The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, March 23, 1977, at 1:15 o'clock p.m. Present were Mayor
Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commis-
sioner Vandeventer, City Manager Gesko, Assistant City Manager Wolf, City Attorney
Berg and the Clerk I
Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes
of the r~gular meeting held on March 16, 1977, were approved as read.
Authorize Absence of Commissioner Lehrkind on March 30, 1977
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, tha t the
absence of Commissioner Lehrkind be authorized from the meeting of March 30, 1977,
in compliance with Section 11-3245, R.C.M. , 1947. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those
voting No,none.
Governor Thomas L. Judge - Present to visit with City Commission
The City Commission was honored by a visit from the Honorable Governor Thomas L.
Judge. Governor Judge advised the Commission that he had had several opportunities
to speak to the Montana League of Cities and Towns. The state for too many years
left the local government out and he as Governor wants to strengthen the ties with
the local government and would like to work closer together with the Montana League
of Cities and Towns. I
Public Hearin - Vacation of Portion of Mulberr - Broadwa to
M~ - Ord~nance No. Vacat~ng port~on Street
This was the time and place set for a public hearing to consider the request
of Mr. & Mrs. John Apperson for vacating a portion of Mulberry (Davis) Street
between Blocks 41 and 46, Northern Pacific Addition to the City of Bozeman. Affidavit
of publication of Notice and the Clerk's mailing certificate stating all property
owners had been notified as required by law was presented. There were no written
protests on file and no one appeared to protest verbally.
The hearing was closed, and it was moved by Commissioner Taylor, seconded by
Commissioner Vandeventer, that the Commission concur in the recommendation of the
City Manager, that Ordinance No. 984, entitled:

TION OF STREET BETWEEN BLOCKS 41 & 46, NORTHERN PACIFIC ADDITION

as prepared by the City Attorney vacating a portion of Mulberry (Davis) Street
between Blocks 41 and 46, Northern Pacific Addition, be passed and adopted. The
motion was carried by the following Aye and No vote: those voting Aye being I

sioner Sedivy, and Mayor Vollmer; those voting No, none.
South Willson Improvements Association - re proposed traffic and truck route regulations
The petition signed by a number of property owners and residents of South
Willson Avenue requesting the City Commission to consider forthwith the implementation
of a truck route ordinance for the City of Bozeman and consider excluding all heavy-
vehicle traffic (with the exception of school buses) on residential city streets

which have a speed limit of 25 miles per hour, having been turned over to the City
staff for additional study and a recommendation was presented.
Attorney Andriola, representative for the South Willson Improvements Associa-
tion, was present to discuss the subject matter.
A letter addressed to the City Manager from the Assistant City Manager and a
letter from A. Glen white, Chairman of the Pedestrain-Traffic Safety Committee,
I regarding a four-way stop at College Street and Willson Avenue and speed limit
signs, was read.
Many interested persons, as well as property owners were present to discuss
the subject and to make suggestions. They recommended that one of the goals for
the City should be to designate alternate truck routes in order to keep the trucks
out of the community and keep the town aesthetic. Establishing a four-way stop
sign at South willson Avenue and West College Street would be better than a bouncing
ball school crossing.
The City Manager commented on the South Willson traffic situation. All of the
input has been given to the traffic department for evaluation. It is a critical
area that needs some work done on it. A four-way stop sign would not be justified
-- stop signs are for safety purposes and do not slow down traffic. A bouncing
ball school crossing designator at the intersection of South Willson Avenue and
West College Street would safeguard pedestrians during busy hours, but not impede
the flow of traffic during the rest of the day. The City has agreed to install
some speed limit signs but is not in agreement that a four-way stoplight be in-
stalled at the intersection of South Willson Avenue and West College Street. Placing
an amber light at the above intersection to be used only during the busy hours of
the day would be one solution.
The Assistant City Manager injected that they had just gotten the reports
back and are working with the schools to get the help needed. By next month there
I should be a delegation of prople from the school to make the traffic count.
Following extensive discussion, Mayor Vollmer acknowledged the presence of
the South Willson Improvements Association and concurred in the recommendation of
the City Manager that two speed limit signs be installed on South Willson Avenue.
The City Manager thanked the South Willson Improvements Association, Mayor
Vollmer, the City Commission and everyone that worked on the proposed traffic and
truck route regulations stating that he would like to see the residential neighbor-
hood character preserved.
Request from Henry VanderVos to Construct a private road from North Montana to North
Rouse, for Access to Building Site
A letter received from Tom and Henry Vandervos requesting a variance to
Section 18.69.050 of the Bozeman Municipal Code regarding the use of one access and
driveway for two structures located at 414 North Montana Avenue, was presented.
Following discussion, it was moved by Commissioner Vandeventer, seconded by
Commissioner Lehrkind, that the City Commission grant a variance to Section 18.69.050
of the Bozeman Municipal Code and approve Mr. VanderVos's request with the approval
of the City Engineer and the Building Official and that he comply with the minimum
20' driveway and minimum setback. The motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind,
Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting NO, none.
Request for Sign Variance - Sunrise Remnants - 11th at Babcock Street
I A letter received from Sunrise Remnants, 1013 West Babcock Street, requesting
a variance to the sign code to approve the usage of two business signs located at
1013 West Babcock Street, was presented.
The Building Official stated the signs were freestanding, away from structures,
and he saw no reason not to allow the requested variance.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that
the City Commission approve the variance to the sign code for the usage of two
business signs located at 1013 West Babcock Street, and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Lehrkind,
Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor
Vollmer; those voting No, none.

