HomeMy WebLinkAbout1976-11-24 10 Bozeman, Montana _24 November 1976 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 24 November 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Vandeventer, Com- missioner Taylor, Acting City Manager Wolf, City Attorney Berg, and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 17 November 1976, were approved as read. Open Bids - SID No. 571 - Watermain to Veterinary Research Lab This was the time and place set for the opening of bids for construction and installation of watermains at the Center for Veterinary Research SID No. 571. The affidavit of publication for the "Call for Bids" was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the bids be opened and read. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. The following bids were then opened and read: Intermountain Construction Johnston Excavating C. W. Schmid, Inc. $33,302.75 27,708.50 32,628.00 Upon the Acting City Manager's recommendation, it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the bids be referred to the Consulting Engineers, Thomas, Dean & Hoskins, and the City Engineer for tabulation and recommendation to be made on Wednesday, 1 December. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vpllmer; those voting No, none. Open Bids - Three Police Cars for Police Department This was the time and place set for opening bids for the purchase of three police cars to be used by the Police Department. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Bozeman Ford, Bozeman Rolfe & Wood, Inc., Bozeman Option A - Dodge Aspen Option B - Dodge Monaco $12,928.00 11,791. 00 11,941.00 The Commission concurred with the recommendation of the Acting City Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the bids be referred to the Chief of Police and City staff for tabulation and recommendation to be made to the Commission on Wednesday, 1 December 1976. The motion was carried by the following Aye and No vote: those voting Aye being Commis- sioner Vandei~ter, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. I I I I I I Hearing cornrnission Resolution No. 1833 .... Intent to Create SILD No. 572 - Lighting North South Alley, Blk 4 of the Brunton Palffy Rearrangement This was the time and place set in Commission Resolution No. 1833 to hear protests to the creation of Special Improvement Lighting District No. 572 for the construction of lighting at the North South Alley, Block 4 of the Brunton Pallfy Rearrangement. Affidavit of publication of Notice and the Clerk's mailing certificate stating all property owners had been notified as required by law was presented. There were no protests on file and no one appeared to protest verbally. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that City Attorney Berg be instructed to draw up the necessary resolution to create the district, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vande- venter, and Mayor Vollmer; those voting No, none. Annexation - Portion of Tract 12 Beatty's Alder Court, Tract 9 & 10 and portion Tract 11 of Beatty's Subdivision - Commission Resolution No. 1840 Commission Resolution No. 1840 declaring the City Commission's intention to extend the boundaries of the City of Bozeman to include the North 140' of Tract 12, Beatty's Alder Court, a rearrangement of Tract 9 and 10 and the North 458.8' of Tract 11 of Beatty's Subdivision and known as the Wortman Annexation, was presented entitled: COMMISSION RESOLUTION NO. 1840 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACT WITHIN THE CORPORATE LIMITS THEREOF. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the resolution be passed and adopted as recommended, and that Wednesday, 15 December, be the date set for public hearing. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Big Bear Store - Request Extension of Going Out of Business Sale A letter received from Big Bear Store, requesting a thirty-day extension on their Going Out of Business License was presented. The Acting City Manager recom- mended the extension of the Going Out of Business License. Following an extensive discussion, it was moved by Commissioner Taylor, seconded by Commissioner Sedivy, that the extension of the Going Out of Business License be granted. Those voting Aye being Commissioner Taylor; those voting No being Commis- sioner Sedivy, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer. Therefore, the exte.emaron of the Going Out of Business License was denied. Lease Agreement - Chicago, Milwaukee, St. Paul and Pacific Railroad Co. A proposed new lease No. 80881 whereby the Chicago, Milwaukee, St. Paul and Pacific Railroad Company leased unto the City of Bozeman a tract of land containing approximately 3.3 acres of Railroad Company land for use by the park department was presented. 10-3 1.04 The proposed new Lease No. 80881 supersedes Lease No. 37278 and becomes effec- tive 1 January 1977. The annual rental for the above lease is $120.00, plus taxes, if any. Following a discussion and upon the Acting City Manager's recommendation, it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the City enter into the new Lease Agreement with the Chicago, Milwaukee, St. Paul and Pacific Railroad Company and the Mayor and Clerk of the Commission be authorized and directed to sign for the City. