SUBJECT: Resolution 4733 authorizing Change Order No. 1 to the 2016 Bridger
Drive Trunk Sewer Main Project.

RECOMMENDATION: Approve Resolution 4733 authorizing Change Order No. 1 to the 2016 Bridger Drive Trunk Sewer Main Project.
BACKGROUND: Attached is a copy of resolution 4733 and change order number 1 for the
above referenced project. During the bidding phase of the project, concerns were raised about
the condition of the bridge across Bozeman Creek on Griffin Drive. This was to be the primary
detour route for the project. Information on the condition of the bridge was requested from the County Road and Bridge Department who is responsible for all bridges in the county. They did not have an assessment at the time so had their consultant complete one. We did not receive the
results until after the award of the project. The assessment resulted in the bridge being posted
with a 3 ton weight limit which is not sufficient for large truck traffic. At that point, we were
going to add the additional traffic control necessary to detour the truck traffic to the Wallace/Tamarack intersection to get in and out of the area, but the Wallace reconstruction project closed that intersection the week prior to the sewer project beginning.
In order to route the truck traffic on Story Mill Drive through the sewer project, the contractor will need to widen the existing shoulder of the road, handle the excavated material in a different manner than planned, stop work as needed to allow trucks through, and construct a crossover in
the area south of Hillside Drive where the sewer main crosses from the east side of Story Mill to
the west side. All of this will add an additional two days to the installation of the sewer main
plus one day for two people and a piece of equipment for cleanup and restoration. A detailed breakdown of the time and costs is attached. There is no additional contract time being requested with this change. The final recommended change in cost and time for these items is
reasonable and commensurate with the work involved.

ALTERNATIVES: As suggested by the City Commission.

FISCAL EFFECTS: Overall this change order increases the contract amount by $24,570.14
from $420,912.00 to $445,482.14.

COMMISSION RESOLUTION NO. 4733
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT
WITH COP CONSTRUCTION, LLC., BILLINGS, MONTANA.
WHEREAS, the City Commission did, on the 12th day of September 2016, ratify award of the bid
for the City of Bozeman 2016 Bridger Drive Trunk Sewer Main project, to COP Construction, LLC., Billings,
Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a
municipal corporation, and COP Construction, LLC., as contained in Change Order No. 1, attached hereto, be
and the same are hereby approved; and the City Manager is hereby authorized and directed to execute the
contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest such
signature.

PASSED AND APPROVED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 3rd day of October, 2016.
