The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 10 November 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind,
Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Acting City Manager Wolf, City
Attorney Berg, and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 3 November 1976, were approved as read.
Hearing - Zone Code Amendment - South Willson Street Improvement Assoc. - R-3 to R-2
This was the time and place set for a public hearing to consider the request of the South
Willson Street Improvement Association for a zone change from R-3 to R-2 from Story Street to
Lincoln Street along each side of Willson Street.
Mr. Dick Andriola of the Association told the Commission that the Association would want to
maintain this area in a historic character.
The Zoning Commission, after consideration of the Planning Staff's report, unanimously
approved the zone change request.
Upon the Acting City Manager's recommendation, it was moved by Commissioner Lehrkind, seconded
by Commissioner Sedivy, that the Commission concur with the Zoning Commission's recommendation and
approve the zone change request, and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner
Vandeventer, and Mayor Vollmer; those voting No, none.
Senior Social Center - Request City submit HUD Grant Application
A request from the Senior Social Center for the City to submit an application to HUD for a
grant to make a Senior Social Center a reality was presented.
Upon recommendation of the Acting City Manager, it was moved by Commissioner Sedivy, seconded
by Commissioner Taylor, that the application be referred to the staff for review and a report to
the Commission next week. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner
Lehrkind, and Mayor Vollmer; those voting No, none.

Resolution No. 1834 - Sanitary Sewer - Figgins Addition - $36,866.65
Resolution No. 1835 - Sanitary Sewer - Bozeman Annexation- 18,400.88
a) This was the time and place set for public hearing on levying the final assessment for the
construction and installation of a sanitary sewer trunk line in Figgin's Addition, SID No. 555 in
the amount of $36,866.65. Affidavit of publication of Notice was presented. No one appeared to
protest verbally, and there being no protests on file, it was moved by Commissioner Taylor,
seconded by Commissioner Vandeventer, that Commission Resolution No. 1834 provisionally passed
and adopted on 3 November 1976 be finally passed. The motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner
Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none.
b) This was the time and place set for public hearing on levying the final assessment for the
construction and installation of a sanitary sewer line in Bozeman Creek Annexation, SID No. 557
in the amount of $18,400.88. Affidavit of publication of Notice was presented. No one appeared
to protest verbally, and there being no protests on file, it was moved by Commissioner Vandeventer,
seconded by Commissioner Lehrkind, that Commission Resolution No. 1835 provisionally passed and
adopted on 3 November 1976 be finally passed. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy,
Commissioner Taylor, and Mayor Vollmer; those voting No, none.
Preliminary Plat Approval - Sourdough Ridge III, Block 2
A preliminary plat approval for Sourdough Ridge III, Block 2 was presented before the
Commission by Ken Nordtvedt.
Upon the Acting City Manager's recommendation, it was moved by Commissioner Lehrkind, seconded
by Commissioner Sedivy, that the preliminary plat be approved, and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy,
Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none.
Conditional Use Permit - Concrete Specialties - Warehouse
This was the time and place set for a public hearing to consider the request of Concrete
Specialties for a conditional use permit to convert a building currently used as an auto repair
shop to a storage warehouse on a lot at 215 North Wallace.

The Zoning Commission, after consideration of the Planning staff's report, unanimously
approved the conditional use request.
Upon the Acting City Manager's recommendation, it was moved by Commissioner Sedivy, seconded
by Commissioner Taylor, that the Commission concur with the Zoning Commission's recommendation and
approve the conditional use permit application for Concrete Specialties. The motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor,
Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none.
Easement Request - Gardner Park for Mountain Bell
A Right of Way Easement by and between Mountain Bell and the City of Bozeman for the purpose
of constructing, operating, maintaining and removing such communication and other facilities thereto
upon and across a strip of land being the South 20 feet of the North 40 feet of Lot 1, Block 1,
Gardner Park Subdivision, located in the NE~, Section 30, T2S, R6E, City of Bozeman, Gallatin
County, Montana.
Upon concurrence of the Acting City Manager, it was moved by Commissioner Taylor, seconded
by Commissioner Vandeventer, that the Right of Way Easement be approved and the Mayor be authorized
and directed to sign for the City. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner
Sedivy, and Mayor Vollmer; those voting No, none.
Reappoint Harold Hogg to Police Commission
The Acting City Manager announced his reappointment of Harold Hogg to Police Commission to be
effective until 30 April 1979.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission
concur in the Acting City Manager's reappointment, and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner
Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none.
Red Cross Award
Mayor Vollmer presented the Red Cross Award to Lee Lewis and stated that he has made the Fire
Department and the City a proud place in which to live. It was moved by Commissioner Lehrkind,
seconded by Commissioner Sedivy, that the Commission endorse the Mayor's statement and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind,
Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those
voting No, none.
Gambling Licenses
a) MSU Indian Club - Raffle - 20 November 1976
b) Bozeman Legal Secretaries - Raffle - 4 December
a) The Acting City Manager presented an application from the MSU Indian Club, along with the
required fee, for one raffle license.
Upon recommendation of the Acting City Manager, it was moved by Commissioner Sedivy, seconded
by Commissioner Taylor, that the Commission approve the application for a raffle license for MSU
Indian Club, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and
Mayor Vollmer; those voting No, none.
b) The Acting City Manager presented an application from the Bozeman Legal Secretaries, along
with the required fee, for one raffle license.
Upon recommendation of the Acting City Manager, it was moved by Commissioner Taylor, seconded
by Commissioner Vandeventer, that the Commission approve the application for a raffle license for
Bozeman Legal Secretaries, and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy,
and Mayor Vollmer; those voting No, none.
EPA Approval of Award for Sewer TV Contract I
A letter from John A. Green of EPA was presented before the Commission approving of the award
for Sever TV Contract to Guildner Water and Sewer, Inc. The work should begin December 26 and be
finished in 30 to 40 days. This data must be in before we can get into the final design for the
waste water treatment plant. It was moved by Commissioner Vandeventer, seconded by Commissioner
Lehrkind, that EPA's plan be approved, and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy,
Commissioner Taylor, and Mayor Vollmer; those voting No, none.

Report: Library
The Acting City Manager commented on the Library report and recommended it be accepted and
ordered filed.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the report be
accepted and ordered filed. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer,
and Mayor Vollmer; those voting No, none.
Contract Documents for SID 561, 562, 566, and 571
The Contract Documents for the construction of paving and storm drainage in SID No's. 561,
562, 566, and 571, prepared by Thomas, Dean & Hoskins, Inc., were presented. The Acting City
}1anager recommended that the Contract Documents in the amount of $671,111.75 as submitted by Long
Construction be approved.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Contract
Documents be approved and the Mayor and Clerk of the Commission be authorized and directed to sign
the contracts for the City of Bozeman, and that Long Construction be authorized and directed to
proceed with the construction of SID's 561, 562, 566, and 571, and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor,
Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none.

The Acting City Manager checked the claims and found them to be true and lawful claims against
the City of Bozeman and recommended they be approved and the Director of Finance be instructed to
issue warrants in payment.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that all claims
be approved as presented, and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor,
and Mayor Vollmer; those voting No, none.
Adjournment
There being no further business to corne before the Commission at this time, it was moved by
Commissioner Lehrkind, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion
