The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, October 12, 1977 , at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer,
Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, City Attorney Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the regular
I meeting and the special meeting were approved as submitted and revised.
Public Hearing - Conditional Use Permits
A - Gary Schaefer - Upholstery shop 5,000 square feet Lot 22 - Gordon Mandeville
State School Section Subdivision
A) This was the time and place set for a public hearing to consider the request of Gary
Schaefer to allow construction of a 5,000 square foot building to be used as an upholstery shop
on Lot 22 of the GordonManlevi11e State School Section Subdivision. The site is on the north side
of Griffin Drive and east of Whalen's Tire, Inc. The site is zoned M-2-T.
Mr. Gary Schaefer was present and asked the Commission for permission to have a free standing
sign instead of a fixed sign on his building so that it can be seen from Griffin Drive.
The Zoning Commission unanimously approved the conditional use permit reque~ of Gary Schaefer
with the addition of #6 condition to the STAFF RECOMMENDATIONS.
Upon the recommendation of the Zoning Commission, also concurred in by the City Manager, it was
moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission approve the
conditional use permit of Mr. Schaefer with the following conditions:
1. The parking layout be developed per the Planning staff drawing.
2. Sewer and water service be approved by the City Engineer and/or Gallatin County Sanitarians.
3. That 75% of the required hard area be landscaped with vegetative material (grass, shrubs,
trees) to specifically include a minimum of 2 (minimum 2-inch diameter) trees.
4. Signing be limited to one, 50 square foot minimum, internally illuminated, flush
mounted wall sign located below roof1ine.
5. All required site improvements be made within 12 months of issuance of the con-
ditional use permit.
I 6. That the applicant receive a curb cut permit from the County Road Office.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy;
those voting No, none.
B - Donald Weaver - Office building 7,064 sq. ft. South side of Kagy Blvd
B) This was the time and place set for a public hearing to consider the request of Donald
K. Weaver to allow construction of a 7.064 square foot building to be used for offices. The 3-
acre site is on the south side of Kagy Boulevard and~st of and adjacent to Valley View Country
Club. The site is zoned R-O-T.
The Zoning Commission unanimously approved the conditional use permit request of Donald
Weaver per the Planning staff's report with the following conditions.
1. Drainage be approved by the City Engineer.
2. A fire hydrant will be located on the site to the satisfaction of the City
Engineer and Fire Chief.
3. The Planning Staff shall review and approve the final landscape plan which
will include the following:
a. Screening of the loading bay with a vegetative or solid fence.
b. Screen the trash areas on 3 sides by a solid fence or wall.
4. All required site improvements be made within 12 months of issuance of the conditional
use permit. Final improvements agreement to be submitted to insure installation of
required improvements.
Upon the recommendation of the Zoning Commission, also concurred in by the City Manager, it
I was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission approve
the conditional use permit of Mr. Weaver with the above conditions. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson,
Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy; those voting No, none.
South Willson Avenue - Discussion of temporary truck route
The City Engineer made a presentation before the Commission explaining the routes the trucks
have been using. He pointed out the proposed paving projects for the next four to eight years.
He advised the Commission that it would not be practical to designate a temporary truck route at
this time.

After a thorough discussion regarding the hazards of trucks using Willson Avenue, it was
moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the City Engineer and
his staff evaluate the possibility of placing stop signs- either manual or electric -- on Willson
and come back with a recommendation within thirty days as to where they should be placed in lieu
of designating an alternate truck route. The motion was carried by the following Aye and No vote:

Commissioner Swanson, and Mayor Sedivy; those voting No. none.
Commissioner Vollmer said that support from the South Willson people would be appreciated
for the Kagy project.

CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE-
MENT DISTRICT NO. 585 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING
AN ASPHALTIC CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURB AND GUTTER,
AND NECESSARY APPURTANANCES THERETO; ALSO APPURTENANCES NECESSARY TO
STORM DRAINAGE ON EAST LAMME STREET BETWEEN BROADWAY AVENUE AND WALLACE
AVENUE IN THE CITY OF BOZEMAN, MONTANA.

The Commission concurred with the recommendation of the City Manager and it was moved by
Commissioner MacNab, seconded by Commissioner Vollmer, that Commission Resolution No. 1909 be
passed and adopted and November 2, 1977, be set as the date for public hearing. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner
Vollmer, Commissioner Swanson, Commissioner MacNab, and Commissioner Sedivy; those voting No, none.

AN ORDINANCE EXTENDING THE CORPORATE LIMITS OF THE CITY OF BOZEMAN TO INCLUDE A TRACT
OF LAND, COMMONLY KNOWN AS THE NELSON PARCEL, WHICH IS CONTIGUOUS TO THE CITY OF
BOZEMAN, WITHIN THE CORPORATE LIMITS OF THE CITY OF BOZEMAN.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that Ordinance
No. 996 annexing a tract of land known as the Nelson parcel and containing approximately 22.912
acres be passed and adopted. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner
Vollmer and Mayor Sedivy; those voting No, none.
Approve E.P.A No. C300-208 Grant Request and approve Contract Documents
E.P.A. No. C300-208 Grant Request and the contract documents for sewer rehabilitation were
presented. The City Manager recommended that the Contract documents be approved as presented.
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Grant
request and contract documents be approved and the mayor and Clerk of the Commission be authorized I
and directed to sign the contract for the City of Bozeman. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner
Vollmer and Mayor Sedivy; those voting No, none.
CAmpfire Girls - Fund Drive October 14, through October 31
A request from the Camp Fire Girls for permission to hold their annual candy sale on the 14th
through 23rd of October 1977 was presented. It was moved by Commissioner Swanson, seconded by
Commissioner VandevenEā¬r, that permission to hold their annual candy sale be granted. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Comm-
issioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy; those voting No,
none.

Application for Raffle Licens - MSU Physical Education Center - November 18, 1977
The City Manager presented an application from the MSU Physical Education Center, along with
the required fee, for the purpose of holding a raffle on November 18, 1977 .
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Commiss-
ion approve the application for the raffle license for the MSU Physical Education Center. The motion

Commissioner MacNab , Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy; those voting No, none .
Claims
The payroll claims and the general claims for the month of September were presented. The
City Manager had checked the claims and found them to be true and lawful claims against the City
of Bozeman and recommended they be approved and the Director of Finance be instructed to issue
warrants in payment.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the claims be
approved as presented. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer,
and Mayor Sedivy; those voting No, none.
Reports - Library for September 1977
The following report was presented: Library
The City Manager commented on the report of the Library and recommended acceptance thereof.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the report of
the Library be accepted and ordered filed. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer,
Commissioner MacNab and Mayor Sedivy; those voting No, none.
Vacation request by Wendy's Hamburgers
The City Engineer presented a request by Wendy's Hamb urgers for permission to vacate the
west half of the alley between 10th and 11th avenues in Block 4, of the Springdell Addition.
I Wendy's was informed that they would not be allowed access on Main Street.
The Commission requested that the City Engineer come up with a proposal for a decision to be
made on next week.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Vandeventer, seconded by Commissioner MacNab, th~ the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Van-
