HomeMy WebLinkAbout1976-09-01 ,50 Bozeman, Montana 1 September 1976 The Commission of the City of Bozeman met in regular session in the Commission , , Room, Municipal Building, 1 September 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, City Manager Fryslie, Assistant City Manager Wolf, City Attorney Berg and the Clerk. Commisstoner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on 25 August 1976, were approved as read. Consideration of Bids - Playground Equipment The Commission was referred to the opening of bids for the purchase of playground equipment for Bogert Pool, Beall Park and the Recreation Complex on 25 August 1976. The bids having been studied in detail by the Park Recreation Department, ~ecommended that the purchase of all of the playground equipment with the exception of the See Saw which was not included in their bid, be awarded to Jensen Park and Recreation Equip- ment Company, Spokane, on the basis of their bid in the amount of $28,067.02 it being I the lowest bid and equaling or exceeding the specifications as contained in the "Call for Bids." The Park Recreation Department recommended that Gene Shoaf & Associates of Spokane be awarded the bid for the See-Saw in the amount of $375.00, it being the only bid submitted and equaling or exceeding the specification in the "Call for Bids". It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the purchase of the playground equipment be awarded to Jensen Park and ReCr&ation Equipment Company in the amount of $28,067.02 and the purchase of the See SaW-,be awarded to Gene Shoaf & Associates in the amount of $375.00. The motion was carried I by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer: those voting No, none. Hearing - Frank Kountz, Jr., - Rezone AS to M-I This was the time and place set for a public hearing to consider a Zone change from AS (Agriculture Suburban) to M-l (Commercial-Light Manufacturing) on an approx- imately 40 acre tract of land located one mile west of the city limits on Highway 191 west from Kountz Trailer Kourt to Cottonwood Road. The zone change would allow the applicant to establish a shop for rebuilding wrecked cars and trucks. Surrounding land uses include agricultural uses, single family homes and mobile homes. After reviewing the considering the planning staff report, the Zoning Commission voted unanimously to deny the zone change request for Mr. Frank Kountz from AS to M-l The Commission concurred with the recommendation of the Zoning Commission also I zone. concurred in by the City Manager, and it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission deny the zone change from AS (Agriculture Suburban) to M-l (Commercial Light Manufacturing) on the land owned by Frank Kountz, Jr., The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer: those voting No, none. I I I 51 Hearing Conditional Use Permit - Robert Jenkins, 40' x 75' Addn. at Griffin Drive This was the time and place set for a pUblic hearing to consider the request of Robert Jenkins for a conditional use permit to construct a 40' x 75' metal building on one-half of Lot 1 of the Bozeman Industrial Park located at Griffin Drive. The building will house the warehouse, small retail store and offices for the Eddy's Bakery, and is located in an M-l-T zone. The Zoning Commission, after consideratiDn of the Planning staff's report, recommended approval of the conditional use request with the following Conditions: 1. That required landscaping include specifically, the anticipated grassed area plus a minimum of five (5) conifer trees (2 inch in diameter). That landscaping be protected from parking and maneuvering areas by a curbing or barrier. 2. That signing be limited to one non-illuminated, flush mounted building sign of less than 50 square feet in size. 3. That all required landscaping, paving, and barrier work be completed within nine (9) months after occupancy of the building. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission concur with the Zoning Commission's recommendation and approve the conditional use permit application for Robert Jenkins with the above conditions. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer1 those voting No, none. Hearing, Conditional Use Permit - Robert Jenkins, 36' x 30' Addn. at 1523 No. Rouse This was the time and place set for a public hearing to consider the 36' x 30' addition to the existing Sweetheart Bakery Building located at 1523 North Rouse Avenue. The conditional use application is necessary because the building is located in an M-l-T zone. The Zoning Commission, after consideration of the Planning staff's report, recommended approval of the application for the conditional use permit. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission concur with the Zoning Commission's recommendation and approve the application for the conditional use permit. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commis- sioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer1 those voting No, none. Hearing, Conditional Use Permit - Joanne B. Jensen This was the time and place set for a pUblic hearing to consider the request of Ms. Joanne B. Jensen, 501 S. 10th Avenue, for a conditional use permit to allow a pre-school in the first floor of a single family residence at 804 South Willson. The Zoning Commission, after reviewing the staff findings, recommended approval of the application of the conditional use permit with the following conditions: 1. Signing be limited to one (1) non-illuminated, flush building mounted unit, l' x 2'. 