HomeMy WebLinkAbout1977-04-20 195 Bozeman, Montana April 20, 1977 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, April 20, 1977, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commis- sioner Vandeventer, City Manager Gesko, Assistant City Manager Wolf, City Attorney I Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the regular meeting held on April 13, 1977, were approved as read. Commissioners' Bond and Oath of Office - Duncan S. MacNab, Keith D. Swanson, and - James W. Vollmer The official bond and oath of office in the amount of $5,000.00 as required by Ordinance No. 524, Section 2.08.020 of the Bozeman Municipal Code for Duncan S. MacNab, Keith D. Swanson, and James W. Vollmer, newly and re-elected Commissioners of the City of Bozeman, was presented. The bond oovers a period of four years, beginning May 1, 1977 and ending December 31, 1981. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the bonds be approved as recommended by the City Attorney and ordered filed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vande- venter, and Mayor Vollmer; those voting No, none. I The proposed orditiairiXe requiring vaults for all adult interments at Sunset Hills Cemetery, having been tables for a period of two weeks for further investigation in regard to the use of materials other than wood which would meet City specifications, was agaIDn presented for discussion. Several interested persons were present to discuss the use of vaults and to register their protests. Directors from both funeral homes were also present to explain the addition fee which would be involved as a result';of this requirement for burials. Objections dealt less with the vault requirement than with the failure or refusal of City Cemetery crews to leave the coffin during the graveside service. The Park Superintendent stated that wooden boxes just did not hold up and the additional expense for leveling the lots was prohibitive. Following an extensive discussion, the City Manager recommended that the Ordinance be passed and adopted. It was moved by Commissioner Sedivy, seconded by Commissioner 'l'aylor, that the Commission pass 'thtf drdi,hancA!!~ . ~s~ requiring vaults for all adult interments at Sunset Hills Cemetery. Those voting Aye being Commis- sioner Taylor and Mayor Vollmer; those voting No being Commissioner Lehrkind, I Commissioner Sedivy, and Commissioner Vandeventer. Variance - R0ger Craft to ins,!.all parking sisE~t B~zeman Hote~_ A letter received from Roger Craft of the Bozeman Hotel requesting a variance to the sign code to install two parking lot control signs and seven creek barrier signs was presented. All signs are made to state and federal highway specifications. Wooden signs may be erected in a Fire Zone I.so long as they do not exceed I twenty square feet and are not lighted, and since the signs exceed the square footage by just four square feet. the Building Official recommended approval of -the variance. The Commission concurred in the recommendation of the Building Official, also concurred in by the City Manager, and it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the variance to the sign code to install two parking lot control signs and seven creek barrier signs be approved. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Verification of Pledged Securities- March 31, 1977 In compliance with the provisions of Section 16-2618, R.C.M. , 1947, Mayor Vollmer and Commissioner Sedivy had examined the receipts of Depository Bonds and Securities held by the Director of 'inance as Security for City funds deposited in Bozeman banks. Securities were found to be in order. It was moved by Commissioner Vandeventer, seconded :by Commissioner Lehrkind,.. I that the securities be approved and a list of these set forth in the minutes of the meeting. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission cohtinue action on Commission Resolution No. 1870 providing for the issuance of general municipal obligation bonds and the City Attorney be instructed to further investigate the possibility of re- phrasing the Resolution to read - Providing for the issuance of General Municipal Obligation Bonds of the City of Bozeman in an amount up to $400,000.00. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Request to sell poppies May 27-28, 1977 - American Legion Auxiliary A letter received from Mrs. Ida C. Love, Poppy Chairman, American Legion Auxiliary, requesting permission to sell poppies on Friday, May 27 and Saturday, May 28, 1977, in memory of those who have given their lives in defense of our Great Nation, was presented. I It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that permission be granted the American Legion Auxiliary to sell poppies as indicated above. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. Easement Agreement - Right of Way for Water Main - Henderson's Development - East of Willson Avenue and South of Garfield Street An Easement and Right of Way Agreement by and between Carroll Henderson and the City of Bozeman for the purpose of installing, operating, using, repairing, replacing, maintaining and removing said watermain and appurtenances and for such other rights of access and incidental rights thereto upon and across a parcel of land beginning at a point on the east line of the Butte Addition to the City of 199 Bozeman, said property being the NW~, Section 18, T6S, R6C, and consisting of thirty feet in width, was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Easement and Right of Way Agreement, having been executed by the property owner, be approved and the Mayor and Clerk of the Commission be authorized and directed to sign for the City. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commis- I sioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Application for Raffle Licenses: a) Welcome Wagon - May 7, 1977 b) Special Olympics Fin. Comm. - May 21, 1977 c) Bozeman Babe Ruth Baseball - May 10, 1977 The City Manager presented an application from the Welcome Wagon, an application from the Special Olympic Finance Committee, and the Bozeman Babe Ruth Baseball Association, along with the required fee, for the purpose of holding a raffle. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commissioner concur in the recommendation of the City Manager and approve the three applications for the raffle licenses and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none.
