The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, September 20, 1977, at 1:15 o'clock p.m. Present were Mayor Sedivy,
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Acting City Manager Murie,
City Attorney Berg, and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the I
regular meeting were approved as submitted.
A. M. Buckingham - Variance to place trailer house on property for sister and brother-in-law
to live in - south of Mathew siding and .3 mile north of radio station KBOZ
A request by A. M. Buckingham for a variance on their property to place a trailer house
for her sister and brother-in-law to live was presented before the Commission. The property is
located south of Mathew Siding and .3 mile north of radio station KBOZ and consists of .71 of an
acre.
Mrs. Buckingham informed the Commission that her sister and brother-in-law were elderly with
emphysema.
After much discussion, it was moved by Commissioner Vollmer, seconded by Commissioner
Swanson, that the Commission delay decision for one week until we receive a doctor's statement.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none.
Request to conduct MSU Homecoming parade on Saturday, October 8, at 10 a.m.
A letter received from Dan L. Rieder requesting permission to conduct the MSU Homecoming
parade on Saturday, October 8, at 10 a.m. The parade is to begin at Buttrey's parking lot and
proceed down Main Street to the corner of Main and Rouse, where it will disband.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the
request be granted with police participation to insure traffic control. The motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner
Vandeventer, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. I
Commission Resolution No. 1907 - Fix date, maturity date and amount of bonds - SID No. 577
The Acting City Manager presented Commission Resolution No. 1907, setting date, maturity
date, and principal amount of bonds issued in Special Improvement District No. 577, entitled:

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN FIXING THE DATE,
MATURITY DATE AND THE PRINCIPAL AMOUNT OF BONDS TO BE ISSUED IN SPECIAL
IMPROVEMENT DISTRICT NO. 577.
It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that Commission
Resolution No. 1907 be passed and adopted, and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Swanson,
and Mayor Sedivy; those voting No, none.
Commission Resolution No. 1908 - Fix date, maturity date and amount of bonds- SID No. 579
The Acting City Manager presented Commission Resolution No. 1908 setting date, maturity
date, and principal amount of bonds issued in Special Improvement District No. 579, entitled:

It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that Commission
Resolution No. 1908 be passed and adopted, and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner
Vandeventer, and Mayor Sedivy; those voting No, none.
Request by Wayne Arnold - Allowing placement of mobile signs onto roof I
A request by Mr. Wayne Arnold's attorney for permission to place mobile signs onto roofs
in order to protect his property was presented before the Commission.
The Building Inspector felt that this request does not meet the requirements of a fixed
sign code or the conditions of a mobile sign.

After an extensive discussion, it was moved by Commissioner Vandeventer, seconded by
Commissioner Vollmer, that the Commission delay action on Mr. Arnold's request for one week in order
to gather information on how other cities deal with this situation at the Montana League of Towns and
Cities convention being held this week. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, and Mayor Sedivy; those voting
No being Commissioner Swanson.
I City Engineer - Authority to attend APWA Fall meeting, Idaho Falls, October 6-7
The American Public Works Association is scheduled to meet in Idaho Falls on October 6-7, and
the Acting City Manager recommended that the City Engineer be authorized to attend the meetings.
It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that City Engineer
Art Van't Hul be authorized to attend the meeting and, it being in the public interest, his expenses
be paid out of the appropriate fund and that he also come back with a report to the Commission.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vandeventer, CommissionerVollmer, Commissioner Swanson, and Mayor Sedivy; those voting No, none.
Gambling license - Fraternal Order of Eagles - Bingo
The Acting City Manager presented an application from the Fraternal Order of Eagles, along with
$250.00, for a bingo license.
Upon the recommendation of the Acting City Manager, it was moved by Commissioner Swanson,
seconded by Commissioner Vandeventer, that the Commission approve the application for the bingo
license. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Swanson, Commissioner Varideventer, Commissioner Vollmer, and Mayor Sedivy; those
voting No, none.
Request to sell antiquing kits - Order of Rainbow
A request by the Order of the Rainbow to sell antiquing kits by phone and door-to-door
as a fund raising activity was presented before the Commission.
It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the request
of the Order of the Rainbow be granted to allow door-to-door sales of antiquing kits, but not by
I phone. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy; those
voting No, none.
Report: Director of Public Service
The following report was presented: Director of Public Service
The Acting City Manager commented on the report and recommended it be accepted and ordered filed.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the report be
approved and ordered filed. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy;
those voting No, none.
Doug Rand - presentation on Senior Citizens Center -

Doug Rand, architect for the Senior Social Center, appeared before the Commission explaining
the floor plans for the ground floor and 10ft of the building. He eXplained his cost of $390,000
would include a crawl space (that could become a full basement), the ground floor and a roughed-in
10ft. If more funds would become available, they could provide for a rough basement and a driveway
canopy. He felt that the construction bids could take place in about two months.
The Commission thanked Mr. Rand for his presentation.
Gambling License for Gary E. Davis - Scoop Bar
The Acting City Manager presented an application from Gary E. Davis, Scoop Bar, 714 West Main,
along with the appropriate fee of $500, for a gambling license for the purpose of operating two tables.
Upon the Acting City Manager's recommendation, it was moved by Commissioner Swanson, seconded
I by Commissioner Vandeventer, that the application of Gary E. Davis for the issuance of a gambling
license be approved. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Swanson, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Sedivy; those
voting No, none.
Request by Senior Social Center to solicit funds
A request by the Senior Social Center to solicit funds door-to-door during the week of
October 10 through 14 was presented before the Commission.

It was moved by CommissionerVandeventer, seconded by Commissioner Vollmer, that the request
of the Senior Social Center be granted, and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Swanson,
and Mayor Sedivy; those voting No, none.
Lion's Club Annual Light Bulb Sale
A request from the Bozeman Lions Club for permission to hold their annual light bulb sale
was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that I
permission to hold their annual light bulb sale be granted. The motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner
Vandeventer, and Mayor Sedivy; those voting No, none.
Authority to send three planners to Montana Association of Planners - Land Use Planning Conference
September 29-30, Great Falls
The Montana Association of Planners is scheduled to meet in Great Falls for a Land Use Planning
Conference on September 29-30, and the Acting City Manager recommended that Dave Fackler, Jerry
Herman, and Paul Bolton be authorized to attend the conference.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that Dave Fackler,
Jerry Herman, and Paul Bolton be authorized to attend the conference, and, it being in the public
interest, their expenses be paid out of the appropriate fund and that they come back with a report
to the Commission. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Swanson, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Sedivy; those
voting No, none.
Controlling the dog situation
The Mayor expressed his concern regarding the increasing number of stray dogs in the City and
the inadequate manpower to deal with this problem. The Acting City Manager explained that there are
anti-recession funds from the Federal government for the purpose of creating new jobs that could be
used for existing programs such as dog martialing.
After some discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Swanson,
that the City use these Federal funds to hire another dog martial. The motion was carried by the I
following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson,
Commissioner Vandeventer, and Mayor Sedivy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Swanson, seconded by Commissioner Vandeventer, that the Meeting be adjourned, and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson,
Commissioner Vandeventer, Commissioner Vollmer, and Mayor Sedivy; those voting No, none.
