City Commission will affirm or disaffirm its action in the adoption and passage of Ordinance No. 962
and Resolution No. 1808 for the purpose of establishing off-street parking facilities for the City
of Bozeman. Affidavit of publication of Notice and the Clerk's mailing certificate, s ta ting all
property owners had been notified as required by law, were presented.
The City Attorney stated that the hearing was called pursuant to a decision by the Supreme
Court. The most serious matter concerned the voting participation on the special improvement dis-
trict in question by Commissioner Taylor, who was alleged to have a financial interest

in the district parking. The City Attorney stated there were three issues that should be considered
at this time. They are as follows:
1. Churches and single family dwellings and gerrymandering federal buildinS.(Medical Arts?)
2. Examine formula ordinance. Was the formula fair?
3. Whether Taylor's participation affected decisions of other commissioners
or affected the proceedings in general.
Mr. Screener stated that the hearing was not for the purpose of bringing any retribution to
I any of the Commission , that it is tainted by law because of the participation of Mr. Taylor.
Various views were expressed by Mr. Screener, Mr. Mack Anderson, Attorney for the plaintiffs,
Mr. Don Nell of the Medical Arts Center, Bill Ogle of the Presbyterian Church, Joe Sabol, Attorney
for the Downtown Development Association and Rick Mayfield, Planning consultant.
Following a thorough discussion and there being no further expressions to be brought before
the Commission, the Mayor declared the hearing closed, and it was moved by Commissioner Vandeventer,
seconded by Commissioner MacNab, that the matter be brought before the Commission for a decision
to be made on Wednesday, January 19, 1978. The motion was carried by the following Aye and No
vote; those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer,
Commissioner Swanson and Mayor Sedivy; those voting No, None.
Public Hearing - Commission Res. No. 1929 - Vacate Orange Street and adjacent alleys.
This was the time and place set in Commission Resolution No. 19~9 for the hearing of protests
to vacating a portion of the alleys in Block 53 of the Northern Pacific Addition of Bozeman, Montana,
and a portion of Orange Street. Affidavit of publication of Notice and the Clerks certificate
stating that all property owners had been notified as required by law were presented.
Following discussion, it was moved by Commissioner MacNab, seconded by Commissioner Vollmer,
that action on the vacation of Orange Street and adjacent alleys be continued for a period of one
week for further consideration. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner
Vandeventer and Mayor Sedivy; those voting No, none.
Call for Bids - Purchase New Van-Type Vehicle for Fire Dept. -open bids January 11, 1978
I The City Manager recommended that specifications for a 1978 Van Wagon - 3/4 ton chassis for
the Fire department be approved and the Clerk of the Commission be authorized and directed to publish
a "Call for Bids".
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the specifications
be approved and the Clerk of the Commission be authorized and directed to publish a "Call for Bids"
to be received on January II, 1978. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commiss-
ioner MacNab and Mayor Sedivy; those voting No, none.
Easement Agreement - Mt. Bell & City of Bozeman cemetery - 10' in widith located in SE~ of Section
17, T2S, R6E, MPM.
A Right-of-Way Easement from the Mountain States Telephone and Telegraph Company, for the
purpose of constructing, operating, maintaining and removing such communications and other facilities
upon, over and across a strip of land ten feet in widt~ said strip is shown on Exhibit 'A' attached
to Right-of-Way Easement. Said strip is located in the SE~ of Section 17, Township 2 South, Range
6 East MPM was presented.
The City Manager recommended that the City enter into the Agreement, approved as to form by
the City Attorney. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer,
that the Right of Way Easement be entered into by the City and the Mayor and Clerk of the Commission
be authorized and directed to sign for the City. The motion was carried by t~e following Aye and
No vote: those voting Aye being Commissioner Swanson, Commission Vandeventer, Commissioner MacNab,
Commissioner Vollmer and Mayor Sedivy; those voting No, none.
I Engineers Staff Report - Far West Annexation preliminary Engineering Cost Estimates
Mr. Van't Hul of the engineering department gave a brief report on the Far West Annexation
Preliminary Engineering Cost Estimates for the Far West Annexation Sanitary Sewer. The engineer-
ing cost estimates covered the water, sewer, paving and drainage in that area.
The Commission thanked Mr. Van't Hul for the extensive report.
Report
The City Manager commented on the report of the Police Court for November and asked that it
be accepted and ordered filed.

It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission
accept the report and order it filed. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commiss-
ioner Vandeventer and Mayor Sedivy; those voting No, none.
Reappointments - Board of Adjustment - Harold Goble, Zoning Commission - Jim DeBree
Mayor Sedivy announced the reappointment of Harold Goble as a member of the Board of Adjust-
ment to December 31, 1980, and Jim DeBree as a member of the Zoning Commission to December 31, 1979. I
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission
endorse the Mayor's reappointments. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer,
Commissioner MacNab and Mayor Sedivy; those voting No, none.
Meeting recessed at 3:55 P.M.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the meeting
be recessed until 7:30 o'clock p.m. at which time it will be reconvened. The motion was carried
by the following Aye and No vote: those voting Aye being ~mmissioner Swanson, Commissioner Vande-
venter, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy; those voting No, none.

Public Hearing - Industrial Revenue Bond Issue for proposed Life of Montana Building
This was the date set for the public hearing for the Industrial Revenue Bomlssue on a pro-
posed project under Title 11, Chapter 41, R.C.M. , 1947.
The proposed project will consist of the acquisition and construction of certain properties to
be used as a commercial office facility, at a cost presently estimated not to exceed $2,000,000.00.
Funds for this purpose will be provided by the issuance of revenue bonds under said Chapter 41 and
secured by a mortgage on the project and such other security as may be deemed advisable. The
project will be leased to Life of Montana Insurance Company at net rentals at least sufficient to pay
the principal of, and interest on the bonds when due.
Mr. Hufford of D. A. Davidson was present along with many other persons to explain the revenue
bond issue for the proposed Life of Montana Building and to answer any questions that might arise. I
Following considerable discussion, and there being no further questions to be answered, Mayor
Sedivy thanked Commissioner MacNab for reconvening the meeting. He also thanked the members of Life
of Montana as well as Mr. Hufford of D. A. Davidson for their interest in explaining this project.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commission
reach a final decision on Wednesday, December 28, 1977 . The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner
MacNab, Commissioner Vollmer and Mayor Sedivy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time it was moved by
Commissioner Vandeventer, seconded by Commissioner MacNab, that the meeting be adjourned, and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande-
venter, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy;
voting No, none.
