The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, February 16, 1977, at 1:15 o"clock p.m. Present were Mayor
Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner
Vandeventer, City Manager Gesko, Assistant City Manager Wolf and the Clerk.
Commissioner Sedivy opened the meeting with a prayer whereupon the minutes of I
the regular meeting held on February 9, 1977, were approved as read.
Public Hearing: A.- Everett Egbert - Conditional Use Permit - Sign
B - Natalie Jenkins - Conditional Use Permit - Sign
Having continued action for a period of one week for additional study and an
on-the-site inspection of the signs, the request of Everett Egbert for a conditional
use permit for the construction of a rental business on lot 7 of the Bozeman Indus-
trial Park Subdivision located on Griffin Drive and zoned M-I-T and the issuance of
a conditional use permit for the construction of a warehouse and small retail store
on Lot 1 of the Bozeman Industrial Park Subdivision located on Griffin Drive and zoned
M-l-T was again presented for discussion and a final decision.
Following a thorough discussion, the Mayor declared the hearing closed and the
City Manager concurred with the recommendation of Commissioner Lehrkind that the
signs be allowed to stay as installed but that they be censured for violating condi-
tions originally approved by both the Zoning Commission and the City Commission and
that they understand that no other signs will be permitted on the premises and that
in the future anyone else who violates the conditions as originally approved will
have to remove their signs and comply with the original conditions. I
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the
Commission approve the conditions as set forth above and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commis-
sioner Vandeventer, and Mayor Vollmer; those voting No being Commissioner Sedivy and
Commissioner Taylor.
It was then moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that
the Zoning Commission be instructed to consider removing the T (Transitional) designa-
tion from the Bozeman Industrial Park. The motion was carried by the fOllowing Aye
and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy,
Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No,i".r.-.
none.
Commission Resolution No. 186l - Declaring Intent to Vacate a Portion of Davis Street
from Broadway east to Mill Creek, Public Hearing
March 23, 1977
COMMISSION RESOLUTION NO. 186l
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA I
DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE
THE REMAINING PSRTION OF STREET BETWEEN BLOCKS 41 & 46, NORTHERN
PACIFIC ADDITION TO THE CITY OF BOZEMAN, MONTANA.
as prepared by the City Attorney was directed by the City Commission to vacate the
remaining portion of Davis Street between Blocks 41 and 46, Northern Pacific Addition
to the City of Bozeman was presented. The portion to be vacated lies between Broadway
Avenue and that portion of Mulberry Street vacated by Ordinance No. 148 on February l~
1997, and consisting of approximately sixty feet by one hundred feet.

It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that
Commission Resolution No. l861 be passed and adopted and March 23, 1977, be the date
set for public hearing and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vande-
I venter, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none.
Certificate of City Clerk - Registered Electors Senior Citizens Social Center
The Clerk of the City Commission, having carefully examined said petitions
.and the County Records showing the qualifications of the petitioners, certified that:
l. The total number of persons who are registered electors is 9,374.
2. That 2,158 persons whose names are subscribed to said petition are
possessed of all of the qualifications required of signers to said
petition.
3. That the qualified signers of said petition constitute more than 20%
of the registered electors of the City of Bozeman.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that
the Certification constituting more than the 20% of the registered electors of the
City of Bozeman be approved as presented. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vande-
venter, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting
No, none.
Commission Resolution No. 1862 - Authorizing the placement of a proposal for a
Senior Center on the April Ballot
I A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY OF BOZEMAN AT AN
ELECTION ON APRIL 5, 1977, THE QUESTION OF ISSUING GENERAL OBLIGATION
BONDS IN AN AMOUNT OF NOT TO EXCEED $400,000.00 FOR THE PURPOSE OF
BUILDING AND EQU~PPING A NEW SENIOR CITIZEN CENTER FOR BOZEMAN INCLUD-
ING, BUT NOT LIMITED TO, MEETING, CRAFTS AND GAME ROOMS; DANCE AREAS;
HEALTH FACILITIES AND FOOD SERVICE AND PROVIDING THAT THE NUMBER OF
YEARS THROUGH WHIC~ THE BONDS ARE TO BE PAID SHALL BE TEN (lO)YEARS.
as prepared by the City Attorney as directed by the City Commission was presented.
Following a discussion, it was moved by Commissioner Vandeventer, seconded by
Commissioner Lehrkind, that the City Commission authorize the placement of an
Official Ballot on the Special General Election to be held on Tuesday, April 5, 1977,
for the purpqse of voting on the following proposition:
That the City of Bozeman, Montana, issue its general obligation bonds
in an amount riot to exceed $400,000 to be payable during a period of .
ten years from the date of the issuance, the proceeds of such bonds to
be used to build and equip~a new senior citizen center for purpose, but
not being limited to meeting, crafts, and game rooms, dance areas, health
facilities and food service.
The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner
Taylor, and Mayor Vollmer; those voting No, none.
I Owenhouse Hardware - Variance, Bicycle Sign for Sign Facing South Black Avenue
A letter received from Rainbow Signs, Inc. , on behalf of Owenhouse Hardware,
requesting a sign code variance to lower a Schwinn Bicycle sign presently mounted at
the top of the masonry tower and projecting five feet over the sidewalk facing South
Black Avenue was presented. If permitted to be lowered to the proposed ll'6" above
the sidewalk, the sign should project only 2'6" from the side of the building, to
comply with the code.

Since the lowering of the sign would violate the projection requirements of the
uniform sign code, the Building Official recommended the variance be denied.
Following discussion, the Commission concurred with the recommendation of the
Building Official, also concurred in by the City Manager, and it was moved by
Commissioner Lehrkind, seconded by Commissioner Sedivy, that the sign code variance
to lower a Schwinn Bicycle sign facing South Black Avenue be denled. The motion was I
carried by the following Aye and No vote: those voting Aye being Commissioner
Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and
Mayor Vollmer; those voting No, none.
Application for City Beer License by John Davant for Et Cetera at 234 East Babcock
The City Manager presented an application from John Davant of the Et Cetera at
234 East Babcock Street, along with the required fee, for an off-the-premise beer
license for the year of 1977.
Upon recommendation of the City Manager, it was moved by Commissioner Sedivy,
seconded by Commissioner Taylor, that the Commission approve the above application
as presented. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commis-
sioner Lehrkind, and Mayor Vollmer; those voting No, none.
Reports
The following reports were presented:
January Director of Public Service Annual Police Department I
The City Manager commented on the reports and recommended acceptance and
filing of the reports.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer,
that the reports be accepted and ordered filed. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner
Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those
voting No, none.
Waste Water Treatment Plant Hearing - l6 March 1977
The City Manager presented a letter from the Montana Department of Health and
Environmental Science containing the Department's recommendations for completion of
the City's waste water treatment plant.
It was moved by Commissioner Vandeventer, seconded by Commissioner Sedivy, that
the date of March 16, 1977, be set as the tentative date for a public hearing on the
proposal. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vandeventer, Commissioner Sedivy, Commissioner Lehrkind,
Commissioner Taylor, and Mayor Vollmer; those voting No, none. I
Adjournment
There being no further business to come before the Commission at this time, it
was moved by Cowaissioner Sedivy, seconded by Commissioner Taylor, that the meeting
be adjourned and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer,
Commissioner Lehrkind, and Mayor Vollmer; those voting No, none.