Call for Bids to Request removal/razing/clearance of three ( 3 ) structures presently
on City Park Lands
The Park Department has a need to remove three buildings owned by the City of
Bozema~ and the City Manager requested permission to call for bids for the removal
of these buildings.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the
request for the removal of the three buildings be authorized, and the Clerk of the I
Commission be directed to issue a "Call for Bids" for the removal of one frame
building at the South Side park, one frame building in Bogart Park, and one log
building in Bogart Park, to be opened on April 6, 1977. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commis-
sioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer;
those voting NO, none.
Request from MSU Booster Club for permission to display a Banner across Main Street
A letter received from Larry Aasheim of the Montana State University Booster
Club requesting permission to place a banner across Main Street for the Bobcat Booster
Drive, was presented.
The banner would be put up on Saturday, March 26, and would be taken down the
week of April 4, 1977. A $25.00 deposit would be required, which would be returned
to the organization if the banner is removed within the specified time.
A discussion was held on whether or not a fee should be charged if the Fire
Department were called upon to use their ladder truck for the placing and removal
of banners or other miscellaneous uses.
Following a thorough discussion, it was moved by Commissioner Taylor, seconded
by Commissioner Vandeventer, that the Commission grant permission for the Booster
Club to place a banner across Main Street and that in the future the Fire Department
ladder truck may be used for erection and removal of banners, signs, etc. , for the
schools, city and county without charging a fee. Those voting Aye on the motion I
being Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those
voting No being Commissioner Lehrkind, and Commissioner Sedivy abstained.
It was then moved by Commissioner Lehrkind, seconded by Commissioner Sedivy,
that the former motion be rescinded, and that it be passed again with the inclusion
of non-profit, service-club type organizations also at no charge. Those voting
Aye on the revised motion being Commissioner Lehrkind, Commissioner Vandeventer,
Commissioner Sedivy, and Mayor Vollmer; those voting No being Commissioner Taylor,
and the motion was carried.
Application for Raffle Licenses: a) Big Brothers & Sisters of Gallatin County - April 14
b) 4-H Leaders - May 7
c) Help Center (323 So. Wallace) - April 30
The City Manager presented applications from the Big Brothers and Sisters of
Gallatin County along with the required fee of $10.00 for a raffle license for a
raffle to be held on April 14, 1977, from the 4-H Leaders along with the required
fee of $10.00 for a raffle to be held on May 7, 1977, and from the Help Center
( 323 So. Wallace) along with the required fee of $10.00 for a raffle license for
a raffle to be held on April 30, 1977.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer,
that the Commission approve the applications for the raffle licenses for the Big
Brothers and Sisters of Gallatin County, the 4-H Leaders and the Help Center. The
motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner I
Sedivy, and Mayor Vollmer; those voting NO, none.
Report - Director of Public Service
The City Manager commented on the report of the Director of Public Service
and recommended it be accepted and ordered filed.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind,
that the report of the Director of Public Service be accepted and ordered filed,
and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Com-
missioner Taylor, and Mayor Vollmer; those voting No, none.

Adjournment
There being no further business to come before the Commission at this time,
it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the
meeting be adjourned, and the motion was carried by the following Aye and No vote;
those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner
