HomeMy WebLinkAbout1977-03-30 17,8 Bozeman, Montana March 30, 1977 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, March 30, 1977, at l:l5 o'clock p.m. Present were Mayor Vollmer, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, City Manager Gesko, Assistant City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Sedivy opened the meeting with a prayer whereupon the minutes of I the regular meeting held on March 23, 1977, were approved as read. Open Bids for Construction Work - re SID No. 574, Watermain Improvements Bozeman Creek Annexation . . This was the time and place set for opening bids for Wat~rmain improvement.s, Special Improvement District No. 574 - Bozeman Creek Annexation - Hayes to Garfield. Affidavit of publication of "Notice to Bidders" was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the b.l.ds pe opened and read, and the motion was carried by the foilowing Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. The following bids were then opened-and read: Boylan Excavating, Bozeman - $18,039.00 c. W. Schmid, Inc. , Bozeman - 29,052.00 T & T Builders, Billings - 23,511.20 The Co~~ission concurred with thc recommend~tion of the City Manager, and it was moved by Commissioncr Taylor, seconded by Co~missioner Vandeventer, that the bids be referred to the Thom~s, Dean & Hoskins, Inc. , Consulting Engineers, and the City I engineering staff for evaluation and recommendation on Wednesday, April 6, 1977. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Public Hearing - Commission Resolution No. 1869 -SID No. 575 - Paving Hayes Street Bozeman Creek This was the time and place set in Commission Resmlution No. 1869, to hear protests to the creation of Special Improvement District No. 575. Affidavit of publication of Notice and the Clerk's mailing certlfical~, stating all property owners had been notified as required by law were presented. Mr. John Hanton of 1304 South Willson Avenue and Mr. James VanWinkle of l222 South Willson Avenue were present to strongly protest the creation of the district. Both claimed they would not benefit by the creation of this district as it is pro- posed to serve only for ingress and-:egress to the Henderson development. Hayes Street cannot continue through the development, nor proceed eastward from the development. Both individuals suggested they be omitted completely from the SID I for paving the street. Discussion revolved around alternatives to the proposed SID. One such alterna- tive would be to narrow the street width to approximately twenty-five feet and pro- hibit parking on both sides. The second alternative would be to simply retain the street width as proposed, but exclude the abutting property owners from any assess- ment. The Commission directed the staff to puruse at least these two alternatives , with Mr. Henderson and to report back one week hence regarding Mr. Henderson's reactions. 179 Public Hearin s ~ a) Conditional Use Permit A lication b Ron Gollehon for a bar an foosball parlor b) Conditional Use Permit Application by Valley Imports for warehouse storage This was the time and place 'set for a public hearing to consider the request of Ronald Gollehon for a conditional use permit to establish a bar and foosball parlor I on the ground floor of the existing building located at 15 Tai Lane. The area in question is zoned B-1 (Neighborhood-Busines~ and a bar and foosball parlor would be a conditional use (retail use serving the consumer directly). Mr. Konuners, an attorney representing the applicant, stated the owners of the building support the expansion. The applicant is not starting a new bar but only expanding on the present location of the Gold Rush Bar. The Zoning Commission having held a public meeting andhav~ng considered the Planning Staff's report, recommended approval of the conditional use permit applica- tion with the following conditions attached: l. Tha-t the one (l) sign permitted by the ordinance be internally or indirectly illuminated, be 25 square feet or less in size, and be of a subdued character (no harsh or glaring color, etc. ) . Further, that the specific sign be reviewed by thePlanRing Staff as to its compliance to this criteria before installation. The Commission concurred in the recommendation of the Zoning Commission, and it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commis- sion concur with the Zoning Commissioner's recommendation and approve the conditional use permit application for Ronald Gollehan with the above condition. The motion was I carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, ~nd Mayor Vollmer; those voting No~none. This was the time and place set for a public hearing to consider the request of Valley Imports for a conditional use permit to use the old Eddy's Bakery warehouse and the open lot next to it for storage