HomeMy WebLinkAbout1977-06-29 Bozeman, Montana 251 June 29, 1977 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, June 29, 1977, at ~i15 o'clock p.m. Present were Mayor Sedivy, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Acting City Manager Murie and the Clerk. I Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the regular meeting held on June 22, 1977, were approved as submitted. Tan.9"_e' s Addi "t:}..9!: Having continued the hearing on the rezoning of Block 3 of Tange's Addition pending study and a report by the staff on the recommendations contained in the petition, it was again presented for discussion and final action. Mr. Tange was present to discuss the zone change for this area. He stated the property owners in that area were more concerned about Oak Street and were worried about becoming a sea of houses among commercial property. The property they are concerned about is not adjacent or contiguous to theb.ouses, and they are not able to see this particular property. Mr. Tange has plans to develop this area and would like to get started as soon as possible. Several property owners were present to discuss the zone change. The Zoning Commission having reviewed the report voted unanimously to recommend approval of the zone change from an R-3 to a B-2-T zone on Block 3 of Tange's Addition It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that I Block 3 of Tange's Addition be rezoned from R-3 to B-2-T. The motion was carried by the following Aye .and No vote;: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. Open Bids_: Seal Coat Materials - Street DeEartment This was the time and place set for receiving bids for HB-436-254, Seal Coat Project, for 63,750 square feet seal coating as approved by the Montana State Highway Department. Affidavit of publication of "Notice to the Bidders" was prese9ted. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the bid of White & McNeil Excavating, it being the only bid submitted, be opened and read. White & McNeil Excavating, Rte 4, Forest Park #28 - $39,334.40 The Commission concurred with the recommendation of the Acting City Manager, and it was moved by commissioner Swanson, seconded by Commissioner Vandeventer, that the bid of White & McNeil Excavating be referred to the engineering staff for study and final recommendation on Wednesday, July 6, and the motion was carried by I the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. ~onditional Use Permit- Thrifty Scot Motel (Oak and North 7th Avenue) The Zoning Commission, not having made a recommendation in regard to the Thrifty Scot Motel, the matter had been tabled pending study and a report. - ---- - ~~~- 2~'O tJ~ The Zoning Commission, having reviewed the report, voted unanimously to recom- mend approval of the conditional use permit application with the following conditions: One Sign - 17' x 14' - 20' high One Sign - 280 sq. ft. = 30' high Following a discussion, the Commission concurred in the recommendation of the Acting City Manager, and it was moved by Commissioner Vandeventer, seconded by I Commissioner MacNab, that the Commission approve the conditional use permit applica- tion with the above conditions on the two signs. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy: those voting No, none. Section 312 Program - scheduled for July 20, 1977 Section 312 Program scheduled for Wednesday, June 29, 1977, has been rescheduled for July 20, 1977. !:~E5 De~ication for F~i~_~~and 4th The City County Planning Board presented information on Figgins Addition Phase 3 and 4 and recommended that approximately two acres of park land dedication required in Figgins Addition 3 and 4 be located within Figgins Addition 4. The Commission concurred in the recommendation of the Planning Board, also concurred in by the Recreation Board, and it was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that all of the park land dedication be located within Figgins Addition 4 in the amount of two acres. The motion was I carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. Prospectus for new library for City of Buzeman The Friends of the Library and the Library Board were present to present a prospectus for a new library for the City of Bozeman. Several members of the Library Board as well as the' Friendsr:.,of the Library were present to answer any questions regarding the proppectus. The Mayor thanked the members of the ';two boards for the presentation of such a prospectus and for all the work they have done in preparing the prospectus. He advised the board that the entire commission is very interested in the proposed project and want to work On it in an expeditious manner. It was moved by Commiss'ioner Vollmer, seconded by Commissioner Swanson, that the City Commission acknOwledge receipt of the prospectus for a new library and that itb:e'.given every consideration. Wally Byam Parade - 12:00, Fourt~Ef July 1977 A letter received from Elton McLain of the Wally Byam Caravan requesting permission to hold a parade on July 4, 1977, at 12: 00 , was presented. 