The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, November 23, 1977 , at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner MacNab,
Commissioner Vollmer, Commissioner Vandeventer, Commissioner Swanson, City Manager Gesko, City
Attorney Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the regular
I meeting held on November 16, 1977 were approved as submitted.
Award Bids - Bozeman Sewer Rehabilitation Schedule I & II
The Commission was referred to the opening of bids for the construction of Sewer Rehabilitation
Schedule I and Schedule II.
The engineering staff have thoroughly analyzed the bids for the construction of Schedule I -
sewer rehabilitation and repairs, and Schedule II - sewer replacement North Rouse Avenue, re-
commended that Gelco Grouting of Salem, Oregon be awarded the bid of Schedule I on the basis of
their low bid in the amount of $204,735.25, and that White McNeil of Bozeman be awarded the bid
of Schedule lIon the basis of their low bid in the amount of $138,425.00.
The City Manager, having concurred in the recommendation of the engineering staff, recommended
the City Commission to do likewise.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that Gelco Grouting
be awarded the bid on the basis of their low bid in the amount of $204,735.25 and that White-
McNeil be awarded the bid on the basis of their low bid in the amount of $138,425.00 subject to
approval by E.P.A., and that the bid security be returned to the unsuccessful bidders. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commiss-
ioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy; those voting No, none.
Review of Plans and Specifications and "Call for Bids" - Senior Social Center - Opening Dec. 7, 1977
Plans and specifications for the construction of the Bozeman Senior Citizen's Social Center
as prepared by Doug Rand, Architect, 37 East Main Street, Bozeman, was placed before the Commission.
Following a discussion, the City Manager recommended that the plans and specifications as
I presented be approved and a "Call for Bids" for the construction of the Social Center be advertised
to be opened on December 7, 1977 .
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission
concur in the recommendation of the City Manager, and the Clerk of the Commission be authorized
and directed to publish a "Call for Bids" with an opening date of December 7, 1977 . The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commiss-
ioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy; those voting No, none.
Request for consideration: Industrial Revenue Bond Issue for proposed Life of Montana Building
Hearing December 21, 1977 - 7:30 o'clock p.m.
A letter received from Attorney Joseph W. Sabol on behalf of Life of Montana Insurance Company,
Bozeman, Montana, requesting the City Commission to proceed with Chapter 41, Revised Codes of
Montana, 1947, as amended, with the holding of a public hearing insofar as the applicability and
desirability of a limited obligation bond sale for the construction of Life of Montana's new
facilities east of Bozeman, was presented.
Mr. Sabol was present to further explain the request and to introduce Mr. Eugene Hufford of
D. A. Davidson & Company, Inc., who had been retained to handle the sale of the bonds subsequent
to the approval of said sale by the City Commission. The amount of bond issue is not to exceed
$2,000,000.00. Mr. Hufford discussed the mechanics of the bond sale and the things involved in
setting up a bond schedule. He advised the Commission that many cities used this type of finan-
cing to build various projects.
Following discussion, the Commission concurred with the recommendation of the City Manager
I and it was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commission
approve a special meeting to be held on Wednesday, December 21, 1977 , at 7:30 o'clock p.m. The
Clerk of the Commission was instructed and directed to advertise the Notice of Public hearing at
least once a week for three consecutive weeks prior to the date set for the hearing. The first
public notice of the hearing to be advertised on Monday, November 28, 1977, and subsequently, on
December 5 and December 12. This procedure complies fully with Section 11-4103, Revised Codes
of Montana 1947. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner \bllmer, and
Mayor Sedivy; those voting No, none.

Messrs. Scully & Lensink - regarding alternative road format for Kagy and Nineteenth Avenue
Senator Everett R. Lensink and Representative John Scully appeared before the Commission
in regard to the Kagy and North 19th projects. Senator Lensink informed the Commission that he
supported the two-lane facility over the proposed four lanes. He submitted several photos and
a letter from the Ass't Superintendent for Planning of Minneapolis, Minnesota for the records.
Representative John Scully was also present to discuss the proposed four-lane project. He
stated he also favored the two-lane facility. He also expressed Representative Vincent's re- I
grets for being unable to attend the meeting.
Mr. Gesko read a letter received from Representative Dorothy Bradley who was unable to
attend the meeting.
Several other property owners were present to express their views in regard to the proposed
four-lane facility over the two lane.
Representative Scully thanked the Commission for giving them the opportunity to express
their feelings in this regard.
Following a discussion, the City Manager explained that expressions from everyone concerned
either for or against, should be in the hands of the City Commission not later than Friday, Nov-
ember 25, 1977 .
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission
acknowledge the presentations made this afternoon, and that the Letter from A. D. Wittman, Ass't.
Superintendent for Planning, Minneapolis, Minnesota and the letter of Representative Dorothy
Bradley be made a part of these minutes as requested by Senator Lensink. Wednesday, December 14,
1977, be set as the date for making the final decision regarding the format for Kagy and Nine-
teenth Avenue. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, and
Mayor Sedivy; those voting No, none
Dear Senator Lensink:
It was a pleasure to have you visit our office and discuss the Minneapolis
parkway system. I
The basic lane width used in our parkway system is 12 feet. With one lane
in either direction we have built a 24 foot road where no parking is
accommodated. Our traffic engineer estimates this provides a capacity of
10,000 vehicles per day as an average daily traffic volume.

