October 5, 1977
The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, October 5, 1977 , at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner MacNab,
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, City
Attorney Berg and the Clerk.
I Commissioner Vollmer opened the meeting with a prayer whereupon the minutes of the regular
meeting were approved as submitted.
Open Bids - New 4-wheel drive pickup truck - Water Department
This was the time and place set for opening of sealed bids for the purchase of a new 4-wheel
drive pick-up for the Water department. Affidavit of publication of the "Call for Bids" was presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the bids be opened
and read, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, and Mayor
Sedivy; those voting No, none.
The following bids were then opened and read:
Bozeman Ford, Bozeman - $5,465.00
Robert F. Dye, Bozeman - 5,581.00
Don Norem Chevy-Buick, Bozeman- 6,454.01
The City Manager directed the bids be referred to the Water Superintendent for inspection of
the vehicles, tabulation of the bids, and a recommendation to the City Commission.
Reconsider decision on zone change for Frank J. Trunk - Reclassify an 8.3 acre parcel from R-3
to B-2 North of and adjacent to King Arthur Mobile Home park and fronts on US Highway 191
A letter received from Frank J. Trunk requesting that the Commission reconsider their recent
decision and refusal to reclassify an 8.3 acre parcel from R-3 (Residential-Medium Density) to B-2
(Community Highway Business) having been delayed for one week was presented.
The City Manager recommended that the Commission not allow the reclassification from AS to B-2.
It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the Commission
I rescind the action taken on August 10, 1977 , and approve the alternative recommendation of the Zoning
Commission to reclassify an 8.3 acre parcel from R-3 to B-2-T with a 45-foot setback from the exist-
ing right-of-way so that the land would be available for land acquisition should Highway 191 be
widened. The motion was carried by the following Aye and No vote: those voting Aye being Commis-
sioner Vollmer, Commissioner Vandeventer, and Commissioner MacNab, those voting No being Commissioner
Swanson and Mayor Sedivy.
Continued Hearing, Commission Resolution No. 1899 - McChesney 23.10 Acre Tract Annexation
The hearing on Commission Resolution No. 1899 declaring its intention to extend the boundaries
of the City of Bozeman so as to include a tract of land in the Northeast 1/4 of Section I, T2S, R5E,
MPM, to the City of Bozeman and designated as the McChesney Annexation, having been continued so
that Mr. McChesney could be present, was presented.
Mr. McChesney was present to discuss the annexation with the City Commission.
The City Manager reported there were a couple of issues that had not been resolved between Mr.
McChesney and the City in regard to the manner in which the property would be platted and developed.
These two issues revolved around dedication of street right-of-way in the Southwest sector of the
property, and exact access onto North Seventh Avenue.
Discussion was held regarding the two issues, and a method by which the street dedication
could be provided for was agreed upon.
Documents previously exchanged between Mr. McChesney and the City outlined the points of
agreements and disagreements with regard to this subdivision development. With the inclusion of the
two issues, all has been agreed upon. The street right-of-way in the Southeast sector will be
I dedicated. The street will initially be provided with a gravel surface to meet city standards
similar to all streets within the subdivision. The portion of the street (in the Southeast sector)
which lies within the two southeastmost lots, will not be paved at the time all of the other streets
are paved. This small portion will be paved when needed to provide access to the adjacent property
to the east. Payment for such paving at that time will be provided by the two adjacent lots within
the McChesney Subdivision.