of new automobiles. The warehouse is located at the intersection of North 6th Avenue and Villard Street. The area is zoned R-3. The conditional use permit is sought to allow the exchange of one non-conforming use (the bread warehouse) to another non-conforming use (the car storage). The Zoning Commission, having held a public meeting and having considered the Planning staff's report, recommended approval of the conditional use permit applica- tion and would suggest a six-point alternative, which would hopefully be acceptable to all parties: l. That all new car storage be placed within the- building and no open storage be allowed on the site. 2. That the applicant remove all existing signs and no other signs be added to the building or property. I 3. That the building and outside area be maintained in a clean, orderly fashion. 4. That the unloading of cars from transport trucks not be conducted in this area. 5. That no additional outside lighting be installed. 6. That no type of business or operation other than inside storage of cars be allowed. The Commission concurred in the recommendation of the Zoning Commission, and it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the . Commission approve the conditional use permit application for Valley Imports, Inc. , . - 180 with the above conditions. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Conunissioner Vandeventer, conunissioner Sedivy, and Mayor Vollmer; those voting No, none. Consigerati~n of proposed revisions to Cemetery Regulations The City Manager presented proposed revisions to the Cemetery Regulation as I recommended by the Cemetery Board for the consideration of the Conunission. Following discussion, the Commission concurred in the recommendation of the Cemetery Board, also concurred in by the City Manager, that an ordinance be drafted to revise the Cemetery regulations to include a vault of steel, fiberglass or con- crete on all adult burials. Status and Direction re proposed sidewalk program for 1977 The City Engineer's staff, having completed their survey of Walks and Curbs within the City of Bozeman, presented a copy of the proposed repairs and/or installa~ tion of the Walks and Curbs for the year 1977 to the Commission for their inspection. The proposed prograrfi will include the balance of the northeast quadrant not completed last season, the northwest quadrant west of North Seventh Avenue, and the I sidewalk in the University Subdivision located in front of Langohr's Greenhouse. The Commission acknowledged receipt of the survey of Walks and Curbs Proposed program within the City of Bozeman, and tabled the 1977 program for a period of two weeks for inspection, further study and contact with additional property owners, then to be brought back for further consideration and a final decision on Wednesday, April 16, 1977. Consideration of Ordinance No. 985 - Amending the Zoninq Code to Authorize barber ana-beauty shops l.n a B-3 zone Ordinance No. 985 amending Section 18.48.020 of the Bozeman Municipal Code, was presented, entitled: ORDINANCE NO. 985 AN ORDINANCE AMENDING SECTION 18.48.020 OF THE BOZEMAN MUNICIPAL CODES BY ADDING BARBER AND BEAUTY SHOPS AS A PERMITTED USE IN A B-3 DISTRICT. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that Ordinance No. 985 be passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, I Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Application for Raffle Licenses - a)Monforton School - April 30, 1977 b)Gallat1.n Valley Snowmobile - May 21 The City Manager presented applications from the Monforton School, along with the required fee of $10.00 for a raffle license, for a raffle to be held on April 30, 1977, and from the Gallatin Valley Snowmobile Association, along with the required fee of $10.00 for a raffle license, for a raffle to be held on May 21, 1977. 181 It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission approve the applications for the raffle licenses for the Mon- forton School and the Gallatin Valley Snowmobile Association. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy, and Mayor Vollmer; those I voting No, none. Application for two beer licenses (retailer -off premises) by Kwik-Way Stores - renewa The City Manager presented applications and the appropriate fee for off-the premises beer licenses for Kwik'Way Stores No. 31 and No. 32 for the year 1977. Upon recommendation of the City Manager, it was moved by Commissioner Vande- venter, seconded by commissioner Sedivy, that the Commission approve the applica- tion for the renewal of the license for Kwik Way Store No. 31 and approve the application for the new license for Kwik Way Store No. 32. The motion was carried by the following Aye and No vote: those voting Aye being Conunissioner Vandeventer Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none.
