HomeMy WebLinkAbout1976-12-22 I I I 123 Bozeman, Montana 22 December 1976 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 22 December 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, City Manager Gesko, Assistant City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedin~ were had. Minutes of the regular meeting held on Wednesday, 15 December 1976, were approved as read. Barker Realty - Payment in Lieu of Park Dedication for Four-Lot Plat on So. 15th Ave. Between Koch and Curtiss St. The Final plat of Barker Realty Company was presented along with the recommenda.;.. tion of the City Manager that the plat be approved with the completion of the park dedication by Mr. Barker. Upon recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedi.vy, that the Commission approve the final plat of Barker Realty and that the Planning DirectQCDr be directed to sign the plat, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Request for Approval oflnter~Local Co-operative Agreement to Cover Creating An Operation of Pedestrian-Traffic Safety Advisory Committee Having continued action on the proposed Inter-Local Co-Operative. Agreement creating an Advisory Committee for Pedestrian Traffic Safety between the City of Bozeman, County of Gallatin~ and School District No. 7 for additional study, the Agreement was presented for discussion and a final decision. Following a continued discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the City of Bozeman enter into the Inter-Local Co- Operative Agreement for the purpose of developing expertise and advising said governrnental bodies in pedes trial-traffic safety problem and to promote public safety and to reduce traffic deaths, injuries, and property losses resulting from traffic accidents, and that the Mayor and Clerk of the Commission be authorized and directed to sign for the City, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vande- venter, commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Request for Vacation of the Right-of-Way of Orange Street Between Plum and Broadway The letter received from Sheldon Sollars requesting the City to vacate the dedicated Right-of-Way of Orange Street between Plum and Broadway Avenue having been continued for a period of one week for further study was presented for final action. The City Engineer and Street Superintendent had no objection to vacating Orange Street between Plum and Broadway Street. The City Manager recommended that the City vacate the Right of Way of Orange Street between Plum and Broadway Avenue when the property owners determine whether or not they will use the property at which time they will apply for a building permit. At that time they must show proof to the ownership 124 of the four lots to the South, have an Agreement with the Railroad that they will sell them the lots to the North and apply for a building permit for the actual construction of the warehouse. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission concur in the City Manager's recommendation as stated above. The motion was carried by the following Aye and No vote: those voting Aye being Commis- sioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, I and Mayor Vollmer; those voting No, none. Commission Resolution No. 1852 - Intent to Create SID No. 574-Henderson's Water Main COMMISSION RESOLUTION NO. 1852 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS "SID NO. 574 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF WATERMAINS AND APPUR- TENANCES TO SERVE THE ADJOINING PROPERTIES, MORE SPECIFICALLY AS FOLLOWS: A SIX (6) INCH WATERMAIN AND APPURTENANCES IN HAYES STREET AND IN AN EASEMENT NORTHWESTERLY THEREFROM ACROSS TRACT 12, BOZEMAN CREEK ANNEXA- TION TO GARFIELD STREET. THE CONSTRUCTION AND INSTALLATION TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIALS, CAST IRON WATER- MAIN, SOME CAST IRON SEWER MAIN FOR CROSS-OVER AREAS, VALVES, FITTING, HYDRANTS, SERVICE LINES, AND OTHER NECESSARY APPURTENANCES TO PROVIDE WATER TO THE LOTS IN THE DISTRICT. prepared:-::J,y,\:he City Attorney as directed by the City Commission and to be known as Special Improvement District No. 574 for the purpose of construction and installation of watermains and appurtenances to serve in Henderson's Addition, was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that Commission Resolution No. 1852 be passed and adopted and 12 January 1977 be I the date set for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner ~andeventer, Commissioner Lehrkind, Commissioner, Sedivy, Commissioner Taylor, and Mayor Vollme~; those voting No, none. Commission Resolution No. 1853 - Authorization to Execute Grant Re-Application for Site Improvements for Senior Center Commission Resolution No. 1853 authorizing the filing of an application for a development block grant with the U.S. Department of Housing and Urban Development for preparation of a site