The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, 15 December 1976, at 1:15 o'clock p.m. Present were Mayor
Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner
Vandeventer, City Manager Gesko, Assistant City Manager Wolf, City Attorney Berg and
the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following pro-
ceedings were had.
Members of the Commission and all persons present were honored by a visit from
Santa Claus.
Minutes of the regular meeting held on Wednesday, 8 December 1976, were approved
as read.
Open Bids for One (1) Pumper Fire Truck - Fire Department
This was the time and place set for opening bids for a pumper fire truck for the
Fire Department. The affidavit for the "Call for Bids" was presented.
The "Call for Bids" called for the pumper fire truck and the equipment to be bid
separate, however, four out of the seven bidders bid the equipment and truck as one
package.
After much discussion, the City Attorney advised bidders present that the City
Commission would accept an oral bid on the equipment portion of the bid. Kenneth
Hanson of Livingston, representing W. S. Darley & Company of Melrose Park, Illinois,
was not in a position to give an oral bid on the equipment as he had not seen the bid.
The City Attorney then advised the representative of W. S. Darley & Company that the
City wou~dvopen the bid of W. S. Darley & Company with the understanding that the City
reserve the right to reject his bid even though it might be the low tlid and asked if
this was acceptable to all bidders present and they responded that it was.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that
the bids be opened and read with the above stipulations. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Com-
missioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer;
those voting No, none.
The following bids were then opened and read:

It was moved by Commissioner Taylor, seconded by commissioner Vandeventer,
that the bids be referred to the Fire Chief and Fire Department Staff for evaluation
and a recommendation on 29 December 1976, and that the bid of Western Fire Equipment
be rejected since their bid bond in the amount of ten percent had not been included.
The motion was carried by the following Aye and No vote: those voting Aye being

Hearing, Commission Resolution No. 1840 - Intent to Annex Wortman Property
During the meeting of the City Commission held on 24 November 1976, the Commis-
sion regularly passed and adopted Commission Resolution No. 1840 declaring its inten-
tion to extend the boundaries of the City of Bozeman so as to include the No. 140' of
Tcract !~~ ~~atty's Alder Court, a rearrangement of Tract 9 and 10 and the No. 458.8'
of Tract 11 of Beatty's Subdivision and known as the Wortman Annexation.
This being the date for public hearing as set forth in said Commission Resolution
No. 1840, affidavit of publication of Notice and the Clerk's mailing certificate
stating all property owners had been notified as required by law was presented. There
were no protests filed and no one appeared to protest verbally.
The Mayor declared the hearing closed, and it was moved by Commissioner Vande-
venter, seconded by Commissioner Lehrkind, that the City Attorney be instructed to c\.LaN
draw up a resolution to accomplish the requested extension of the City Limits. The
motion was carried by the following Aye and No vote: those voting Aye being Commis-
sioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Comm6:esioner Taylor,
and Mayor Vollmer; those voting No, none.
Re~~est for Vacation of Right-of-Way of Orange St. between Plum & Broadway Avenue
A letter received from Sheldon Sollars requesting the City to vacate the dedica~~
cated Right-of-Way of Orange Street between Plum and Broadway Avenue was presented.
Following discussion, it was moved by Commissioner Lehtkind, seconded by Com-
missioner Sedivy, that the Commission acknowledge receipt of the request and con-
tinue action for a period of one week for further study. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Com-
missioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer;
those voting No, none.
Contract - Thomas, Dean & Hoskins, Inc., - Urban Road Program
A Contract Agreement by and between the City of Bozeman, Montana, and Thomas,
Dean and Hoskins, Inc., for the purpose of providing professional engineering ser-
vices for street improvements which will include asphaltic concrete pavement, con-
crete curb and gutter, sidewalk or combination sidewalk-bikepath, storm drain improve-
ments, irrigation canal piping, bridge construction over Sourdough Creek, signing and
traffic delineation, utility relocation and traffic control devices, and other improv~
ments incidental to and necessary for a complete job located on 19th Avenue from
Babcock Street to Durston Road and Kagy Boulevard from Third Avenue to Highland
Boulevard was presented.
Mr. T. H. Thomas of Thomas, Dean & Hoskins, Inc., was also present to discuss
the proposed project and answer any questions that might arise.
Following a thorough discussion, it was moved by Commissioner Lehrkind, seconded
by Commissioner Sedivy, that the City enter into the Urban Road Development Contract
Agreement with Thomas, Dean & Hoskins, Inc. and the Mayor and Clerk of the Commission
be authorized and directed to sign the Agreement for the City. The motion was car-
ried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind,
Commissioner Sedivy, Commissioner Vandeventer, and Mayor Vollmer; those voting No
being Commissioner Taylor.
Request for an Extension on Preliminary Plat Approval for Industrial Properties
Subd1vision and Bomont Center subdivision
A request from the Industrial Properties Subdivision and the Bomont Center Sub-
division for extension of preliminary plat approval was presented.

