Resolution 4731 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Anna Rosenberry, Administrative Services Director SUBJECT: Commission Resolution No. 4731 – Amending the City’s Annual Budget for Street Impact Fee Appropriations for the Fiscal Year Ending June 30, 2017 (FY17). MEETING DATE: October 3, 2016 AGENDA ITEM: Action RECOMMENDATION: Approve Resolution No. 4731 – with any changes necessary to mirror approved Capital Improvement Plan amendments (previous agenda item.) BACKGROUND: The attached Resolution seeks to amend the budget for the proposed changes to the Street Impact Fee Capital Improvement Plan (CIP) for Fiscal Years 2017-2021. A budget amendment is necessary for the changes made to Plan Year 2017, which is our current budget year. The items and amounts are as follows: Additions: These projects and amounts are added to the FY17 budget. SIF 077 – Graf Street Extension (added dollars) $1,120,000 SIF 095 – N. 27th Street – construction $350,000 SIF 099 – N. 27th Street – design $52,500 SIF 107 – Fowler Right-of-Way $800,000 Reduction: This project and amount will be removed from the FY17 budget. SIF 103 – S. 11th Avenue – design ($396,000) Total Appropriations Changes: $1,926,500 Changes to the CIP for FY18-FY21 do not require a budget amendment. These changes will be incorporated into the updated CIP version we are preparing this fall. 142 ALTERNATIVES: Do not fund these projects. Or, make cuts to other projects in order to offset the costs of these projects in the current year. FISCAL EFFECTS: The current budgeted spending in the Street Impact Fee Fund will increase by a total of $1,926,500. The City will provide funding for the items listed as “additions”. The City will not fund the item indicated as “reduction”. The Street Impact Fee Fund has sufficient cash available to fund the additional spending in FY17. Attachment: Resolution No. 4731 Report compiled on September 20, 2016 143 Page 1 of 2 COMMISSION RESOLUTION NO. 4731 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE CITY’S ANNUAL BUDGET FOR STREET IMPACT FEE APPROPRIATIONS FOR THE FISCAL YEAR ENDING JUNE 30, 2017. WHEREAS, the City Commission did, on the 20th day of June, 2016, after due and proper legal notice, conduct a public hearing and adopt a municipal budget for Fiscal Year 2016-2017 (Fiscal Year 2017); and WHEREAS, the need to change the projects and amounts approved in the Fiscal Year 2017 budget for Street Impact Fee funding now exists; and WHEREAS, these changes were presented to and discussed by the City’s Impact Fee Advisory Committee on September 15, 2016; and WHEREAS, the City Commission did, on the 26th day of September, 2016, after due and proper legal notice, conduct a public hearing on proposed amending the municipal budget. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, to wit: Section 1 – Appropriation Changes The City Commission of the City of Bozeman, Montana, does hereby authorize the following changes to expenditures in the Street Impact Fee Fund: Additions: These projects and amounts are added to the FY17 budget. SIF 103 – S. 11th Avenue – design ($396,000) 144 Page 2 of 2 Total Appropriations Changes: $1,926,500 Section 2 – Use of Cash on Hand in the Street Impact Fee Fund The increased appropriation will be funded with cash on hand in the Street Impact Fee Fund. Section 3 Pursuant to Section 7-6-4030, M.C.A., this resolution, upon its passage, shall be in full force and effect on July 1, 2016. Section 4 That should it be found by any court of competent jurisdiction that any section, clause, portion, sentence, word, or phrase of this resolution is deemed to be contrary to any existing law or regulations, that in this instance, it is the intent of the City Commission of the City of Bozeman, Montana, that all other portions, sections, words, clauses, phrases, or paragraphs of this document shall remain in full force and effect.
