HomeMy WebLinkAbout1977-05-25 293 ,::.J ,_ Bozeman, Montana May 25, 1977 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, May 25, 1977, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner MacNab, commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, Assistant City Manager Wolf, City Attorney Berg and I the Clerk. Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the regular meeting held on'May 18, 1977, were approved as submitted. Memorandum of Agreement Bozeman Urban Area - Mayor & Clerk to sign A Memorandum of Agreement for continuing transportation planning in the Bozeman Urban Area by and between the State of Montana, Department of Highways, the City of Bozeman and the County of Gallatin was presented. It is the desire of the Federal Highway Administration, and the signatory agencies to have future transportation projects for the Bozeman Urban Area based on a continuing, comprehensive transportation planning process carried on cooperatively by the State and Local Community. The planning process is intended to continue indefinitely and shall be maintained as long as the Agreement is in force. Following discussion and upon the City Manager's recommendation, it was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the City of Bozeman enter into the Memorandum of Agreement for continuing transportation planning in the Bozeman Urban Area and the Mayor and Clerk of the Commission be authorized and I directed to sign the Agreement on behalf of the City of Bozeman. The motion was carried by the following Aye and No vote: those.voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. Consideration of Ordinance No. 990 - Notification and fee structures for rezoning and conditional use permits Ordinance No. 990 amending certain sections of the Bozeman Municipal Code relating to notice of public hearings and fee schedules for conditional usesJ variances and amendments, entitled: ORDINANCE NO. 990 AN ORDINANCE AMENDING SECTIONS l8.09.070, l8.72.030, 18.75.050, 18.93.01/10, 18.93.050, AND 18.96.030 OF THE BOZEMAN MUNICIPAL CODE RELATING TO NOTICE OF PUBLIC HEARINGS AND FEE SCHEDULES FOR CONDITIONAL USES, VARIANCES AND AMENDMENTS, AND CHANGE TO THE ZONING TITLE AND PROVIDING FOR AN EFFECTIVE DATE. as prepared by the City Attorney was presented. No permit, zone change, conditional use, or variance shall be issued unless or until such costs, charges, fees, or expenses have been paid in full. I The Commission concurred in the recommendation of the City Manager, and it was moVed by Commissioner Vollmer, seconded by Commissioner Swanson, that Ordinance 990 be passed and adopted and shall be in full force and effect thirty days No. from its final passage. Muscular Dystrophy Bowl....A-'l'hon ~ June 3 The City Manager presented an application from Rudy's Distributing, along with the required fee for a raffle license for the Huscular Dystrophy Bowl-A-Thon to be held on June 3, 1977. Upon recommendation of the City Manager, it was moved 'by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commission approve the application I for the raffle license. Proclamation ~ American Legion Auxiliary Poppy Sale Days .,.,May 27 & 27 In accordance with the American Legion Auxiliary, Mayor Sedivy proclaimed May 27 and 28 as "Poppy Day" in the City of Bozeman and urged every citizen to give generous recognition to this program and to obtain and wear a Memorial Red Poppy tp pay tribute to those many members of our Armed Forces who sacrificed their lives in the defense of our great Nation. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Mayor's proclamation be endorsed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy; thoseyvoting No, none. Bond Sale for SIDs .... SID No. 576 Watermain and Sanitary Sewer - West Park Manor, Second Addn. - $88,000 SID No. 578 Watermain & Sanitary Sewers Lateral Mains - West I Park Manor, First Addn. - $60,000 The City Manager stated according to the affidavit of pUblication, this was the time and place set for the bond sale of Special Improvement District Nos. 576 and 578. The Mayor and City Manager outlined the procedure for conducting this bond sale and stated that the amount of bonds to be sold for each district vould be the same as the advertised amount and announced that the City was ready to conduct the bidding on the bonds of SID No. 576 in the amount of $88,000.00. A sealed bid submitted by D. A. Davidson and Company, Great Falls, along with a good faith check in the amount of $4,400.00 as prescribed by the Notice of Sale, and bidding 7.20% plus a premium of $28 was opened and read. It was then announced the City was ready to conduct oral bidding. First National Bank of Bozeman and Grande & Company of Seattle, having presented their good faith checks in the amount of $4,400.00 as prescribed by the Notice of Sale, oral bidding began. The final best oral bid was as follows: First National Bank, Bozeman - 6.75% Grande & Company, Seattle - 6.70% It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the I sale of the bonds for Special Improvement District No. 576, in the amount of $88,000 be awarded to Grande & Company of Seattle, in the amount of 6.70%. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. 2"01 . '('.j', The Mayorthenann:olln-ced~that the City was ready to conduct the bidding on the bonds of SID No. 578 in the amount of $60,000.00. A sealed bid submitted by D. A. First Security / and First National Bank Bank of Bozeman and Grande & Company of Seattle, having presented their good faith checks in the amount of $3,000.00 as prescribed by the Notice of Sale, oral bidding began. The final best oral bid was as follows: - ~ First Security Bank, Bozeman - 6.40% - Grande & Company, Seattle .... 6.45 plus $25 It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the sale of the bonds for Special Improvement District No. 578, in the amount of - $60,000.00 be awarded to First Security Bank of Bozeman, in the amount of 6.40%. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, and Mayor Sedivy; those voting No, none. Award Construction Bid for SID's 576 and 578 (Water mains and Sanitary sewer) The consulting engineers, Thomas, Dean and Hoskins, Inc. , and the City engineer- igg staff, having prepared a final tabulation of the bids submitted for the construc- tion of watermains, sanitary sewer lines and sewer laterals in SID No's 576 and 578, I recommended that the bid be awarded to Johnston Excavating, l431 South Fourth Avenue, on the basis of their low bid in the amount of $89,439.50, it equaling or exceeding all specifications in the "Call for Bids". The Commission concurred with the recommendation of the engineers, also con- curred in by the City Manager, and it was moved by Commissioner Vollmer, seconded by Commissioner Swa.nson, that Johnston Excavating be awarded the bid for the construction of SID No's. 576 and 571 in the amount of $89,439.50. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, and Mayor Sedivy; those voting No, none. Request for beer license from Softball Association for May 28-29,-1977 The City Manager ~resented an application from the Bozeman Softball Association for permission to obtain a beer license for May 2S:and 29, 1977, along with the required fee. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, I that the Bozeman Softball Association, having met all requirements, be granted a license to sell beer at the Recreational Complex on May 28-29, 1977. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. ",226 Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the meeting be adjourned, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor sedivy~ those voting No, none.
