The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, April 27, 1977, at l:15 o'clock p.m. Present were Mayor
Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commis-
sioner Vandeventer, City Manager Gesko, Assistant City Manager Wolf, City Attorney
Berg and the Cilierk. I
Commissioner Sedivy opened the meeting with a prayer whereupon the minutes of
the regular meeting held on April 20, 1977, were approved as read.

In concurrence with the recommendation of the City Manager, it was moved by
Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission designate
a special meeting to be held on Monday, May 2, 1977, for the purpose of taking
action on Commission Resolution No. 1870 - providing Sor the issuance of bonds in an
amount not to exceed $400,000 to provide building and equipping a new senior center;
and to officially swear-in the newly- and re-elected Commissioners. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Lehr-
kind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor
Vollmer; those voting No, none.
Appointment and Reappointments:
Mayor Vollmer announced his appointments and reappointements to the various
City Boards as follows: I
Board of Adjustment - James W. Drain to Effective May 1, 1977
replace Keith Swanson to Dec. 31, 1979
Cemetery Board - Reappoint Roy Ayres to Dec. 31, 1979
Police Commission - Reappoint Donald Cobb to April 30, 1980
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that
the Commission concur in the appointment and reappointments made by the Mayor.-
The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner
Lehrkind, and Mayor Vollmer; those voting No, none.
Public Hearing, Commission Resolution No. 1871 - SID No. 579 - Henderson Paving
Commission Resolution No. 1873 - Creating SID No. 579
This was the time and place set in Commission Resolution No. 1871 to hear
protests to the creation of Special Improvement District No. 579, paving construc-
tion on portions of Hayes Street shown on the subdivision plat of Tract 12, Bozeman
Creek Annexation, to the City of Bozeman. Affidavit of publication of Notice and
the Clerk's mailing certificate, stating all property owners had been notified as
required by law were presented. I
There were no written protest$ on file and no one appeared to protest verbally.
The Mayor declared the hearing closed and in concurrence with the recommenda-
tion of the City Manager, it was moved by Commissioner Taylor, seconded by commis-
sioner Vandeventer, that Commission Resolution No. 1873, entitled:

Open Bids for Sodium Silico-Fluoride
This was the time and place set for opening bids for the purchase of 42,000
pounds of Sodium Silicofluoride. The affidavit of publication of the "Call for
Bids" was presented. It was moved by Commissioner Vandeventer, seconded by
Commissioner Lehrkind, that the bids be opened and read, and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer;
those voting No, none.
The following bids were then opened and read:

The Commission concurred in the recommendation of the City Manager, and it

be referred to the Water Superintendent and the engineering staff for tabulation
and final recommendation on Wednesday, Mary 4, 1~77. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commis-
sioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer;
those voting No, none.
Consideration of Ordinance No. 988 to require vaults at Sunset Hills Cemetery
Having delayed action on Ordinance No. 988 requiring vaults for all adult
interments at Sunset Hills Cemetery for a period of one or two weeks for additional
input, it was again presented for discussion.
Several interested persons were again present to discuss the use of vaults
and to again register their protests. Eldon Dahl of Dahl's Funeral Home was
present to further explain the additional fee which would be involved as a result
of this requirement for burials. Two ministers from the Ministerial Association
appeared to object to the ordinance. They felt it would increase the cost of
I burials, preclude the option of "simple" burial, and make it necessary to purchase
vaults at retail prices through local mortuaries.
Following continued discussion, the City Manager indicated that he had received
protests only from two members of the clergy and felt it apparently indicated no
general opposition to the ordinance.
It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer,
that the Commission continue action on the ordinance indefinitely but not permanently

for the purpose of obtaining further input. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vande-
venter, and Commissioner Lehrkind; those ,voting No being Commissioner Taylor and
Mayor Vollmer.
Announcement of results of the Pool Naming Contest: Doug Ferkin I
The City Manager announced that Doug Ferkin was the winner of the Bozeman
Lioness Club contest to name the 50-meter pool as the result of a Pool naming
contest. DougJs entry in the contest was the "Bozeman Swim Center". The Lioness
Club will also be responsible for the installation of the sign.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that
the Commission concur in the judges' choice of naming the 50-meter pool "Bozeman
Swim Center" and the Bozeman Lioness Club be granted permission to install the sign,
and a swimming pass be presented to Doug Ferkin as winner of the reward. The
motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vande-
venter, and Mayor Vollmer; those voting No, none.
Consideration of a Resolution which would require environmenta~/economic impact
statements for all proposed maJor new,developments
Commission Resolution No. 1874 declaring the concern of the Bozeman City Com-
mission with problems which accompany growth in all areas: Residential, commercial,
and mndustrial as prepared by the City Manager was presented, entitled:

