The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, 13 October 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner
Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, City Manager Fryslie,
Assistant City Manager Wolf, City Attorney Berg, and the Acting Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings
were had.
Minutes of the regular meeting held on Wednesday, 6 October 1976, were approved as read.

Open Bids - Trailer Mounted Air Compressor
This was the time and place set for opening of sealed bids for the purchase of One New Two
Wheel Trailer 110unted Air Compressor for the Shop Complex. The affidavit of publication of the
"Call for Bids" was presented.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the bids be
opened and read, and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer,
and Mayor Vollmer; those voting No, none.
The following bid was then opened and read:
Allied Equipment, Billings $5,459.00
Upon concurrence of the City Manager, it was moved by Commissioner Taylor, seconded by
Commissioner Vandeventer, that the bid be referred to the Water, Cemetery and Sewer Departments
for tabulation and recommendation to be made on 20 October 1976, and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vande-
venter, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none.
Hearing - Conditional Use Permit - vlarner Marketing Association
This was the time and place set for a public hearing to consider the request of Warner
Marketing Associates for a conditional use permit to build a theatre complex on Lot 9 in the
Tai Lane Addition, said property being located at 1611 South Eleventh Avenue.
The Zoning Commission, after consideration of the Planning staff's report, unanimously
approved the conditional use request.
Upon the City Manager's recommendation, it was moved by Commissioner Vandeventer, seconded
by Commissioner Lehrkind, that the Commission concur with the Zoning Commission's recommendation
and approve ttle conditional use permit application for Warner Marketing Associates. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting
No, none.
Easement for Water and Sewer Lines - CMStP&P Railroad
A Pipe Line Agreement by and between Chicago, Milwaukee, St. Paul and Pacific Railroad
Company and the City of Bozeman for the purpose of providing for a water line and sanitary
sewer across the Railroad's right of way near Bozeman was presented. Special provisions of
the agreement are a preparation fee of $50.00 and an annual rental fee of $35.00 to be paid by
the City.
Upon recommendation of the City I1anager, it was moved by Commissioner Lehrkind, seconded
by Corrmissioner Sedivy, that the Pipe Line Agreement be approved and the Mayor and Acting Clerk
of the Commission be authorized and directed to sign for the City. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner
Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Hayor Vollmer; those voting No, none.
Shopping Center Discussion - Joe Sabol
Mr. Joe Sabol, counsel for University Mall Associates, made a presentation before the
Commission stating that since Mail Iiall is also being built in the same trade zone, tenants will
not sign a lease with University Mall. Mr. Sabol suggested that either the Commission rescind
the hookup of Main Mall to the City sewer system or that the Commission withdraw the SID of
$250,000.00 -- an expense incurred by University 11all. He added that he would like to have
their decision on this matter next, and the COlnmissioners agreed.
Building Code Adoption - 1976 Edition UBC
This was the time and place set for a public hearing to consider adopting the 1976 Edition -
Uniform Building Code (Ordinance 978). The Notice of Intention was presented.

It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that Ordinance
No. 978 be passed and adopted, and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commis-
sioner Vandeventer, and Mayor Vollmer; those voting No, none.
Resolution No. 1828 - Conflict of Interest Resolution

BOZEMAN'S COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM.
establishing conflict of interest procedures for the City of Bozeman's Community Development
Block Grant Program was presented.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that Resolution No. 1828
be passed and adopted, and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind.

Sign Code Variance - Beaver Pond
A letter received from Mr. F. J. Messmer and Mr. Russell L. Jones of Beaver Pond requesting
a sign code variance to build a sign partially constructed of wood in order to match the building
exterior was presented.
Upon recommendation of the City Manager, it was moved by Commissioner Vandeventer, seconded
by Commissioner Lehrkind. that the Commission concur in the recommendation of the City Manager
and approve the request for the Sign;Code Variance. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind.
Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none.
Raffle License - Chi Omega Sorority
The City Manager presented an application from the Chi Omega Sorority, along with the
required fee, for a raffle license.
Upon recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded
by Commissioner Sedivy, that the Commission approve the application for the raffle license.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor
Vollmer; those voting No, none.
Report: Police Court
The City Manager commented on the report of the Police Court and recommended it be accepted
and ordered filed.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the report be
accepted and ordered filed. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner
Lehrkind, and Mayor Vollmer; those voting No, none.
Camp Fire Girls - Annual Candy Sale - 15-25 October
A request from the Headwaters Council of Camp Fire Girls for permission to hold their annual
candy sale on the 15-25 October 1976 was presented. It was moved by Commissioner Taylor,
seconded by Commissioner Vandeventer, that permission to hold their annual candy sale be granted
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer;
those voting No, none.
Proclamation - National Business Women's Week - 17-23 October
Mayor Vollmer announced his proclamation designating 17-23 October 1976 as National Business
Women's Week. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind,
that the Commission endorse the Mayor's proclamation and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind.
Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none.
F. E. (Sonny) Suhr
Mr. Suhr expressed concern and solicited the City's action regarding paving on North 5th
from Durston Road North. The City Manager told him that he would check into the matter.

The City Manager checked the claims and found them to be true and lawful claims against the
City of Bozeman and recommended they be approved and the Director of Finance be instructed to
issue warrants in payment.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that all claims
be approved as presented, and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner
Sedivy, and Mayor Vollmer; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved
by Commissioner Vandeventer, seconded by Commissioner Taylor, that the meeting be adjourned
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer;
those voting No, none.
