January 26. 1977. at 1:15 o'clock p.m. Present were Mayor Vollmer. Commissioner Lehrkind. Commissioner Sedivy. Commissioner Taylor. Commissioner Vandeventer. City Manager Gesko. Assistant City Manager Wolf. City Attorney Berg and Acting Clerk. I Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday. January 19. 1977. were approved as read. Absence of the Clerk of the Commission In the absence of the Clerk of the Commission. it was moved by Commissioner Lehrkind. seconded by Commissioner Sedivy. that Mrs. Diane Krupinsky be appointed as Acting Clerk of the Commission. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Sedivy. Commissioner Taylor. Commissioner Vandeventer. and Mayor Vollmer; those voting No. none. Continued Public Hearing - Rezoning Petition A-S to R-4 as requested by American Legion Gallatin Post #14 The request of the American Legion Gallatin Post No. 14 to consider a zone change from A-S to R-4 on Durston Road next to the Gallatin County Rest Home to permit construction of sixty units of rent assisted elderly housing was again presented for discussion. Letters were presented before the Commission from two nearby property owners. Mr. & Mrs. Rolf Johnson and Dr. E. G. Allen. objecting to the American Legion Housing Development because of it being a multiple unit structure in a single dwelling zone and the adverse affects on sewer. water. and traffic which may result in more SID's. Mrs. Charles Ash and Dr. E. G. Allen. along with several other property owners. were present to make their objections to the proposed zone change. Mr. Howard Erwin. American Legion representative. answered their questions regarding who would get housing and if they would pay their share of SID's. After considerable discussion. the City Manager recommended that the zoning be changed on the basis of the planning staff's report. It was moved by Commissioner Taylor. seconded by Commissioner I Vandeventer. that the Commission approve the zone change request. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Vandeventer. and Mayor Vollmer; those voting No being Commissioner Lehrkind and Commissioner Sedivy. It was moved by Commissioner Taylor. seconded by Commissioner Vandeventer. that the Planning staff immediately look at the northwest section and update the Master Plan and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Vande- venter. Commissioner Lehrkind. Commissioner Sedivy. and Mayor Vollmer; those voting No. none. Mr. Bruce Beers - National Endowment for the Arts Mr. Bruce Beers. consultant for the National Endowment for the Arts. appeared before the Commission and outlined the meetings that would take place before the community to get the people's opinion regarding a center for performing arts in Bozeman. Public Hearing - re request by Martel Construction. Inc.. for vacation of alley (Tracy's 2nd Addn.. Blk C. Lots 4 thru 10 and 11 thru 17 on the north) This was the time and place set for a public hearing to consider the request of Martel Construction for vacation of an alley at Tracy's 2nd Addn.. Blk C. Lots 4 thru 10 and 11 thru 17 on the north so that both Martel buildings can use just one meter for power service as required by the Public Service Commission. It was moved by Commissioner Vandeventer. seconded by Commissioner Lehrkind. that this matter be postponed until next week in order to get more additional background. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Lehrkind, Commissioner Sedivy. and Commissioner Taylor; those voting No being Mayor Vollmer. I Consideration of ordinance vacating alley as requested in above public hearing Because the above hearing has been postponed. it was moved by Commissioner Lehrkind. seconded by Commissioner Sedivy. that consideration of an ordinance for vacating the alley between the Martel buildings be deferred. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Sedivy. Commissioner Taylor. Commissioner Vandeventer. and Mayor Vollmer; those voting No. none. Request for vacation of a portion of Davis Street from Broadway east to Mill Creek A letter received from John and Laura Apperson requesting vacation of a portion of Davis Street from Broadway east to Mill Creek was presented before the Commission. :1'42 Upon the City Manager's recommendation, it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that this matter be deferred and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vande- venter, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Request for City Commission interpretation of a zoning ".E.~3~_~~_~!<2..I!~,for property located at 601 West Main St. A letter received from Byron L. Lundquist requesting permission to operate a retail sales store for communication equipment in a B-2 zone was presented before the Commission. I Upon the City Manager's recommendation, it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that this request be deferred for one week in order to obtain more specific information, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Application for Gambling License - VFW Hall at 240 East Main (Gary Allen Pahl) The City Manager presented an application from the VFW Hall, along with the required fee, for a gambling license. Upon recommendation of the City Manager, it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission approve the application for the gambling license for the VFW Hall, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. Application for Raffle - MSU Office Education Association - Feb. 24, 1977 The City Manager presented an application from MSU Office Education Association, along with the required fee, for a raffle to be held on February 24, 1977 . Upon recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission approve the application for the raffle to be held on February 24, 1977 , and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. I Discussion of recommendations by Community Recreation Board - January 19 meeting - The City Manager presented the following recommendations of the Community Recreation Board before the Commission: l. That three members' terms have expired as of January 19 and the same three members have agreed to serve again. Three other persons are also interested. 2. That a portion of the recreation softball complex be dedicated as a midget football field entitled the Sonny Holland Field. 3. That the City accept cash donation in lieu of land dedication and equal to fair market value for the amount of land that would have been dedicated and that this money be set aside to purchase park property in the general area of South 19th (Gene Graf, Jr. minor subdivision). Upon the City Manager's recommendation, it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission endorse the Board's recommendations, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. Mr. Walt Russell had filled an unexpired term which ran out at the end of December 1976. Mayor Vollmer announced Mr. Russell's reappointment to a full three-year term. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission endorse the Mayor's reappointment of Mr. Walt Russell, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Proclamation - Designating week of January 31 thru February 6, 1977 as MSU Bobcat Week I Mayor Vollmer proclaimed the week of January 31 thru February 6, 1977 , as "MSU Bobcat Week" for a successful year and the honor and recognition brought to themselves, Montana State University, the City of Bozeman and to the State of Montana in being the national champions of NCAA Division II football. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission concur in the Mayor's proclamation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vande- venter, and Mayor Vollmer; those voting No, none. ------ ---~ 14'3 Presentation by Joel Shouse, Executive Director of Blue Ribbons of the Big Sky Country - Areawide Planning Organization At this time, a presentation by Mr. Joel Shouse was scheduled for approximately an hour's duration. Mr. Shouse is the Executive Director of Blue Ribbons of the Big Sky Country - Areawide Planning Organiza- tion, a 208 federally funded program. Inasmuch as the official business of the Commission was concluded, as well as the likelihood of I various commissions having to leave during the presentation, the meeting was officially adjourned prior to the presentation.
