The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, February 23, 1977, at 1:15 o'clock p.m. Present were
Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vande-
venter, City Manager Gesko, Assistant City Manager Wolf, City Attorney Berg, and the
Clerk. I
Leave of Absence Mayor Vollmer - 23 February 1977
Upon recommendation of the City Manager, it was moved by Commissioner Lehrkind,
seconded by Commissioner Taylor, that due to illness, the absence of Mayor Vollmer be
authorized in compliance with Section 1l-324S, R.C.M., 1947, and that Commissioner
Sedivy be appointed as President Pro-Tempore during his absence. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Lehr-
kind, Commissioner Taylor, Commissioner Vandeventer, and Commissioner Sedivy; those
voting No, none.
Commissioner Sedivy opened the meeting with a prayer whereupon the minutes of
the regular meeting held on February 16, 1977, were approved as read.
Request from First Security Bank for Vacation of an Additional 28' Portion of the
alley between Bozeman and Rouse Streets
A petition received from the First Security Bank of Bozeman requesting vacation
of the westerly 28.5 feet of the current alley and more particularly described as all
that part of Lots 4, 5, 32 and 33 of Block C of the Original Townsite, in the City
of Bozeman, was presented. I
Following a discussion, and in concurrence with the recommendation of the City
Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Taylor,
that the petition be referred to the City Staff for study and their comments to be
brought back to the Commission on Wednesday, March 2, 1977, for final action. The
motion was carried by the following Aye and No Vote: those voting Aye being
Commissioner Lehrkind, commissioner Taylor, Commissioner Vandeventer, and Commissioner
Sedivy; those voting No, none.
Open Bids for police Cars, as authorized by City Commission- February 2, 1977
This was the time and place set for opening bids for the purchase of three police
cars to be used by the Police Department. It was moved by Commissioner Taylor,
seconded by Commissioner Vandeventer, that the bids be opened and read, and the
motion was carried by the following Aye and No vote: those voting Aye being Commis-
sioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Commissioner
Sedivy; those voting No, none.
The following bids was then opened and read:
Rolfe & Wood, Inc. , - Bozeman I
1 - 1977 Dodge Monaco 4-Door Sedan $5,485.00
1 - 1977 Dodge Aspen 4-Door Sedan 5,287.00
1 - 1977 Dodge Monaco 4-Door Six Passenger
Station Wagon 5,237.00
Total Trade-in Allowance 4,300.00
The Commission concurred with the recommendation of the City Manager, and it was
moved by Commissioner Vandeventer, seconded by commissioner Lehrkind, that the bid
of Rolfe & Wood, Inc. , it being the only bid submitted, be referred to the Chief of

Police and City Staff for evaluation and a recommendation to be made to the Commis-
sion on Wednesday, March 2, 1977. The motion was carried by tpe following Aye and No
vote: those voting Aye being Commissioner Vandeventer, Commiss$<DDBJer Lehrkind, Com-
missioner Taylor and Commissioner Sedivy; those voting No, none.
I Request for Variance of Building Code - Remodeling Oxford Building Robert A. Taylor
A request for a variance to the Building Code for remodeling the Oxford Building
was called for discussion.
Commissioner Taylor, having an interest in the matter, excused himself and left
the meeting.
J~seph Sabol, representing Mr. Taylor, presented his views regarding the substi~
tution of a sprinkler system on t~e second floor in lieu of one hour fire resistive
corridors.
Several persons were present to discuss the request for the variance.
The Building Official stated his reasons for requiring a one~hour fire resistive
corridor.
City Attorney Berg questioned whether the City should be acting on this propesal
or whether this should be a state matter.
Attorney Sabol stated he had a letter coming from Jim Kimbel regarding the issue
of jurisdiction.
Following discussion, it was moved by Commissioner Lehrkind, seconded by Commis-
I sioner nahdeverl~er, that the City Commission approve Mr. & Mrs. Taylor's request for
a variance contingent upon receiving Mr. Kimbel's letter regarding the issue of juris-
diction. The motion was carried by the following vote: those voting Aye being
Commissioner Lehrkind and Commissioner Vandeventer; those voting No being Commissioner
Sedivy.
NOTE: Because of the absence of Mayor Vollmer and Commissioner Taylor having
excused himself for conflict of interest, only three commissioners were present for
this vote. The City Manager then requested that the City Attorney research and report
on the validity of a two~to-one vote out of a quorum of three as being legally suffi-
cient to carry a motion.

It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that
the Official Surety Bond and Oath of Office in the amount of $20,000.00 written by
Hartford Accident and Indemnity Company, as required by Ordinance No. 524, Chapter
2.08.100 of the Municipal Code, for City Manager Samuel C. Gesko, Jr. , for an indefi-
nite period of time from January 1, 1977, be accepted. The motion was carried by the
I following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commis~
sioner Lehrkind, and Commissioner Sedivy; those voting No, none.
Request to Conduct VFW Buddy Poppy Sale - May 21, 1977
A letter received from the VFW Auxiliary No. 903, requesting permission for the
members of Major Drennan Auxiliary to sell "Buddy Poppies" on May 21, 1977, was
presented.

It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that
permission to conduct the fund drive be granted. The motion was carried by the follo~
ing Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vand~
venter, and Commissioner Sedivy; those voting No, none.
Adjournment
There being no further business to come before the Commission 'at this time, it I
was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the
meeting be adjourned, and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, and Commis-
sioner Sedivy; those voting No, none. ~