The City Manager read in full a memorandum addressed to the City Commission
and dated April 27, 1977. This memorandum outlined the need for such a resolution.
The City Manager thereupon elaborated somewhat on the reasons contained with the
memorandum" and thereby introduced the commission discussion of this matter.
Many interested persons were present to discuss the subject in question.
Following a thorough discussion, the Commission concurred in the recommendation
of the City Manager, and it was moved by commissioner Taylor, seconded by Commissioner
Vandeventer, that Commission Resolution No. 1874 be passed and adopted and the City
Attorney and City staff be instructed to draw up an ordinance to be brought before
the Commission on Wednesday, May 4, 1977. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandevente~
Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none.
Plans & Specifications - SID No. 576 - Watermain & Sanitary Sewer Construction I
West Park Manor - Second Addition
SID No. 578 - Watermain & Sanitary Sewer Construction
Lots 1-17 Inc., Blk. l, West Park Manor - F1rst Addn.
Plans and specifications covering the proposed improvement in Special Improve-
ment District No. 576 for construction of watermains and sanitary sewers, and
Special Improvement District No. 578 for construction of watermains and sanitary
sewers as prepared by Thomas, Dean & Hoskins, Inc. , consulting engineers, was
placed before the Commission.

Upon recommendation of the City Manager, it was moved by Commissioner Vande-
venter, seconded by Commissioner Lehrkind, that the plans and specifications as
presented be approved and the Clerk of the Commission be authorized and directed
to publish a "Call for Bids" for the construction of Special Improvement District
I No. 576 and 578 with an opening date of May 18, 1977, and to advertise for the
sale of bonds in the approximate amount of $88,000.00 for SID No. 576 and $60,000.00
for SID No. 578 to be received on May 27, 1977. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vandeventer, Com-
missioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmerr
those voting No, none.
Consider Change Order on SID 562 (Storm drainage & Street Paving on Babcock at 20th)
Change Order No. 1, SID No. 562 prepared by Thomas, Dean & Hoskins, Inc. , to
become a part of the original contract for street paving and storm drainage on Bab-
cock Street and North 20th Avenue was presented.
Description - Additional excavation to lower gas main and allow
placement of 18' reinforced concrete storm at
intersection of 20th Avenue and Babcock Street.
Purpose - To allow clearance of gas main and storm drain.
Cost - Actual Cost (enclosed listing) Total - $348.75
The City Manager concurred with the engineers and recommended that Change
Order No. 2 be accepted and approved as presented.

the Change Order be accepted and approved and the Mayor and Clerk be authorized
and directed to sign for the City, and the motion was carried by the following Aye

none.
Request by Softball Association to convert the main room at the Recreation Complex
Building for use as a concession stand
A request from the Bozeman Softball Association to convert the main room at
the Recreation Complex Building for use as a concession stand was presented. The
Softball Association will pay all expenses for the conversion.
Following a discussion, the Commission concurred in the recommendation of the
City Manager, and it was moved by Commissioner Sedivy, seconded by Commissioner
Taylor, that the Commission approve the request from the Bozeman Softball Associa-
tion to convert the main room at the Recreation Complex Building for use as a con-
cession stand. The motion was carried by the following Aye and No vote: those
I voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer,
Commissioner Lehrkind, and Mayor Vollmer; those voting No, none.
Request by Water Department to purchase copper tubing
The Water Department has need for copper tubing, and the City Manager requested
authorization to purchase the copper tubing at an approximate cost not to exceed
$4,000.00.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that
the City Manager be granted authorization to purchase the copper tubing at a cost

Request by Water Department to advertise for bids for vibratory roller
The Water Department has need for a new double-drum, walk-behind diesel- I
powered vibratory roller and the City Manager requested that the purchase be autho-
rized.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind,
that the purchase as requested by authorized and the Clerk of the Commission be
directed to issue a "Call for Bids" for the purchase of the Vibratory Roller, to be
opened on May 11, 1977, and the motion was carried by the. following Aye and No vote:
those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner
Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting >No, none.
Petition - Requesting construction of a Youth Center
A petition signed by students under the age of 18 petitioning the City of
Bozeman to construct a Youth Center in Bozeman for students under 18 years of age
to go to play pool, pinball, foosball, and dance, was presented.
Following a discussion, it was moved by Commissioner Lehrkind, seconded by
Commissioner Sedivy, that the Commission acknowledge receipt of the petition as
presented. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Com- I
missioner Vandeventer, and Mayor Vollmer; those voting No, none.
Application for Raffle License - Cancer Fund, May 22, 1977
The City Manager presented an application from the Cancer Society along with
the required fee for the purpose of holding a raffle on May 22, 1977.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that
the Commission approve the application for the raffle license for the purpose of
holding a raffle on May 22, 1977. The motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Com-
missioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none
proclamation - National Secretaries' Week - April 24-30, 1977
Mayor Vollmer proclaimed the week of April 24-30, 1977, as "National Secretaries'
Wee~'in the City of Bozeman and asked that all businesses and industries join in
giving due recognition to this group, paying special attention to Secretaries' Day
on April 27, 1977.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, I
that the Mayor'S proclamation be endorsed. The motion was carried by the following