The exact access on North Seventh Avenue has been decided upon between Mr. McChesney and the
City, as well as the Highway Department. As a result of this access change, the inclusion of a new
lot will be created and shown on the final subdivision plat. This approved access onto North Seventh
Avenue will result in a considerable reduction to the initial curb cut from 160' to 40' plus a slight
realignment to the previous road design. The City planning and administrative staffs will insure
that all requirements will be met.
The Mayor declared the hearing closed, and the City Attorney was instructed to draw up a I
Resolution to accomplish the requested extension of the City limits.
Final action - Commission Resolution No. 1900 - Nelson 22.912 Acre Tract Annexation
Having deferred action on Commission Resolution No. 1900 declaring its intention to extend
the boundaries of the City of Bozeman so as to include a tract of land in the North 1/2 of Section I,
T2S, R5E, to the City of Bozeman and designated as the Nelson Annexation until after the McChesney
Annexation hearing, Commission Resolution No. 1900 was presented for a decision.
Attorney Joseph Sabol appeared before the Commission on behalf of Mr. Nelson to explain that
the Nelson annexation should stand on its own.
Following a short discussion, the City Attorney was instructed to draw up a Resolution to
accomplish the requested extension of the City limits.
Consideration of new 4-wheel drive pickup truck.,- Water Department
Upon recommendation of the Water Superintendent, also concurred in by the City Manager, it
was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commission accept
the bid of Robert F. Dye on the basis of their bid in the amount of $5,581.00, it equaling or exceed-
ing the specifications as contained in the "Call for Bids". The low bid of Bozeman Ford did not meet
the specifications as contained in the "Call for Bids". The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner
MacNab, Commissioner Vollmer, and Mayor Sedivy; those voting No, none.
Alleged zoning violation on South Willson Avenue
Attorney Joseph Sabol appeared before the City Commission on behalf of property owners living
on South Willson Avenue in regard to alleged zoning violations on South Willson Avenue. The alleged I
violations have occurred at 1222, 1719 and 1817 South Willson Avenue.
The Mayor indicated the alleged violations were an administrative matter and would be handled
accordingly.
Mrs. James (Bea) Taylor - Citation for Pedestrian Safety 1976
Mrs. James (Beatrice) Taylor, on behalf of the Automobile Association, presented to the
Commission a plaque for no pedestrian fatalities in the City of Bozeman for one year. She commended
the City Commission and the Police Department for being safety-minded.
Mayor Sedivy accepted the plaque on behalf of the City Commission and stated it was with deep
regret that the City of Bozeman lost the award for 1975 and that they would do their best to keep
Bozeman safe in the future.
Ottis Hill from Department of Community Affairs - Establishment of Local Housing Authority
Mr. Ottis Hill of the Department of Community Affairs appeared before the Commission to give
informal explanation as to the relative merits of establishing a Public Housing Authority in Bozeman.
The Public Housing Authority is an excellent vehicle for assisting the housing needs of low
and moderate income groups in Bozeman. Low Housing Authorities are public bodies authorized by
state and federal law to plan, develop and operate public housing programs in their communities.
Low Housing Authorities work best in tight housing market with high rents as they can assist
low income families with rents without getting into financing large structures.
Mr. Hill recommended that if there is any interest in the establishment of Local Housing
Authority, the City Commission, the City and the County should arrange a meeting to discuss the
possibility of establishing Local Housing Authority as a positive step towards dealing with a lack I
of affordable housing for many local residents.
Mayor Sedivy thanked Mr. Hill for making the presentation.
Purchase Land - Fred Leibrand, corner of Durston and North 19th Avenue
The City Manager reached an agreement with Fred Leibrand for the acquisition of Lot 23, of
Block A, Maple Terrace Addition in order to preserve it for right-ofway acquisition for Nineteenth
(extended) at an acquisition price of $10,500.00 and asked the Commission to endorse the purchase
of same.

It was moved by Commissioner Vollmer, seconded by Commissioner Swanson that the Commission
endorse the purchase of Lot 23, of Block A, Maple Terrace Addition, and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson,
Commissioner Vandeventer, Commissioner MacNab, and Mayor Sedivy; those voting No, none.
Proclamation - Fire Prevention Week - October 9-15, 1977
Mayor Sedivy announced his proclamation designating the week of October 9-15, 1977 , as "Fire
I Prevention Week" and called upon all departments and agencies of the City Government to participate
actively in a campaign for improved fire safety.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission
concur in the Mayor's proclamation and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner
Vandeventer, and Mayor Sedivy; those voting No, none.
Application for raffle license - FOE No. 326 (Eagles) November 5, 1977
The City Manager presented an application from the Montana Realtors Education Foundation, along
with the required fee, for the purpose of holding a raffle on November 5, 1977 .
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission
approve the application for the raffle license. The motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vande-
venter, Commissioner MacNab, and Mayor Sedivy; those voting No, none.
Set Date for meeting to consider the priorities for road improvements
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that a special
meeting be called for the purpose of considering the priorities for road improvements. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy; those voting No,
none.

The following reports were presented:

The City Manager commented on the reports and recommended they be accepted and ordered filed.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the reports be
accepted and ordered filed. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer,
and Mayor Sedivy; those voting No, none.
Removal of parking for a sufficient distance from the intersection
A brief discussion was held in regard to cars and/or trucks being parked next to intersections
and if they did in fact create a hazard. It was suggested that this area be restricted to small car
parking, thereby eliminating the problem of trucks with campers, etc. It was felt by some that this
would be discriminatory.
It was moved by Commissioner MacNab, seconded by Commissioner Vandeventer, that the Street
Superintendent and the Chief of Police be directed to visually inspect the intersections as drivers
of a vehicle and in the presence of a vehicle being parked there; if the vehicle obstructs the view,
then red zoning should be initiated. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner MacNab, Commissioner Vandeventer, Commissioner Vollmer, Commissioner
Swanson, and Mayor Sedivy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Vandeventer, seconded by Commissioner MacNab, that the meeting be adjourned, and the
I motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy; those voting No,