2~C) tJ' "U The parade will begin at Lincoln Drive and Eleventh Avenue and continue to Kagy, east on Kagy to Seventh Avenue, north on Seventh.,Avenue to. Grant, West on Grant to Eleventh, south on Eleventh to Lincoln where they will disband. It was moved by Commissioner Swanson, seconded by Conllaissioner Vandeventer, I that permission be granted the Wally Byam Canavan to conduct the parade as indicated above. Erwin requesting permission to operate a Hot Dog 'push cart' business on Main Street from North Seventh Avenue to Rouse Street and all ,adjacent corners within this area was presented. The price of the hot dogs will be 35~ and if the push cart is to be operated in front of a downtown business a fee of $25 will be charged for advertising purposes. The advertisement may be placed on the push cart. Following a thorough discussion, the Acting City Manager recommended denial of the use of public streets for the purpose of a push cart. It was moved by Commissioner Vandeventer, seconded by Corrmissioner MacNab, that the request to operate the Hot Dog ~'push~cart' in the downtown area be denied. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner I Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy; those voting No, none. Housing Program COMMISSION RESOLUTION NO. 1886 I A RESOLUTION ASSURING THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT THAT THE CITY OF BOZEMAN, MONTANA, APPROVES ALLOCATION OF FUNDS TO ENCOURAGE CONSTRUCTION AND REHABILITATION OF HOUSING LOCATED WITHIN THE POLITICAL JURISDICTION FOR HOUSEHOLDS IN NEED OF HOUSING ASSISTANCE, VESTING THE CITY MANAGER WITH THE RESPONSIBILITIES OF COORDINATING THE ACTION OF PRIVATE HOUSING DEVELOPERS AND THE U.S. DEPARmMBBT00F HOUSING AND URBAN DEVELOPMENT TO ASSURE THAT SUCH DEVELOP- MENT OR REHABILITATION IS IN THE INTEREST, SAFETY AND GENERAL WELFARE OF THE COMMUNITY. as prepared by the City Attorney whereby the City of Bozeman assures the U.S. Depar~meBt of Housing and U~ban Development that the construction and rehabilitation of rent subsidy assisted housing is in the interest of the general welfare of the Community of Bozeman, Montana, and endorses implementation of such program was presented. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that Commission Resolution No. 1886 assuring the United States Department of Housing and Urban Development that the City of Bozeman approved the allocation of funds to encourage construction and rehabilitation of housing located within the political jurisdiction for households in need of housing assistance be passed and adopted. City of Bozeman Study Commission - Use of Punds The Acting City Manager presented a letter from Torlief S. Aasheim, Chairman of the Bozeman Study Commission, stating that the Bozeman Study Commission spent $11,843.24 during the course of its duties, and that according to law one-half of this cost is to be paid from the State fund and one-half from City funds. The cost 21/f"1',...'~.." , . tJi to each is $5,921.62. The Study Commission received $20,000 in State funds which leaves a total of $14,078.38 due the State of Montana. City Manager Gesko requested that the City of Bozeman be permitted to use the amount due the State for the purpose of preparing administrative and personnel manuals and/or recodification of city ordinances. Although the Bozeman City Com- I mission had not received information that such use of these funds is permissable, they did take action of June 20, 1977, to permit such use of the funds in the amount of $14,078.38 as requested if permissible. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the City of Bozeman accept the money until an opinion is received from the Attorney General. Statement of Completion - City of Bozeman Sewer Rehabilitation - C. W. Schmid The certificatel_:~of the engineer of Thomas, Dean & Hoskins, Inc., notifying the City that the construction of the Sewer Rehabilitation EPA Project No. C-300208-02, constructed by C. W. Schmid, Inc., has been completed in accordance with plans and specifications was presented. The Acting City Manager concurred in the recommendation of the engineers and recommended that the project be accepted and approved by the City Commission and 1- final payment made. This final acceptance does not relieve the contractor of his responsibility of negl..igence or faulty materials or workmanship within the standard period provided for by law. The contractor has furnished a performance bond equal to the contract bid to guarantee material and workmanship for a one-year period to commence upon _final -acceptance.