The developers of Industrial Properties Subdivision, Gene Cook, and Bozeman
Center Subdivision, Delbrook Lichtenberg, gained approval from the City-County Plan-
ning Board after reviewing the staff report and voted unanimously to recommend appro-
~~l for these subdivisions.
Following a discussion and upon recommendation by the City Manager, it was
moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commis-
sion approve the one year extension of preliminary plat approval for these subdivi~
sions. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy, and Mayor
Vollmer; those voting No, none; those abstaining being Commissioner Lehrkind.
Request for Approval of Claim by Long Construction Company
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind,
that the City Commission concur in the recommendation of the City Manager and instruct
the Director of Finance to issue warrants to Long Construction in the amount of
$26,360.14 and the Department of Revenue in the amount of $266.27 to cover the First
Pay Estimate for SID No. 561, 562, 566, and 567, Street Paving and Storm Drainage
Improvements for the year 1976. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind,
Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none.
Request for Approval of Inter-Local Co-operative Aqreement to cover Creation and
Operatlon of PedestrIan - TrafflC Safety Aavlsory Conunttee
A proposed Inter-Local Co-operative Agreement creating an Advisory Committee
for Pedestr!dn t~affic safety between the City of Bozeman, County of Gallatin and
School District No.7. was presented.
After an extensive discussion, it was moved by Commissioner Taylor, seconded
by Commissioner Vandeventer, that action on the Inter-Local CQ-operative Agreement
be tabled for a period of one week for further study and a decision. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner
Taylor, Commissioner Vandeventer, and Commissioner Lehrkind; those voting No being
Commissioner Sedivy and Mayor Vollmer.
The recommendation of the ad-hoc Committee that a letter be addressed to the
State Highway Department by the City Manager regarding the results of their study
on 25 October 1976, suggesting several solutions to various pedestrian traffic
problems was accepted.
The City of Bozeman is upgrading the signal at North Rouse Avenue and East
Mendenhall Street and the signalization at North Seventh Avenue at Durston Road is
being taken care of.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind,
that the City Manager address a letter to the State of Montana Department of Highways
with a request instructing them to install a traffic light on Main Street at Third
Avenue and that a bouncing ball school flasher be placed on North Rouse on the south
side of Lamme Street. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner
Sedivy, Commissioner Taylor, and Mayor Vollmer; those votin~ No, none.
Proclamation designating 16-22 January 1977 as "United States Jaycee Week"
In accordance with the request from the Bozeman Jaycees, Mayor Vollmer pro-
claimed 16-22 January as United States Jaycee Week, urging all citizens of the commu-
nity to give full regard to the past services of the Jaycees.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that
the Commission endorse the ~1ayor's proclamation in accordance with the Jaycees, and

motion was carried by the following Aye and No vote: those voting Aye being Com-
missioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vande-
venter, and Mayor Vollmer; those voting No, none.
Letter to HSU Bobcats - Extending Compliments of the City of Bozeman
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that a
letter be addressed to the MSU "Bobcats" extending the compliments of the Commission
for a successful year and the honor brought to the City of Bozeman and State of
Montana in being named the National Champions. The motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor,
Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No,
none.
Adjournment
There being no further business to come before the Commission at this time, it
