HomeMy WebLinkAbout1976-08-25 :44 Bozeman, Montana 25 August 1976 The commission of the... ci ty : of Bozeman' met in regular session in the Commission Room, Municipal Building, 25 August 1976, at l:lS o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, commissioner Taylor, conunissioner Vandeventer, City Manager Fryslie, and the Clerk. Commission Lehrkind opened the meeting with a prayer and the following pro- ceedings were had. Minutes of the regular meeting held on Wednesday, 21 August 1976, were approved as read. Open Bids - Playground Equipment This was the time and place set for opening bids for the purchase of playground equipment for Bogert Pool, Beall Park and the Recreation Complex. The affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the bids be opened and read. The motion was carried by the following Aye and No vote: those voting Aye being commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer~ those voting-No, none. The following bids were then opened and read: Jensen Park & Recreation Equip., Spokane $28,067.02 Gene Shoaf and Assoc., (Miracle Rac. Equip.) 32,473.00 Upon concurrence of the recommendation of the City Manager, it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the bids be referred to the Park Recreation Department for tabulation and final recommendation on Wednesday, 1 September 1976. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer~ those voting No, none. Proposed Curb Opening on West Main Street The request from Mr. T. G. Haggerty for a curb cut variance to Gibsons parking lot off of Main Street having been tabled for a period of one week for further study and consideration was again brought before the Commission for discussion and a final decision. Following an extensive discussion, the City Manager recommended approval of the curb cut variance with some misgivings. It was moved by Commissioner Vandeventer, seconded by Commissioner Sedivy, that the request for the curb cut variance to Gibsons Parking lot off of Main Street be approved. Commissioner Vandeventer amended the motion to read that the request for the curb cut variance be approved if and when they begin construction in that area. Commissioner Taylor seconded the amended motion. Those voting Aye on the amended motion being Commissioner Vandeventer and Commissioner Taylor~ those voting No on the amended motion being Commissioner Lehrkind, Commissioner Sedivy and Mayor Vollmer. The amendment to the motion died for lack of a majority. Those voting Aye on the original motion being Commissioner Vandeventer, Commis- sioner Sedivy, Commissioner Taylor, Commissioner Lehrkind, and Mayor Vollmer~ those voting No, none, and the motion was carried. I I I I I I 415 The request of Smith Stallmaker and Associates for a curb cut variance on the South side of Main Street at the intersection of West Babcock Street and West Main Street was presented for continued discussion. It was maved by Cammissianer Taylar, secanded by Commissianer Vandeventer, that the curb cut variance be denied. Thase vating Aye being Cammissianer Taylar, Cammis~ sianer Lehrkind, Cammissianer Sedivy and Mayar Vallmer; thase vating Na being Cammis- sianer Vandeventer. Petitian - DemandingVate Upan Ordinance Na. 962 A petitian signed by approximately 1921 registered vaters demanding that Ordinance Na. 962, establishing a farmula far the methad .of assessment .of Special Impravement District Na. 565 far .off-street parking passed by the City Cammissian an 21 July 1976, be referred and submitted ta the peaple .of the City .of Bazeman for their appraval or rejectian was presented. In accardance with Sectian 11-3237 R.C.M., 1947, Cammissian-Manager Plan, na .ordinance passed by the Commissian, unless it be an emergency measure, shall ga inta effect until thirty days after its final passage by the Cammissian. If at any time within the said thirty days, a petitian signed by twenty-five percent .of the tatal number .of registered vaters in the municipality be filed with the Clerk .of the Cammissian, requesting that any such .ordinance be repealed .or submitted t.o a vate .of the electars, it shall nat became .operative until the steps taken herein shall have been taken. Therefare, the pet~tilian was faund insufficient and the City Manager recammended that the matter: nat be placed upan the ballat. It was maved by CammissianerLehrkind, secanded by Cammissianer Sedivy, that the petitian signed by appraximately eighteen percent .of the twenty-five percent required in accardance with Sectian 11-3237, R.C.M., 1947, Cammissian-Manager Plan, was declared inadequate. Continued Hearing ~ J. Danaghy - Conditianal Use Permit The public hearing ta cansider the request .of Jaseph Danaghy for a conditianal use permit to allaw an early learning center to be located an the first floar .of a hause lacated at 607 South TracY-Avenue having been cantinued for additianal study was again brought before the Cammissian. The request if appraved will allow an early learning center ta be lacated an the first flaor .of a hause at 607 Sauth Tracy. The center will be far appraximately 20 children, 5 days a wekk, 3 haurs per morning. 46 I I I I I I 47 Following discussion, it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission unanimously give a vote of confidence and support in writing to the proposal by the Finance and Building Committee of the Senior Social Center Building and a formal acceptance of the Resolution to Develop a Bozeman Senior Social Center. