The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, 22 September 1976, at 1:15 o'clock p.m. Present were
Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor,
Commissioner Vandeventer, City Manager Fryslie, Assistant City Manager Wolf, City
Attorney Berg and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceed-
ings were had.
Minutes of the regular meeting held on Wednesday, 15 September 1976, were
approved as read.
Consideration of Bids - Dump Truck for Street Department
The Street Superintendent, having studied all the bids submitted by the various
bidders, respectfully submitted and recommended that the low bid submitted by Rolfe
and Wood, Inc., in the amount of $20,572.12 on the two 1977 Dodge D-600 dump trucks
equipped with perfection 4 yard dump boxes and hoists meeting all specifications
called for in the bid, be accepted as the best bid for the City of Bozeman.
The Commission concurred with the recommendation of the Street Superintendent,
and it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that
Rolfe & Wood, Inc., be awarded the bid for the two 1977DodgeD-600 dump trucks in
the amount of $20,572.12, and the motion was carr~ed by the following Aye and No
vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commis-
sioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none.
Consideration of Bids - South Side Park Building
The Commission was referred to the opening of bids on 15 September for the
construction of a building to be located at the South Side Park as prepared by the
Building Inspector.
The Building Inspector having reviewed the bids for the structure with the
Recreation Director and the Park Superintendent recommended that the bid be awarded
to Robert A. Taylor Construction based upon their low bid in the amount of $25,432.00.
The Commission concurred in the recommendation of the staff, a1sD concurred in
by the City Manager, and it was moved by Commissioner Sedivy, seconded by Commissioner
Vandeventer, that Robert A. Taylor Construction be awarded the bid based upon his
low bid of $25,432.00. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Sedivy, commissioner Vandeventer, Commissioner
Lehrkind, and Mayor Vollmer; those voting No, none; those abstaining being Commis-
sioner Taylor.
Contract Documents
The Contract documents for the construction of the Bozeman Bogert Park
Pavilion as prepared by Berg-Grabow-Schofield Architects was presented. The City
Manager recommended that the contract documents in the amount of $141,920.00 as
submitted by Edsall Construction Company be approved.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind,
that the contract documents be approved and the Mayor and Clerk of the Commission
be authorized and directed to sign the contracts for the City of Bozeman, and that

Edsall Construction, Bozeman, be authorized and directed to proceed with the construc-
tion of the Bozeman Bogert Park Pavilion and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehr-
kind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No,
none.
Request to Conduct Parade - BSHS - Saturday, 9 October 1976
A letter received from perrie Agocs of the Student Council of Bozeman Senior
High School, requesting permission to conduct a Homecoming Parade on Saturday, 9
October 1976, at 12:15 p.m. was presented.
The parade is to begin at Buttrey's parking lot and proceed down Main Street to
Heebs Grocery where it will disband.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that
the request be granted with police participation to insure traffic control. The
motion was carried by the following Aye and No vote: those voting Aye being Commis-
sioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer,
and Mayor Vollmer; those voting No, none.
Improvement for South Third Avenue
A petition signed by approximately 175 residents of the area from the Kagy-Third
Street intersection south to the City limits was presented. The petition states
South Third Avenue from Kagy Boulevard to the City limits does not meet reasonable
safety standards for vehicular or pedestrian travel. Three churches and a nursery
school are also located in this area.
The petitioners request the City to construct and maintain an all-weather, hard
surfaced street with a minimum width of thirty-seven feet.
Many interested persons were also present in regard to the petition.
The Commission thanked the petitioners for their presentation and stated they
were aware of the traffic problems in the area and would consider the petitioners'
request in setting priorities for road improvement.
Supplemental Report - Bozeman City Government Study commission
Torlief Aasheim, acting as Chairman 6f the Bozeman Study Commission, presented
several proposals that the Study Commission felt might be worthy of the City Commis-
sion consideration. Mr. Aasheim also asked that the City of Bozeman make a written
report as to what they desire.
The Commission thanked Mr. Aasheim and Mrs. Mathre for attending the meeting
and voicing their opinion as to the':Bozeman Study Commission's opinion.
Request to Place Tables on Sidewalks - Petition Circulators
Two separate groups contacted the City of Bozeman for the purpose of placing
card tables on Bozeman City Streets and gather signatures for petitions to place
a constitutional amendment on the ballot in November 1978.
Having reviewed its policy of obstructing traffic in street right-of-way and
upon pUblic sidewalks and following a full de1iveration and consideration of the
matter, the past and current policy was reaffirmed by the City Commission and it
was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the City of

