The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, 6 October 1976, at 1:15 o'clock p.m. Present were Mayor
Vollmer, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, City
Manager Fryslie, Assistant City Manager Wolf, City Attorney Berg and the Acting Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following pro-
ceedings were had.
Minutes of the regular meeting held on Wednesday, 29 September 1976, were
approved as read.
Leave of Absence - Commissioner Lehrkind, 6 October 1976
Upon recommendation of the City Manager, it was moved by Commissioner Taylor,
seconded by Commissioner Vandeventer, that the absence of Commissioner Lehrkind,
from the meeting of 6 October 1976, be authorized in compliance with Section 11-3245,
R.C.M., 1947. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy,
and Mayor Vollmer; those voting No, none.
Hearing - Proposed Zone Code Amendment - Conditional Uses
This was the time and place set for a public hearing to consider the request
of the Bozeman City-County Planning Staff to amend Section 23 {Conditional Uses)
of the Bozeman Area Zoning Code. Said amendment would hopefully reduce the time
requirements of the conditional use procedure.
Upon the City Manager's recommendation that the hearing be continued after
the decision of the Planning Board is received, it was moved by Commissioner Sedivy,
seconded by Commissioner Taylor, that the hearing be continued and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy,
Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No,
none.
Hearing - Conditional Use Permit - Everett Egbert
This was the time and place set for a public hearing to consider the request
of Everett Egbert for a conditional use permit to construct a 4,000 square foot
store and warehouse building on Lot 7 of the Bozeman Industrial Park Subdivision,
located on Griffin Drive, zoned M-l-T.
The Zoning Commission, after consideration of the Planning staff's report,
unanimously approved the conditional use request with the following conditions:

That signing be limited to a maximum of two signs, with a total
size of 50 square feet or less, either wall signs or eave signs
(eave sign not to extend above the top roof line), and either
non-illuminated or indirectly illuminated.
That landscaping include specifically, the anticipated grassed
area plus a minimum of five (5) conifer trees (2" minimum diameter).
Also, that landscaping be protected from parking and maneuvering
area by a curbing or barrier.

3. That any required landscaping, paving, fencing, and barrier work,
be completed within nine (9) months after occupancy of the building.
Upon the City Manager's recommendation, it was moved by Commissioner Vandeventer,
seconded by Commissioner Sedivy, that the Commission concur with the Zoniag

Commission's recommendation and approve the conditional use permit application for
Everett Egbert with the above conditions. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner
Sedivy, Commissioner Taylor, and Mayor Vollmer: those voting No, none.
The City Manager recommended that the Commissioners instruct the Planning staff

and building inspector to initiate an amendment to the zoning code to remove the
transitional designation from Bozeman Industrial Park Division in order to reduce
the number of conditional use applications coming before the Commission.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, to
instruct the Planning staff to act on an amendment to remove the transitional
designation from Bozeman Industrial Park Division, and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commis-
sioner Taylor, Commissioner Vandeventer, and Mayor Vollmer: those voting No, none.
Hearing - Conditional Use Permit - David Osterman
This was the time and place set for a public hearing to consider the request
of David Osterman for a conditional use permit to construct a complex of four ware-
house buildings, housing 61 rent-type storage units, on Tract 1 of the Mays Tracts
Subdivision, located on North Griffin Drive. The complex will be located in an
M-l-T zone.
The Zoning Commission, after consideration of the Planning staff's report,
unanimously approved the conditional use request with the following conditions:

trees (minimum 211 diameter) set in a ground cover of shrubs,
ornamental rock and boulders. Also, that landscaping be protected
from driveway and maneuvering areas by curbing or barriers.

satisfaction of the City Engineering Department . before a building
permit is issued.

Hearing - Conditional Use Permit - Burton Moe
This was the time and place set for a public hearing to consider the request
of Burton Moe for a conditional use permit to construct three 8 plexes of efficiency
unit apartments to be built on three separate lots -- lots 4, 5, and 6 of Moe's

Subdivision located on South 15th Avenue, south of Babcock.
The Mayor declared the hearing open. Not having received a recommendation
from the Zoning Commission, it was moved by Commissioner Vandeventer, seconded by
Commissioner Sedivy, that the hearing be continued until a future date. The motion