TO THE BOZEMAN CITY COMMISSION:
I regret that I am unable to attend the City Commission meeting today, but my husband
and I are visiting my father in Wisconsin for Thanksgiving. I hope this letter can
be read into the record on the Kagy and North 19th projects.
I have had occasion to review various materials on the proposed 4-lanes -- including
tapes of the recent public hearing on the projects. I am impressed with the strong
positive position that has been taken by residents of the community to the effect that
a 2-lane facility would be sufficiently reliable, efficient, safe and would involve
less intrusion in the neighborhoods affected. A sizeable number of citizens took the
time to present solid arguments in support of their preferred alternative.
In the past, I have been disappointed by instances in which obscure traffic projections
have been used to justify excessive construction. That appears to be the situation in
this case. The offered projections are misleading in their failure to distinguish
between the increased traffic that will be included by the proposed 4-lane construction
from that which would occur due to other uncontrollable factors. Induced traffic in
particular could encourage commercialization in both the Kagy and North 19th areas --
impacts not sufficiently assessed or anticipated to date.
In addition, I am reliably informed that Dr. Lensink and Representatives John Scully
and John Vincent will be discussing the alternative of a 2-lane parkway, such as that I
currently employed in Minneapolis. That type of construction can clearly handle volumes
of traffic in excess of the most grandiose projections for the project areas -- while
providing a pleasant driving experience and maintaining the quality of adjacent neigh-
borhoods. It is being used with success in other areas of the country. I commend
that option to you as a way of handling the traffic needs of the community and being
responsive to the citizens who have clearly expressed themselves on this issue.

ation to the State Highway Department.

Aproval of Revenue Sharing Funds - Installation of New Dual Tone Component Type 3 signal 128
Decibel 3-phase sirens
The City Manager reported that the City has been offered a matching grant for the installation
of Municipal Emergency Warning Sirens. The cost of acquisition and installation for two rotating
sirens is $19,076.00. The grant offer is for half that amount or a cost of $9,538.00.
The City Manager recommended that the Commission accept the grant offer and that the City I
utilize Revenue Sharing Funds for its portion of the cost.
Following discussion, the Commission concurred in the recommendation of the City Manager and
it was moved by Commissioner MacNab, seconded by Commissioner Swanson, that the City Accept the
grant offer for the acquisition and installation for two rotating sirens at a cost of $9,538.00
to be paid out of Revenue Sharing Funds. The motion was carried by the following Aye and No vote:

Bozeman Rotary Club - Status Report for Establishment of Easement to allow free public access
between Graf Park and Gardner Park by means of a pathway.
Dave Fackler of the Planning department appeared before the Commission to present an inform-
ational report on the plans for a recreational pathway in the southern portion of Bozeman. He
stated the pathway was first proposed by the Rotary Club. The purpose of the agreement is to es-
tablish free public access between Graf Park and Gardner Park by means of a pathway located along
said easement. The pathway would be used for walking, jogging, bicycling, horseback riding, and
cross country skiing, with the following reservations:
a) That said easement shall be in force and effect for five years from the date of
the Agreement; and
b) That Eugene Graf, Jr., reserves the right to establish a sixty foot wide east-west
access through said easement, at the place and time of his choosing; and,
c) That usage of said easement shall be strictly limited to walking, jogging, bicycling,
horseback riding and cross country skiing; and,
d) That no hunting, shooting, or use of motorized vehicles (maintenance, emergency and I
policing vehicles excepted) shall be allowed upon said easement.
The Commission thanked Mr. Fackler for the status report on the plans for a recreational
pathway in the southern portion of Bozeman.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Vandeventer, seconded by Commissioner MacNab, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande-