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. Dedication of a Portion of Babcock Street - Warranty Deed, Mary Margaret Dean A Warranty Deed whereby Mary Margaret Dean of Bozeman, Montana, granted unto the Ci ty of Bozeman a strip of land in the Northwest Quarter of t!h~s:outhwest Quarter of Section Twelve, T2S, R6E, M.P.M. was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the City accept the dedication of the above strip of land, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkinq Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Request for AmbulanOeFunding - Good Samaritan Ambulance A request from the Good Samaritan Ambulance for additional subsidy and participa- tion in the purchase of a new ambulance was brought before the City Commission. Following a thorough discussion, the City Commission agreed that they would share one-half of a monthly lease agreement between Gallatin County and an Ambulance Leasing Service for the lease of one ambulance contingent upon an agreement being reached by the City and the County on a revised method of funding an ambulance ser- vice during the next fiscal year. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission enter into the Lease Agreement and share one-half of a monthly lease Agreement between Gallatin County and an ambulance service until 1 July 1977. The motion was carried by the following Aye and No vote: those voting Aye being Commis- sioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and M~yor Vollmer; those voting No, none. Special Primary Election to be held 8 February 1977 It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission order a Special Primary Election to be held on Tuesday, 8 February 1977, for the purpose of electing three (3) City Commissioners in connection with Section 16-5115.13(2) Revised Codes of Montana, 1947. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. I I I I I I Request to Vacate a Portion of Twelfth Street A letter received from several property owners on South Twelfth Avenue requesting that a portion of Twelfth Avenue north of Curtiss Street be vacated was presented. Following a thorough discussion and in concurrence with the recommendation of the Acting City Manager, it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the request for the vacation be denied. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commis- sioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Confirmation - Police Officer Glen Merritt, effective 23 November 1976 The Police Chief reported that Police Officer Glen Merritt had satisfactorily completed the required one-year probationary period and recommended that Police Officer Merritt be confirmed as a regular officer of the Police Department effective 23 November 1976. The Acting City Manager concurred in the recommendation of the Police Chief, and it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the confirmation of Police Officer Glen Merritt be approved and he be congratulated upon completing the one-year probationary period. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commis- sioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and M~yor Vollmer; those voting No, none. Authorization - Call for Bids for Taping Machine for Water Department It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Water Department be granted authorization to call for bids for a Tapping Machine in the approximate amount of $6,500.00. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commis- sioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Gambling License - Disabled American Veterans Auxiliary - Raffle, 11 January 1977 The Acting City Manager presented an application for the Disabled American Veterans Auxiliary along with the required fee for a raffle licens~ for a raffle to be held on 11 January 1977. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission approve the application for -'the raffle license, and the motion was car- ried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Report: Director of Pu~iic Service The Acting City Manager commented on the report of the Director of Public Service and recommended the same be accepted and ordered filed. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the report of the Director of Public Service be accepted and ordered filed. Commission Resolution No. 1839 - Amend Resolution No. 1676 - Parking Commission Amended Commission Resolution No. 1839 specifying the powers of the Parking Commission of the City of Bozeman and amending Commission Resolution No. 1676 pre- pared by the City Attorney was presented, entitled: COMMISSION RESOLUTION NO. 1839 A RESOLUTION AMENDING COMMISSION RESOLUTION NO. 1676 SPECIFYING THE POWERS OF THE PARKING COMMISSION OF THE CITY OF BOZEMAN. The Commission concurred with the recommendation of the Acting City Manager, and it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that Commission Resolution No. 1839 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, rI Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer, those voting No, none.
