HomeMy WebLinkAbout1977-05-04 208 Bozeman, Montana May 4, 1977 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, May 4, 1977, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, Assistant ity Manager Wolf, City Attorney Berg and the Clerk. Commissioner Vollmer opened the meeting with a prayer whereupon the minutes of the regular I meeting held on April 27, 1977, and the Special Meeting held on May 2, 1977, were approved as read. Consideration of Bids for sodium silico-fluoride - opened April 27, 1977 The Water Superintendent and the engineering staff having checked the bids on the purchase of 42,000 pounds of sodium silicofluoride recommended that the bid of Van-Waters & Rogers, Billings, Montana, in the amount of $15.54 per cwt., it being the lowest bid and meeting or exceeding the specifications as contained in the "Call for Bids" be accepted. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission concur in the recommendation of the Water Superintendent and engineering staff, also concurred in by the City Manager, and accept the bid of Van Waters & Rogers, Billings, on the basis of their bid in the amount of $15.54, it being the lowest bid and equaling the specifications as contained in the "Call for Bids". The motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. Property Exchange - request to authorize Mayor and Clerk of Commission to execute Warranty Deed conveying property to Life of Montana Insurance Company A warranty deed whereby the City of Bozeman granted unto the Life of Montana Insurance Company of Bozeman a tract of land located within the Southwest one-quarter of Section Eight, Township Two South, Range Six East, MPM, and containing 12.50 acres, more or less, was presented for signature by the Mayor and Clerk of the City Commission. Following discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that action on the warranty deed be deferred for clarification by the City Attorney for the best I interest of all concerned. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, and Mayor Sedivy; those voting No, none. Discussion of site for new senior center The City Manager told the Commissioners the Senior Center Project was at the site selection stage and it appeared the seniors favored the North Grand site but before any action could be taken on the site, notice of its availability had to be received in writing from HUD of Denver so as not "" to jeopardize any further funding. HUD has been notified by telephone and in writing and they have responded verbally that the North Grand site would be available for a senior center but the written confirmation has not yet been received. Open Bids - One 1977 or 1978 Van Type Truck - Water Department This was the time and place set for opening of sealed bids for the purchase of one 1977 or 1978 Van-type truck for the Water Department. The affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy; those voting No, none. The following bids were then opened and read: Bozeman Ford - Bozeman - $4,500.00 Rolfe & Wood, Inc., - Bozeman Option 1 - 4,889.47 Op tion 2 - 5,169.47 Option 3 - 4,722.07 I The City Manager recommended that the bids be referred to the Water Superintendent and the City staff for evaluation and a final recommendation-on Wednesday, May 11, 1977 . It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the bids be referred to the Water Superintendent and City staff for evaluation and recommendation, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. 20.9 Open Bids for Sidewalk construction program This was the time and place set forclOpening bids for the repairing and reconstruction of miscellaneous sidewalks and curbs. Affidavit of publication of "Notice to Bidders" was presented and it was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the bids be opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, and Mayor I Sedivy; those voting No, none. The following bids were then opened and read: Baltrusch Construction Co - Box Ill, Havre - $31,429.00 , Concrete Specialties - Bozeman, MT - 39,876.50 Intermountain Constr. - Bozeman, MT - 42,265.50 The Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the bids be referred to the City engineers for final tabulation, consideration and recommendation on Wednesday, May 11, 1977 . The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. Request from adult group to be allowed to consume beer during league picnic - Lindley Park A letter received from Paul Joubert requesting permission for their bowling group to consume beer during a league picnic at Lindley Park was presented. During the discussion, the City Attorney reminded the Commission that an Ordinance is a law and that granting an exception to the law would be beyond the scope of the Commission. An ordinance may be revoked or amended. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Commission amend the ordinance to authorize consumption of beer but prohibit the consumption of wine or beer in a public park. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy; those voting No, none. I It was then moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission deny the request for the bowling group to consume beer during a league picnic at Lindley Park. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. ?jd..mmu. WI. jO: to require physical data and economic impact studies for proposed major commercial and industrial developments A proposed ordinance for the purpose of providing and guiding the development of all major commercial and/or industrial development, establishing suitable criteria upon which to assess the impacts of such proposals, and providing review procedures that such developments as proposed, conform to all comprehensive or master plans of the City and their respective goals and policies was presented. Mr. Daum, who is proposing the development of the Main Mall as well as many interested persons were present to express their views on this particular item on this community. The City Manager read a letter received from Guy Sperry, Executive Vice President of the Bozeman Chamber of Commerce, and Mr. Mikkelsen read a letter received from John Vincent, State Representative. John Vincent requested that the Commission hold an evening meeting to consider the proposed ordinance requiring physical data and an economic impact statement for major developments in Bozeman. He stated in so doing the Commission would be serving the best interests of the community by allowing many concerned people the opportunity to participate in this critically important decision. The Commission concurred in the recommendation of the City Manager, and it was moved by I Commissioner MacNab, seconded by Commissioner Vollmer, that a public information meeting be called for Thursday, May 19, 1977 , at 7:30 o'clock p.m., the place to be announced at a later date. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. Request to place banner across Main Street by Montana State University Outdoor Club A request from the Montana State University Outdoor Club for permission to place a banner across Main Street was presented. The banner would remain across the street for a period of seven to ten days. 210 Following much discussion, it was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Fire Department not be responsible for the erection or removal of banners but that the group wishing to place a banner across the street first get a permit from the City and that they provide for the erection and removal of the banner and that a deposit of $25.00 be required and returned to the organization only if the banner is removed within seven to ten days after the final date of the activity. The motion was carried by the following Aye and No vote: those voting I Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. Proclamations - a) Safety Awareness Days b) Respect for Law Week c) Municipal Clerks Week d) Old Americans Month - May Several members of the Bozeman Junior High School appeared before the Commission in regard to National Safety Awareness Days and to urge the adults, as well as the young people, to work hand in hand in an effort to make Bozeman a more safe place in which to work. Mayor Sedivy proclaimed the week of May 9 through May 21, 1977 , as "Safety Awareness Days" in accordance with Bozeman Junior High School students and the Bozeman Police Department and urged all citizens, young and old, to get involved, participate and support all activities during Safety Awareness Days and all year long. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab that the Commission endorse the Mayor's proclamation. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy; those voting No, none. Mayor Sedivy proclaimed the week of May 1-7, 1977 , as "Respect to Law Week" and asked all citizens of Bozeman to join with the Optimists in carrying the message of respect for law to other citizens, and by ecample, exercise responsible citizenship. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission endorse the Mayor's proclamation. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. I In accordance with a request from both Houses of Congress, Mayor Sedivy proclaimed the week of May 9-15, 1977 , as "Municipal Clerk's Week" in recognition of the vital services the Municipal Clerk performs and the outstanding dedication to the community she represents. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission concur in the Mayor's proclamation and that an expression of thanks be extended to Erna Harding. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner , Vandeventer, Commissioner MacNab, and Mayor Sedivy; those voting No, none. Mayor Sedivy proclaimed Mayas "Older Americans Months" in accordance with action in commu- nities all across the nation in honor of our older citizens and urged all citizens to focus their attention on the older Americans. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commission endorse the Mayor's proclamation as presented. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer; and Mayor Sedivy; those voting No, none. Application for Gambling License: Oaks Bar & Cigar Store (New Owner) The City Manager presented an application from the Oaks Bar and Cigar Store along with the appropriate fee of $500.00 for a gambling license for the purpose of operating two tables. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Commission concur in the recommendation of the Chief of Police, also concurred in by the City Manager, and approve the application for the issuance of the gambling license. The motion was carried by the following I Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy; those voting No, none. Reports: The City Manager commented on the report of the Building Inspection Department and recommended it be accepted and ordered filed. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the report be accepted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. 211 Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the meeting be adjourned, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, I Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, and Mayor Sedivy; those voting No, none.
