The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, September 7, 1977 , at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner
MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko,
City Attorney Berg and the Acting Clerk.
I Commissioner MacNab opened the meeting with a prayer whereupon the minutes of the regular
meeting were approved as submitted.
Absence of the Clerk of the Commission
In the absence of the Clerk of the Commission, it was moved by Commissioner MacNab, seconded
by Commissioner Vollmer, that Mrs. Diane Krupinsky be appointed as Acting Clerk of the Commission,
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy;
those voting No, none.
Open Bids - Crushed aggregate material- Street Department
This was the time and place set for receiving bids for 8,000 tons of crushed aggregate
material for the Street Department. Affidavit of publication of "Notice to the bidders" was
presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the bids be
opened and read, and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab,
and Mayor Sedivy.
Gardner Sand and Gravel, Inc., Bozeman - $23,920.00
Pioneer Ready Mix, Bozeman - 20,000.00
The City Manager recommended that the above bids be referred to the Street Department for
tabulation and recommendation to be made later on during today's meeting.
Open construction bid for SID's 577 and 579
I This was the time and place set for the opening of bids for construction of street paving
on SID No's. 577 and 579. The affidavit of publication for the "Call for Bids" was presented.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the bid
of Long Construction Company be opened and read. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner
MacNab, Commissioner Vollmer, and Mayor Sedivy; those voting No, none.

Upon the City Manager's recommendation, it was moved by Commissioner Vandeventer, seconded
by Commissioner MacNab, that the bids be referred to the City Engineer for tabulation and recom-
mendation to be made on Wednesday, September 14. The motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner
Vollmer, Commissioner Swanson, and Mayor Sedivy; those voting No, none.
Decision regarding conceptual approval for Tewage Development - Gene Cook et al - 96 apartment
units and 112 condominium units on E~ Lot 1 and all lots 2A and 2B of Boylan's Addition - 15 acre
tract southwest corner of Eleventh and Kagy
The decision of the request of Gene Cook, ~ aI, to grant conceptual approval to a planned
unit development consisting of a small office, 96 apartment units, and 112 condominium units on the
East half of Lot 1 and all of Lots 2A and 2B of the Boylan Addition having been deferred for a
period of one week was again brought before the Commission for a final decision.
Following an extensive discussion, it was moved by Commissioner MacNab, seconded by Commis-
I sioner Vollmer, that a decision be delayed for a period of three weeks until the City Engineer has
further investigated the matter of acquiring rights-of-ways along the Kagy extension from 11th to
19th Streets.
Appearance by the South Willson Improvement Association
Mr. Bob Evans read a letter from Professor John DeHaas of the Montana Historical Society
approving a portion of South Willson Avenue as an historical district. Mr. Evans also inquired
of the Commission regarding a designated truck route and the safety problem for school children
crossing Willson Avenue. It was pointed out that the Association would like trucks to use state
highways rather than residential streets.
The City Manager recommended that we come back a month from today to give consideration to
the South Willson traffic, pedestrian safety, and designating a truck route.

Reconsideration: Decision re rezoning request - Maurice Klabunde - AS to B-2-T (from meeting of
August 31, 1977)
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commission
rescind the action taken at last week's meeting approving the reclassification from AS to B-2-T as
requested by Mr. Klabunde. Those voting Aye being Commissioner Swanson and Commissioner Vandeventer; I
those voting No being Commissioner MacNab, Commissioner Vollmer, and Mayor Sedivy. The motion to
rescind was defeated for lack of a majority.
Consideration of Far West Annexation petitions
A petition signed by approximately 76 property owners petitioning the City of Bozeman to
annex a portion of the land located immediately to the west of the present west city limit line
lying north of US 191 to Durston Road, including the east and west sides of Northwestern Drive
was presented.
Following discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Swanson,
that the Commission acknowledge receipt of the petition and the staff be instructed to make a
preliminary study. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab,
and Mayor Sedivy; those voting No, none.
Commission Resolution No. 1905 - Expressing condolences to widow and family of Jack Harding
Commission Resolution No. 1905 extending condolences and sympathy to the bereaved widow and
family and friends of Jack F. Harding was presented.

CONDOLENCES AND SYMPATHY TO ERNA V. HARDING, BEREAVED WIDOW, AND FAMILY OF
JACK F. HARDING.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that Commission
Resolution No. 1905 be passed and adopted. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner I
MacNab, Commissioner Vollmer, and Mayor Sedivy; those voting No, none.

Appointments to Technical Advisory Committee, Montana Traffic Safety Study
The Mayor announced the appointments of Ralph Zimmer as representative of the Pedestrian/
Traffic Safety Committee and Richard McConnen as citizens' representative to the Technical
Advisory Committee.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission
concur in the Mayor's appointments, and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commis-
sioner Vandeventer, and Mayor Sedivy; those voting No, none.
Application for raffle license - Bozeman High School Senior Class - September 26
The City Manager presented an application from the Bozeman High School Senior Class along
with the required fee for the purpose of holding a raffle on September 26.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission I
approve the application for the raffle license for Bozeman High School Senior Class. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Swanson, Commissioner Vandeventer, Commissioner MAcNab, and Mayor Sedivy; those voting
No, none.
Absence of City Manager - September 13-20
The City Manager requested authorization to be excused from September 13 through September 20
and that the Director of Finance Grant D. Murie be designated as Acting City Manager during this
period.

authorization be granted, and the motion was carried by the following Aye and No vote: those

Changing Conunission meeting from September 21 to September 20
I Because the Montana League of Cities and Towns will hold its 46th annual convention in
Helena from September 21-24, it was moved by Conunissioner Vandeventer, seconded by Conunissioner
MacNab, that the regular meeting of the Conunission be held on September 20 instead of September 21.
The motion was carried by the following Aye and No vote: those voting Aye being Conunissioner
Vandeventer, Conunissioner MacNab, Conunissioner Vollmer, Conunissioner Swanson, and Mayor Sedivy;
those voting No, none.
Adjournment
There being no further business to come before the Conunission at this time, it was moved by
Conunissioner MacNab, seconded by Commissioner Vollmer, that the meeting be adjourned, and the
motion was carried by the following Aye and No vote: those voting Aye being Conunissioner MacNab,
