HomeMy WebLinkAbout1976-09-15 I I I Bozeman, Montana ;,57 15 September 1976 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 15 September 1976, at 1:15 o'clock p.m. Present were Acting Mayor Sedivy, Commissioner Lehrkind, Commissioner Taylor, Commissioner Vande- venter, City Manager Fryslie, Assistant City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Tuesday, 7 September 1976, were approved as read. Leave of Absence - Mayor Vollmer, 15 September 1976 Upon recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Taylor, that the absence of Mayor Vollmer from the meeting of 15 September 1976, be authorized in compliance with Section 11-3245, R.C.M., 1947, and that Commissioner Sedivy, be appointed as President Pro-Tempore during his absence The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Taylor, Commissioner Vandeventer, and Acting Mayor Sedivy; those voting No, none. Consideration of Bids - Multi-Purpose Pavilion The Commission was referred to the opening of bids on 7 September for the construction of the Bozeman Bogert Park Pavilion as prepared by Berg-Grabow-Schofield Architects. Architect William E. Grabow of Grabow and Associates, and the City staf~ having completed their study of the bids submitted and having prepared a final tabulation of the bids,recommended that the bid be awarded to Edsall Construction on their low bid in the amount of $141,920.00 as follows: Base Bid Alternate #1 Alternate #3 A & E Sewer $114,950.00 7,200.00 7,100.00 9,000.00 3,670.00 $141,920.00 The Commission concurred in the recommendation of the Architects, also concurred in by the City Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the bid be awarded to Edsall Constructing of Bozeman at a cost not to exceed $141,920.00. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Taylor, and Acting Mayor Sedivy: those voting No, none. Consideration of Bids - SID No.'s 567, 568 and 569 In accordance with the plans and specifications under date of 11 August 1976, 8 September was the date set for opening bids for the consteuction of SID No. 567, 568 and 569, and the consulting engineers and the city engineer opened the following bids: Peter Kiewitt Sons' Co. - Billings w. D. Construction Inc. - Bozeman Intermountain Construction - Bozeman $310,329.08 287,637.00 231,010.00 ..... :58 The engineers representing consultants Thomas, Dean & Hoskins, Inc., having completed their study of the bids for the construction of SID No. 567, Sanitary Sewer Laterals Figgins Addition Phase II, SID No. 568, construction of Lateral Watermains in Figgins Addition Phase II, and SID No. 569, construction of lateral Watermains and Sanitary Sewer Mains Summit Engineering, and having prepared a final tabulation of the bids submitted, recommended that the bid be awarded to Intermountain Construction on the basis of their low bid in the amount of $231,010100, it equaling or exceeding all specifications in the "Call for Bids". The Commission concurred with the recommendation of the engineers, also concurred in by the City Manager, and it was moved by Commissioner Lehrkind, seconded by Commis- sioner Taylor, that Intermountain Construction Company be awarded the bid for the construction of Lateral Watermains and Sanitary Sewer Mains in SID No.ls 567, 568 and 569 in the amount of $231,010.00 contingent upon the sale of the bonds. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Taylor, Commissioner Vandeventer, and Acting Mayor Sedivy; those voting No, none. Open Bids - Two Dump Trucks This was the time and place set for opening of sealed bids for the purchase of two 1977 Model 20,000 pound G.V.W. Trucks for the Street Department. The affidavit of pUblication of the "Call for Bids" was presented. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the bids be opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Acting Mayor Sedivy; those voting No, none. G.M.C. - Three Forks Owenhouse Hardware - Bozeman Rolfe & Wood, Inc. - Bozeman The Commission concurred in the recommendation of the City Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the bids be referred to the Street Superintendent for tabulation and recommendation to be made on Wednesday, 22 September 1976. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Taylor, and Acting Mayor Sedivy; those voting No, none. Open Bids - South Side Park Building This was the time and place set for the opening of bids for the construction of a building to be located at the South Side Park as prepared by the Building Inspector. The affidavit of pUblication for the "Call for Bids" was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Taylor, that the bids be opened and read. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Taylor, Commissioner Vandeventer, and Acting Mayor Sedivy; those voting No, none. I I I I I I 5-9 The following bids were then opened and read: Edsall Construction - Bozeman Taylor Construction - Bozeman Western Construction - Bozeman $29,950.00 25,432.00 27,174.00 Upon concurrence of the City Manager, it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the bids be referred to the Building Inspector for tabulation and recommendation to be made on Wednesday, 22 September. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Acting Mayor Sedivy; those voting No, none. Bonds Sales: (a) SID No. 567 - Phase II Sewer, Figgins Addition - $100,000.00 (b) SID No. 568 - Phase II Water. Fiqqins Addition - 96,000.00 (c) SID No. 569 - Water and Sewer, Swnnut Eng1neer1ng - 86,000.00 The City Manager stated that according to the affidavit of publication, this was the time and place set for the bond sale of Special Improvement District Numbers 567, 568 and 569. The Mayor and City Manager outlined the procedure for conducting this bond sale and stated the amount of bonds to be sold for each district would be the same as the advertised amount. It was moved by Commissioner Lehrkind, seconded by Commissioner Taylor, that the bidding begin and that the City not accept any bids either sealed or oral bids above 8%. The motion was carried by the following Aye and No vote: those voting aye being Commissioner Lehrkind, Commissioner Taylor, Commissioner Vandeventer, and Acting Mayor Sedivy; those voting No, none. The Clerk of the City Commission then presented a sealed bid from D. A. Davidson & Company of Great Falls in the amount of 7.40% plus a premium of $60.00 for Special Improvement District No. 567. The sealed bid submitted by D. A. Davidson & Company of Great Falls having been the only bid submitted, the City Manager recommended that the sale of the bonds for Special Improvement District No. 567 be awarded to D. A. Davidson & Company, Great Falls, on the above basis. The Commissioner concurred in the recommendation of the City Manager and it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the sale of the bonds for Special Improvement District No. 567 in the amount of $100,000.00 be awarded to D. A. Davidson & Company, Great Falls, at 7.40% plus a premium of $60.0Q The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Acting Mayor Sedivy; those voting No, none. The Mayor announced that the City was now ready to conduct bidding for the purchase of the bonds for SID No. 568. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the city proceed with the bidding of SID No. 568. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Taylor, and Acting Mayor Sedivy; those voting No, none. "60 The following bidders presented their good faith checks as prescribed by the Notice of Sale: D. A. Davidson & Company - Great Falls First Security Bank - Bozeman The sealed bid from D. A. Davidson & Company of Great Falls in the amount of 7.45% plus a premium of $60.00 was submitted. Oral bidding began and the final best oral bid was First Security Bank of Bozeman in the amount of 7.40%. It was moved by Commissioner Lehrkind, seconded by Commissioner Taylor, that the sale of the bonds for Special Improvement District No. 568 in the amount of $96,000.00 be awarded to First Security Bank of Bozeman in the amount of 7.40%. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Taylor, Commissioner Vandeventer, and Acting Mayor Sedivy; those voting No, none. The Mayor announced that the City was ready to conduct bidding for the purchase of the bonds of SID No. 569. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the City proceed with the bidding of SID No. 569. ~e motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Acting Mayor Sedivy; those voting No, none. The sealed bid of D. A. Davidson & Company of Great Falls in the amount of 7.45% plus a $55.00 premium, having been the only bid submitted, the City Manager recom- mended that the sale of the bonds for Special Improvement District No. 569 in the amount of $86,000.00 be awarded to D. A. Davidson I Company. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the sale of the bonds for Special Improvement District No. 569 in the amount of $86,000.00 be awarded to D. A. Davidson & Company of Great Falls at 7.45% plus a $55.00 premium. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Taylor, and Acting Mayor Sedivy; those voting No, none. Proposed Sewer Line Agreement - Harry Daum et al The proposed Agreement by and between the City of Bozeman and Harry M. Daum and Kathleen Mary Ellen Daum, et aI, for the purpose of constructing of a trunk sewer line extending on a parcel of land in a northerly direction over and across lands owned by Gary L. and Joan W. Cook, George E. and Alice M. Cook, Lowell and Shirley E. Curtiss, and Erwin and Eva Lachenmaier and extending on Ourston Road east to connect with the present sewer system of the City of Bozeman, having been taken under advise- ment until the City Engineer had completed his stud~was again presented for dis- cussion and a final decision. Mr. William L. Madden, Jr., Attorney representing several interested persons, appeared in regard to the proposal for extension of City sewer and water services to the Main Mall Shopping Center. Mr. Madden protested the proposed extension of the new sewer line on behalf of a group of interested persons. I I I I I r 61 Following an extensive discussion, it was the City Attorney's opinion that there would be no legal ramifications which would justify denying Mr. Daum's request to construct the sewer line. Upon concurrence of the recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Taylor, that the City of Bozeman enter into the Agreement with Harry M. Daum and Kathleen Mary Ellen Daum, et aI, and the Mayor and Clerk of the Commission be instructed and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Taylor, Commissioner Vandeventer, and Acting Mayor Sedivy; those voting No, none. Proposals - TV Examination of Sewers A letter received from Thomas, Dean & Hoskins, Inc., engineering consultants advising the City Engineer that the T.V. Inspection proposal submitted by Guildner Water & Sewer, Inc., of 'Westminster, Colorado, in the amount of $51,390.00 was the lowest bid and equaled or exceeded all specifications. Following discussion, the Commission concurred in the recommendation of con- sUlting engineers also concurred in by the City Manager and it was moved by Com- missioner Taylor, seconded by Commissioner Vandeventer, that Guildner Water & Sewer, Inc., be awarded the bid in the amount of $51,390.00 for the proposed T.V. Inspection based upon their low bid and that the award be made contingent upon approval by the State Department of Health & Environmental Sciences and to the Environmental Pro~ tection Agency. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Acting Mayor Sedivy; those voting No, none. Authority to Purchase 5000 feet 3/4 Inch Copper Tubing - Approximately $3500 The Water Department has need for copper tubing and the City Manager requested authorization to purchase the copper tUbing at an approximate cost of $3,500.00. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the City Manager be granted authorization to purchase 5,000 feet 3/4 inch copper tubing at an approximate cost of $3,500.00. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Com- missioner Lehrkind, Commissioner Taylor, and Acting Mayor Sedivy; those voting No, none. Request for Variance to Sign Code - Lewis & Clark Motel A letter received from Mr. William Sebena requesting a Sign Code Variance to install flashing lights on the Lewis and Clark Motel sign was presented. Following discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Taylor, that the Commission concur in the recommendation of the City Manager and deny the request for the Sign Code Variance. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Taylor, Commissioner Vandeventer, and Acting Mayor Sedivy; those voting No, none. ..62 Ordinance No. 978 - 1976 Edition Uniform Building Code for Proposed Adoption ORDINANCE NO. 978 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES IN THE CITY OF BOZEMAN, MONTANA; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; PROVIDING PENALTIES FOR THE VIOLATION THEREOF, REPEALING ORDINANCE NO. 942 OF THE CITY OF BOZEMAN AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. I being marked and designated as the 1976 Edition - Uniform Building Code for the purpose of regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area, and maintenance of all buildings or structures in the City of Bozeman was presented. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Notice of Intention to adopt the foregoing building code, as amended, be passed, adopted and approved and the notice be published once in the Bozeman Daily Chronicle at least fifteen (15) days prior to final action and that the hearing be held on Wednesday 13 October. Proclamations: a) Pass, Punt and Kick Day - 18 September 1976 b) Constitution Week c) World Peace Day Acting Mayor Sedivy announced his proclamation of 18 September 1916, as "Punt, Pass and Kick Day" in the City of Bozeman and called upon all citizens of Bozeman to observe the day with the traditional American Spirit of Competition and good I sportsmanship. A proclamation proclaiming 11-23 September 1976 as "Constitution Week" as requested by the Montana Society of the Sons of the American Revolution, was presented It was moved by Commissioner Lehrkind, seconded by Commissioner Taylor, that the Commission endorse Acting Mayor Sedivy's proclamation as presented. In accordance with the Spiritual Assembly of the Baha'i of Bozeman,' Acting Mayor Sedivy proclaimed September 1976 as World Peace Day, in the fervent hope local communities and eventually in the world community.
