HomeMy WebLinkAbout1977-11-09 ,3:35 Bozeman, Montana 9 November 1977 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, November 9, 1977 , at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner MacNab, Commissioner Vollmer, Commissioner Vandeventer, City Manager Gesko, City Attorney Berg and the Clerk. Commissioner MacNab opened the meeting with a prayer whereupon the minutes of the regular I meeting held on November 2, 1977, were approved as submitted. Open Bids - Garfield Culvert between Black and Tracy Avenue This was the time and place set for opening bids for the installation of a culvert under East Garfield Street, including construction of ditches and other appurtenances thereto. The affidavit "' for the "Call for Bids" was presented. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the bids be opened and read. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, SemMfssfefte~-SWBftSeft, Commissioner Vandeventer and Mayor Sedivy; those voting No, none The following bids were then opened and read: Lockie Excavating Item 1 thru 8 $17,417.05 Item 9 and 10 4,519.15 White-McNeil Item 1 thru 8 7,445.00 Upon concurrence of the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the bids be referred to the engineering staff for revaluation and a recommendation to be brought in on Wednesday, November 16, 1977 . The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy; those voting No, none. Decision Re-Zone change Perry Metcalf - AS to RS-l 10-Acre Tract The decision on the request of Perry Metcalf to reclassify a 10-acre tract of land from AS to RS-l having been deferred for a period of one week, was again brought before the Commission for a final decision. Mr. Metcalf was present to answer any additional questions. He advised the Commission that I he only wants to subdivide the tract one time. Following further discussion and upon the City Manager's recommendation, it was moved by Comm- issioner Vandeventer, Seconded by Commissioner MacNab, that the decision be delayed for an additional week in order to further study the request and receive a legal opinion from the City Attorney. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Recreation Board - Recommendation regarding park on South Tracy Avenue and bordering Langohr Park The Recreation board, having discussed the petition from the South Tracy Homeowners in regard to vacating lots five through eleven inclusive in the 1962 rearrangement of Block 2 of the University Subdivision recommended that the City take necessary steps to vacate the street and all fifty feet of the street be dedicated for park land and that the stream be left in its natural state. Followng a thorough discussion, it was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the recommendation be referred back to the Park Board and to the residents to deter- mine whether this solution would be satisfactory to all persons concerned. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Recommendation regarding Architectural Design Review Committee The City Manager presented a pn!iminary informational report on the creation and implementation of an architectural design review committee for Bozeman as submitted by Planning Director Paul Bolton. Following discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, I that upon concurrence of the City Manager the Architectural Design Review Committee for Bozeman be delayed until a later date. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy; those voting No, none. Petition SID Improvements - Paving College from Tracy to Black, Harrison from Tracy to Black, Black from College to Southern-most cul-de-sac, and all cul-de-sacs adjoining Black Avenue. A petition received from property owners requesting the development of paving improvement districts on College Street from Tracy Avenue to Black Avenue, Harrison Avenue from Tracy Avenue to Black Avenue, and Black Avenue from College Street to the southern-most cul-de-sac, and all cul-de- sacs adjoining Black Avenue was presented. -- ---- - -- - -~ ----~- ,'336 The Commission concurred in the recommendation of the City Manager and it was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the City acknowledge receipt of the petition and the City staff be instructed to evaluate and consider the request for special improvements. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande- venter, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy; those voting NO, none. Commission Resolution No. 1924 - Estimated Assessment SID No. 561, paving 20th Avenue Koch, Olive And Dickerson Streets - $250,000.00 Commission Resolution No. 1924 levying the estimated assessment for the construction of paving I 20th Avenue, Koch, Olive and Dickerston Streets, SID No. 561 in the amount of $250,000 was presented COMMISSION RESOLUTION NO. 1924 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 561 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 561. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that Commission Resol- ution No. 1924 be provisionally passed and adopted and November 16, be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner MacNab, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Commission Resolution No. 1925 - Estimated Assessment SID No. 562, paving and storm drainage South 23rd Ave. - $320,000.00 Commission Resolution No. 1925 levying the estimated assessment for the construction of paving on 23rd Avenue from College Street north to Babcock Street and Babcock Street east from 23rd to South 20th, SID 562 in the amount of $320,000.00 was presented. COMMISSION RESOLUTION NO. 1925 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 562 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 562. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Commission I Resolution No. 1925 be provisionally passed and adopted and November 16, 1977, be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy; those voting No, none. Commission Resolution No. 1926 - Estimated Assessment SID No. 574, Watermains Hayes Street and Bozeman Creek Annexation to Garfield St. - $17,SOO.00 Commission Resolution No. 1926 levying the estimated assessment for the construction of water- mains on Hayes Street and Bozeman Creek Annexation to Garfield Street, SID 574 in the amount of $17,500.00 was presented. Commission Resolution No. 1928 - Estimated Assessment SID No. 578, Watermain & Sanitary Sewer North 19th Avenue between Beall & Durston Road - $60,000.00 Commission Resolution No. 1928 levying the estimated assessment for the construction of water- I mains and sanitary sewer mains on North 19th Avenue between Beall & Durston Road, SID No. 578 in the amount of $60,000.00 was presented. COMMISSION RESOLUTION NO. 1928 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 578 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 578. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Commission Resolution No. 1928 be provisionally passed and adopted and November 16, 1978 be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy; those voting No, none. Application for Raffle L:icenses - a) Booster Club Sr. Social Center - Nov. 19 - b) Bozeman Junior Class - Nov. 10 - - c) Bozeman Legal Secretaries - Dec. 10 d) Office Education Assoc. - Dec. 20 The City Manager presented an application from the Bozeman Club Senior Social Center along with the required fee, for the purpose of holding a raffle on November 19, 1977 . It was moved by Commissioner Vandeventer, seconded b y Commissioner MacNab, that the Commission approve the application for the raffle license. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, I and Mayor Sedivy; those voting No, none. The City Manager presented an application from the Bozeman Junior Class along with the re- quired fee, for the purpose of holding a raffle on November 10, 1977 . It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission approve the application for the raffle license. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. The City Manager presented an application from the Bozeman Legal Secretaries, along with the required fee, for the purpose of holding a raffle on December 10, 1977 . It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the Commiss- ion approve the above application for a raffle license. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commiss- ioner MacNab and Mayor Sedivy; those voting No, none. The City Manager presented an application from the Office Education Association, along with the required fee, for the purpose of holding a raffle on December 20, 1977 . It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Commission approve the above application for a raffle license. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Reports for October The following reports were presented: I Building Inspector for October Library for October Police Court for October Police Department for October The City Manager commented on the above reports and recommended they be accepted and ordered filed. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. "338 Claims - October~ The payroll claims and the general claims for the month of October were presented. The City Manager had checked the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be instructed to issue warrants in payment thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the claims be approved as presented.