2. That indicated fencing be installed before the school begins sessions. 3. That the dropoff, pickup area be located on Willson Street, rather than College Street or the alley. "52 It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission concur with the recommenation of the Zoning Commission and approve the application for the conditional use permit with the above conditions. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vande- venter, and Mayor Vollmer; those voting No, none. Hearing - Rezone School Property ~ PLI to R-4 A request from the Board of Trustees of School District No.7, to consider a recommendation from the Zoning Commission to change the Zoning from PLI to R-4, Blocks 33 and 34 in the tmes Addition to the City of Bozeman and known as the North Grand Ball Park was presented for hearing. The Bozeman Zoning Commission having held a public hearing on 24 August recom- mended that the City Commission approve the zone change request of School District No. 7 from PLI to R-4. I It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission approve the zone change request and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Request to Extend Going Out of Business License - Big "0" Tires A letter received from Long's Big "0" Tires, requesting a thirty-day extension I on their Going Out of Business License was presented. Following discussion, it was moved by Commissioner Taylor, seconded by Commis- sioner Vandeventer, that the Big "0" Tires be granted the thirty-day extension, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Request to Lease City Land - Myhre Advertising A letterLreceived from Michael Bissonnette, Director of Planning and Development of Myhre Advertising, requesting that the City of Bozeman enter into a five-year lease agreement at a price of $300.00 per year on a parcel of property located on North Seventh Avenue and described as Tanges Addition, Block 3, Lot 5, was presented. The proposed property is a 40' lot and is located next to the Exxon Service Station on North Seventh Avenue. Following a discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the request for the proposed 5-year Lease Agreement be denied, and the motion was carried by the following Aye and No vote: those voting I Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none; and Commissioner Vandeventer abstained. Easement Agreement - Water and Sewer Lines - Development Credit Corporation An Easement and Right of Way Agreement by and between Development Credit Corporation and the City of Bozeman for the purpose of construction and installation I I I 53 of water and sewer lines and necessary appurtenances to serve various properties located within the southern portion of the City of Bozeman and containing a strip of land thirty feet in width and containing 0.041 acres was presented. Upon concurrence of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Easement and Right of 'Wa~Agreement, having been executed by Development Credit Corporation of Montana, be approved and the Mayor and Clerk of the Commission be authorized and directed to sign for the City. The motion was carried by the following Aye and No vote: those voting Aye being Commis- sioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Easement Agreement - Water and Sewer Lines, Gene Graf and Montana National Bank An Easement and Right of Way Agreement by and between Gene Graf and Montana National Bank of Bozeman and the City of Bozeman for the purpose of construction and installation of water and sewer lines and appurtenances and for such other rights of access and incidental rights as are hereinafter described within the southern portion of the City of Bozeman and consisting of forty feet in width and containing approximately 0.134 acres was presented. Upon concurrence of the City Manager, it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Easement and Right of Way Agreement, having been executed by Gene Graf and the Montana National Bank of Bozeman, be approved and the Mayor and Clerk of the Commission be authorized and directed to sign for the City. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Harry Daum - Meeting Wednesday, 15 September 1976 Harry Daum appeared before the Commission to re-emphasize his urgent need for City sewer service. The Commission, after an informational session, said they would reconsider Daum's offer to sign a Waiver of Protest to Annexation in exchange for sewer services on 15 September~ Beer & Wine License Application - Village Inn Pizza The City Manager presented an application and the appropriate fee for a Beer and Wine License for the Village Inn Pizza Parlor, 806 North 7th Avenue. Upon recommendation of the City Manager, it was moved by Commissioner Vandevente~ seconded by Commissioner Lehrkind, that the Commission approve the above applicat~on for the Beer and Wine License. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none.