Bozeman adhere to the pOlicy it had in the past and deny the request. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and
Mayor Vollmer; those voting No, none.
Curb Cut Variance at 2015 West Beall Street, Mrs. Lillie M. Warwood
A letter received from Mrs. Lillie M. Warwood of 2015 West Beall, requesting
a second curb cut variance off of North 21st Avenue, was presented. This cut will
facili tate entering her,ilarge backyard as there is no alley access.
Following discussion, it was moved by Commissioner Vandeventer, seconded by
Commissioner Lehrkind, that the request for the second curb cut variance off of
North 21st Avenue be granted. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind,
Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none.
Raffle License - Ducks Unlimited
The City Manager presented an applicatiDn from the Ducks Unlimited, along
with the required fee, for a raffle to be held on 23 September 1976.
upon recommendation of the City Manager, it was moved by Commissioner Lehrkind,
seconded by Commissioner Sedivy, that the Commission approve the application for
the raffle license to be held on 23 September 1976. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commis-
sioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer;
those voting No, none.
Authority to Call for Bids - Air Compressor for Street and Cemetery Dept. ($10,000.00)
The Street and Cemetery Department has need for a new two wheel trailer mounted
air compressor and the City Manager requested authorization to call for bids for the
compressor at an estimated cost of $10,000.00.
It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, it
being a budget item, that the purchase of the two wheel trailer mounted Air Compressor
be authorized and the Clerk of the Commission be authorized and directed to issue a
"Call for Bids" for the purchase to be received on 13 October 1976. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy,
Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor
Vollmer; those voting No, none.
Proposed Purchase of New 1,000 Gallon Pumper Fire Truck
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind,
that the City Commission officially confirm the purchase of the new 1,000 pumper
fire truck for the Fire Department and that the staff be instructed to draw up
the specifications for a new 1,000 gallon pumper truck as requested by the City
Fire Department. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner
Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none.

Commission Resolution No. 1825 - Intent to Close Portion of Ida Street
Commission Resolution No. 1825 for the purpose of closing and prohibiting
traffic on a portion of Ida Street was presented.

A RESOLUTION CLOSING AND PROHIBITING TRAFFIC ON A PORTION OF
IDA STREET IN THE CITY OF BOZEMAN.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that
the portion of Ida Street as stated above be closed. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commis-
sioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer;

bally, and there being no protests on file, it was moved by Commissioner Sedivy,
seconded by Commissioner Taylor, that Commission Resolution No. 1820 provisionally
passed and adopted on 15 September 1976 be finally passed. The motion was carried

that Commission Resolution No. 1822 provisionally passed and adopted on 15 September
1976 be finally passed. The motion was carried by the following Aye and No vote:

that Commission Resolution No. 1823 provisionally passed and adopted on 15 September
1976 be finally passed. The motion was carried by the following Aye and No vote:

by Commissioner Sedivy, seconded by Commissioner Taylor, that Commissioner Resolution
No. 1824 provisionally passed and adopted on 15 September 1976 be finally passed.
The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner
Lehrkind, and Mayor Vollmer; those voting No, none.
Proclamation - Life Time Learning
Mayor Vollmer announced his proclamation of 25-30 September as the Institute
of IILffe Time Learning" as requested by the Senior Citizens, and called upon all
citizens of Bozeman to observe the proclamation.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer,
that the proclamation as requested be endorsed. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner
Vandeventer, Commissioner Lehrkind, and Commissioner Sedivy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time,
it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that
the meeting be adjourned and the motion was carried by the following Aye and No