for a Senior Center was presented entitled: COMMISSION RESOLUTION NO. 1853 A RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR A COMMUNITY DEVELOPMENT BLOCK GRANT WITH THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR PREPARATION OF A SITE FOR A SENIOR CENTER AND AUTHORIZING A DESIGNATED OFFICIAL WHO HAS THE PRIMARY RESPONSIBILITY OF THE GRANT. Following an extensive discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commissioners pass and adopt Commission Resolution No. 1853 and authorize James W. Vollmer and Samuel C. Gesko, Jr., to execute and file an application with the Department of Housing and Urban Development for a Community Development Block Grant for the purpose of site preparation for a I senior center. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commission~ Vandeventer, and Mayor Vol~er; those voting NO, none. Commission Resolution No. 1854 - Vacating Riqht-of-Wav of an Alley within the Martel Center Between Grarid and Th1rd Avenue Commission Resolution No. 1854 declaring it to be the intention of said Commissim to vacate an alley twenty feet wide located in Tracy's Second Addition to the City of Bozeman was presented, entitled: I I I 125 COMMISSION RESOLUTION NO. 1854 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE THE ALLEY IN TRACY'S SECOND ADDITION TO THE CITY OF BOZEMAN, MONTANA. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that Commission Resolution No. 1853 vacating Right-of-Way of an Alley within the Martel Center between Grand and Third Avenue be passed and adopted and 26 January 1977, be the date set for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No being Commissioner Taylor. Acceptance of Waiver of Protest from Mountain Country Coors - Jim Koch An Annexation and Utility Connection Agreement by and between the City of Bozeman and Mountain Country Coors, Inc., for permission to connect a tract of land in the Northwest one .uarter of Section six, T/2S, R6E, MPM, Gallatin County, Montana, at no cost to the City of Bozeman, was presented. Following discussion, the Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Taylor;" seconded by Commissioner Vandeventer, that the Utility Agreement, having been executed by James W. Koch of Mountain Country Coors, Inc., be approved and the Mayor and Clerk of the Commission be authorized and directed to sign for the City of Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandevente~1 Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Execution of Contract Documents for SID No. 571 - Water Main Improvement Veterinary Research Lab The Contract Documents for the construction of Special Improvement District No. 571, Watermain Improvements at MSU Veterinary Research Laboratory, was presented. The City Manager recommended that the Contract Documents be approved as presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Contract Documents be approved and the Mayor and Clerk of the Commission be authorized and directed to sign the contracts for the City of Bozeman, and that Johnston Excavating, Inc., be authorized and directed to proceed with construction of SID No. 571, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and ,Mayor Vollmer; those voting No, none. Acceptance and Execution of Contract Documents for Phase III EPA Sewer Rehabilitation The Contract Documents for Phase III Environmental Protection Agency for the Sewer Rehabilitation was presented. The City Manager recommended that the City accept and execute the Contract Documents for Phase III EPA Sewer Rehabilitation as presented It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the City enter into the Contract for Phase III Environmental Protection Agency for the Sewer Rehabilitation and the Mayor and Clerk of the Commission be authorized and directed to sign for the City, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commis- sioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. 12f) Commission Resolution No. 1855 - Designating Individuals Authorized to Sign EPA Documents - WaterPollut1on Control proJects Commission Resolution No. 1855 authorizing Mayor James W. Vollmer of the City of Bozeman and Samuel C. Gesko, Jr., City Manager of the City of Bozeman, to execute and file an application on behalf of the City of Bozeman with the United States Government for a grant to aid in construction of sewage treatment plan improvements and to sign all necessary documents was presented, entitled: COMMISSION RESOLUTION NO. 1855 RESOLUTION AUTHORIZING FILING OF AN APPLICATION WITH THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY, UNITED STATES OF AMERICA, FOR A GRANT UNDER THE WATER POLLUTION CONTROL ACT, (33 U.S.C. 466, et seq.). It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that Commission Resolution No. 1855 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commis- sioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none.