was carried by the following Aye and No vote: those voting Aye being Commissioner
Vandeventer, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those
voting No, none.
Hearin and Final Ado tion: a) Resolution No. 1826 - Assess SID 550 - $45,883.35
b) Resolution No. 1827 - Assess SIn 553 - 88,629.95
This was the time and place set for pUblic hearing on levying the final
assessment for the construction of watermains in Figgins Addition and Graf's Third
Addition, SID No. 550 in the amount of $45,883.35. Affidavit of pUblication of
Notice was presented. No one appeared to protest verbally, and there being no pro-
tests on file, it was moved by Commissioner Sedivy, seconded by Commissioner Taylor,
that Commission Resolution No. 1826 provisionally passed and adopted on 29 September
1976 be finally passed. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vande-
venter, and Mayor Vollmer; those voting No, none.
This was the time and place set for public hearing on levying the final
assessment for the construction of a storm drainage system in Figgins Addition,
SID No. 553 in the amount of $88,629.95. Affidavit of publication of Notice was
presented. No one appeared to protest verbally, and there being no protests on
file, it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer,
that Commission Resolution No. 1827 provisionally passed and adopted on 29 September
1976 be finally passed. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner
Sedivy, and Mayor Vollmer; those voting No, none.
Proposals for Roof Repair - Police - Fire Building
The Police and Fire Building is in need of roof repairing and the City Manager
requested and recommended that Sickler Roofing Service be awarded the contract for
roofing at an estimated cost of $4,395.00.
It was moved by Commissioner Vandeventer, seconded by Commissioner Sedivy,
that the City award the roofing contract to Sickler Roofing Service for $4,395.00.
The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Sedivy, Commissioner Taylor, and Mayor
Vollmer; those voting No, noae.
Certificate of Completion - Curb and Sidewalks - Mendenhall and Babcock Streets
A letter from James Cummings of Thomas, Dean & Hoskins Inc. notifying the City
that the construction of the Curb and Gutter Improvements by Concrete Specialties
has been completed in accordance with the plans and specifications was presented.
The letter further stated that the improvements be accepted and approved by the
City Commission and that the contractor shall be paid the full amount due him within
30 days.
The City Manager concurred with the above recommendation, and it was moved by
Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission accept
and approve the Babcock-Mendenhall Curb and Gutter Improvements and that the oon-
tractor be paid within 30 days, and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commis-
sioner Vandeventer, and Mayor Vollmer; those voting No, none.

Easement for Street - Babcock - 23rd
An Easement and Right of Way Agreement for Street Construction by and between
Anton Lovfald and Bruce Mecklenberg and the City of Bozeman for the purpose of con-
structing and installing streets and necessary appurtenances to serve various proper-
ties located within the southwest portion of the City of Bozeman was presented.
Upon the recommendation of the City Manager, it was moved by Commissioner Taylor,
seconded by Commissioner Vandeventer, that the Easement and Right of Way Agreement
for Street Construction, having been executed by Anton Lovfald and Bruce Mecklenberg,
be approved and the Mayor and Acting Clerk of the Commission be authorized and
directed to sign for the City. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commis-
sioner Sedivy, and Mayor Vollmer; those voting No, none.
Application for Bingo License - F.O.E.
The City Manager presented an application from the Auxiliary Fraternal Order
of Eagles, along with the required fee, for a Bingo license.
Upon the recommendation of the City Manager, it was moved by Commissioner Vande-
venter, seconded by Commissioner Sedivy, that the Commission approve the application
for the Bingo license and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vandeventer, Commissioner Sedivy, commissioner
Taylor, and Mayor Vollmer; those voting No, none.
Application for Raffle License - Pilgrim Congregational Church
The City Manager presented an application from the Pilgrim Congregational
Church, along with the required fee, for a raffle license.
Upon recommendation of the City Manager, it was moved by Commissioner Sedivy,
seconded by Commissioner Taylor, that the Commission approve the application for
the raffle license. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer,
and Mayor Vollmer; those voting No, none.
South Third Avenue Improvements
Mr. Arthur Vanlt Hul, City Engineer, made a presentation before the Commission
regarding South Third AVenue Improvements. He estimated the cost of the improve-
ments would be about $390,000.00 which would require a special improvement district
funding.
The City Manager recommended that we first convey this conclusion to the
surrounding property owners and allow them to give us their reaction and the Commissim
agreed.

Mrs. Judy Mathre - Community Councils
Mrs. Judy Mathre inquired the Commissioners if they had any further thoughts
regarding Community Councils in our City. She pointed out that these Councils would
facilitate communications between the City Commission and neighboDhoods, adding that
Great Falls and Helena had such councils.
The Commissioners responded by saying that they would like to observe how
Community Councils are working in other cities first before they make a decision.
Proclamation - Columbus Day - 11 October 1976
Mayor Vollmer announced his proclamation designating Monday, 11 October 1976,
as Columbus Day and urged all citizens to observe this day in a manner that will
dramatize and restate the fundamental principles of faith, wisdom, and courage
which guided the footsteps of the Great Discoverer.
Adjournment
There being no further business before the Commission, it was moved by
Commissioner Sedivy, seconded by Commissioner Taylor, that the meeting be adjourned
and the motion was carried by the following Aye and No vote: those voting Aye