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Ordinance No. 972 - Appropriations (Budget) for FY 1977- Final Adoption The affidavit of publication of the annual Appropriation Ordinance for the fiscal year ending 30 June 1977 was presented with Appropriation Ordinance No. 972 entitled: ORDINANCE NO. 972 AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITURES DEEMED NECES- SARY AND IN ACCORDANCE WITH BUDGETARY REQUIREMENTS FOR MAINTENANCE, ETC., OF THE MUNICIPAL GOVERNMENT OF THE CITY OF BOZEMAN, MONTANA, FOR THE FISCAL YEAR ENDING 30 JUNE 1977. The City Manager stated that he knew no reason to suggest a change in the Ordinance since it has been provisionally passed the 23rd day of July 1976, and a public hearing held on 4th of August 1976, and therefore recommended final adoption thereof. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that Appropriation Ordinance No. 972 be finally passed and adopted. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Ordinance No. 973 - Setting Salaries for 1976-1977 Ordinance No. 973, the Annual Salary Ordinance covering salaries of the heads of depa.r:.tlnents and employees who are direct appointees of the Commission was presented, entitled: ORDINANCE NO. 973 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, FIXING THE MONTHLY SALARY AND OFFICIAL BOND OF THE CITY MANAGER, THE HEADS OF DEPA~ENTS, AND THE EMPLOYEES OF THE CITY COMMISSION OF THE CITY OF BOZEMAN AS REQUIRED BY LAW. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that Ordinance No. 973 be passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Agreement with Humane Society of Gallatin Valley An Agreement by and between the Humane Society of the Gallatin Valley and the City of Bozeman, Montana, for the purpose of defining administrative and financial procedures concerning all animals brought to the Humane Society Animal Shelter by the City was presented. Following discussion, the CommiSSion concurred in the recommendation of the City Manager that the City of Bozeman enter into a written agreement. It was moved by Corr~issioner Vandeventer, seconded by Commissioner Lehrkind, that the Mayor and '.'8 Clerk of the Commission be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote:, those voting Aye being Commis- sianer Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. Authority to Call for Bids - Dump Trucks, Opening 15 September 1976 The Street Department has need for two 1977 Model 20,000 pound G.V.W. trucks and the City Manager requested authorization to issue a "Call for Bids" for the purchase of the .two trucks. It was moved,by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the purchase of thetwQ 1977 model 20,000 pound G.V.W. trucks be authorized and the Clerk of the Commission be authorized and directed to issue a "Call for Bids" for the purchase to be received on 15 September 1976. Authority to Call for Bids - South Side Park Building The Gity Manager reconunendedthatplans and specifications for the construction of a building to be located at the South Side Park as prepared by the Building Inspector be authorized, and the Clerk of the conunission be authorized and directed to publish a call for bids for the construction thereof. It was moved by conunissioner Sedivy, seconded by conunissioner Taylor, that the plans and specifications be approved and the Clerk of the Commission be authorized and directed to publish a I'Call for Bids" for the construction of the South Side Park Building with an opening date of 15 September. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those vo,ting No, none. Proclamation - Cancer Day - 8 September 1976 In concurrence with the United Cancer Institute, the Mayor proclaimed 7-11 September as Cancer Week and proclaimed 8 September 1976 as Cancer Day in Bozeman and urged all residents to commemorate this observance with appropriate activities. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission endorse the Mayor's proclamation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commis- sioner Vandeventer, Commissioner Lehrkind, and Commissioaer Sedivy; those voting Mo, none. Board of Adjustments - Appointments Mayor Vollmer announced his appointments to the various city boards as follows: Board of Adjustment - Harold Goble to replace Luther Reel Effective 30 August 1976 to 30 December 1977 Parking Commission Effective 1 July 1976 ttJo30 June 1980 - H. B. Landoe to replace Roger,"Craft It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission concur in the appointmsenssmade by the Mayor. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy; those voting No, none. I I I I I I 49 Rick Mondale - Roads and Traffic Circulation Proposa~ Rick Mondale appeared before the Commission to give a Roads and Traffic Circula- tion Proposal. The Commission thanked Mr. Mondale for making the presentation and expressed their apprecation for the interest shown in this proposal. Report The City Manager commented on the report of the Director of Public Service and recommended it be accepted and ordered filed. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the reports be approved and ordered filed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commis- sioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none.
