HomeMy WebLinkAbout1976-10-20 '8t; Bozeman, Montana 20 October 1976 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 20 October 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind Commissioner Sedivy, Commissioner Vandeventer, City Manager Fryslie, Assistant City Manager Wolf, and the Acting Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 20 October 1976, were approved as read. Authorize Absence of Commissioner Taylor Upon recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the absence of Commissioner Taylor, from the meetings of 20 October and 27 October 1976, be authorized in compliance with Section 11-3245, R.C.M., 1947. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Consideration of Bids - Trailer Mounted Air Compressor The Cemetery and Street Superintendents, having studied the only bid submitted by Allied Equipment Company, in the amount of $5,459.00 with trade on the air compressor meeting or exceeding all specifica- tions, respectfully submitted and recommended that Allied Equipment Company's bid be accepted as the best bid for the City of Bozeman. The Commission concurred with the recommendation of the Cemetery and Street Superintendents, and it was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that Allied Equipment Company be awarded the bid for the air compressor in the amount of $5,459.00 with trade, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Open Construction Bids - SID's 561, 562, 566, 570 This was the time and place set for the opening of bids for construction of street paving and storm drainage improvements on SID No's. 561, 562, 566 and 570. The affidavit of publication for the "Call for Bids" was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the bids be opened and read. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. The following bids were then opened and read: Long Construction, Billings $761,111.75 Peter Kiewitt, Billings 800,481.00 Upon the City Manager's recommendation, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the bids be referred to the City's engineering consultants for tabulation and recommendation to be made on Wednesday, 27 October. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Open Bids - Sanitary Sewer Rehabilitation This was the time and place set for the opening of bids for sewer rehabilitation. The affidavit of publication for the "Call for Bids" was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that the bids be opened and read. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. The following bids were then opened and read: C. W. Schmidt, Bozeman $27,991.00 Intermountain Construction, Bozeman 51,370.00 Upon the City Manager's recommendation, it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the bids be referred to the City's engineering consultants for tabulation and recommendation to be made on Wednesday, 27 October. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Requests from University Mall The City Manager informed the Commission about the alternatives they have regarding University Mall's request to either rescind the hookup of Main Mall to the City sewer system or that the City withdraw the SIDs of approximately $250,000.00 assessed against University Mall. He pointed out that the City Attorney advised the Commissioners about possible litigation should they breach their agreement with Harry and I 1 1 1 1 1 ~ Kathleen Daum. If they chose to withdraw the SID's, they would have to drop SID No's. 561 and 562 which were just opened for bid. By dropping SIDs 561 and 562, it would be necessary for University Mall Associates to compensate the City about $45,000 to $50,000 for administrative costs incurred by the City. Upon the City Manager's recommendation, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the University Mall matter be tabled for a week, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. As a further note, a letter from Mr. Guy Sperry, Manager of the Bozeman Chamber of Commerce, was presented stating that the Board of Directors of the Bozeman Chamber of Commerce resolved that no more than one new shopping mall be established in the Bozeman area at this time. A.A.R.P. - Sidewalk Snow Removal Rev. J; Homer McGee of the American Association of Retired Persons made a presentation before the Commission to remind the people of Bozeman that the residents are responsible for the removal of snow and ice from the sidewalks. The City Manager pointed out that there is an ordinance in effect that states that the morning after an accumulation of more than an inch of snow, the Business District must have the sidewalks cleared by 10 a.m. and the residential areas must have sidewalks cleared by 12 noon. UNICEF Drive - Friday, 29 October 1976 A request from the Church Women United for permission to conduct Trick or Treat for UNICEF beginning at about 4 p.m. on Friday, 29 October, was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that permission to conduct this UNICEF Drive be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Authority to Purchase Vehicle - Inspection Department The Inspection Department is in need of a vehicle to replace a 1966 model and the City Manager requested authorization to purchase from Don Norem Chevrolet a 1976 Chevy Nova (demonstrator) at an approximate cost of $3,960.00. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the City Manager be granted authorization to purchase the 1976 Chevy Nova at $3,960.00 from Don Norem Chevrolet, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Raffle Licenses: a) MSU Cheerleaders; b) HPER Club - MSU The City Manager presented an application from the MSU Cheerleaders and from the Health, Physical, Education and Recreation Club, with the required fee, for a raffle license. Upon recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission approve the applications for the raffle licenses. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Beer and Wine License - Cats Paw The City Manager presented an application from the Cats Paw along with the required fee of $200.00 for a Beer and Wine License. It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that the Cats Paw, having met all requirements, be issued a license as stated above. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Federal Aid to Urban Systems - Thomas, Dean and Hoskins Mr. T. A. Thomas of Thomas, Dean and Hoskins requested the Commission's approval to draw up a designing and engineering agreement between Thomas, Dean and Hoskins and the City of Bozeman in order to expedite the following paving projects: 1) North 19th from Main Street to Durston Road 2) Kagy Boulevard from South 3rd to Highland Boulevard 3) Oak Street from Rouse Avenue to 7th Avenue This agreement which must meet State and Federal standards would be presented to the State Highway Department for their approval in order to expedite the program as approved with Federal Aid to Urban Systems funding. .88 It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission give Thomas, Dean and Hoskins permission to draw up an agreement for approval by the State Highway Department to expedite the above paving projects. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Request for SID - Carroll V. and Vera E. Henderson A letter received from Carroll V. and Vera E. Henderson petitioning the City of Bozeman to create a special improvement district for a 6" watermain to run from Garfield south of Langohr's Greenhouse across our property to Hayes Street and west on Hayes Street to the existing waterline on Willson Avenue was presented. The letter also petitioned for the paving of Hayes Street from Willson Avenue to the easterly end of same. The City Manager asked that the Commission acknowledge receipt of the request for a Special Improve- ment District and instruct the City Attorney to draw up a resolution of intention to create the district as soon as the City staff furnishes the necessary information. Mayor's Announcement - New City Manager Mayor Vollmer announced that the City Commission had reached a decision as to whom they selected for the City Manager position being vacated by Harold Fryslie on 1 November. From the 102 applications they had received, those chose Mr. Samuel C. Gesko, Jr., of Bridgeton, Missouri. Mr. Gesko has accepted the position and will arrive early in December to assume the position.
