Malcolm Story - Protested Installation of Sidewalks Malcolm Story appeared before the Corrunission to complain about having to replace a portion of sidewalk in front of his property. He felt the portion he replaced was serviceable and reasonably safe for pedestrian traffic, and did not need to be constructed this season. Plans for Multi-Purpose Pavilion Plans and specifications for the construction of the Bozeman Bogert Park Pavilion as prepared by Berg~Grabow-Schofield Architects, 1119 North Seventh Avenue, Bozeman, was placed before the Commission. Following a discussion, the City Manager recommended that the plans and specifications as presented be approved and a "Call for Bid" for the construction of the Bozeman Bogert Park Pavilion with an opening date of 7 September. It was moved by corrunissioner Sedivy, seconded by Commissioner Taylor, that the Commission concur in the reconunendation of the City Manager and the Clerk of the Commission be authorized and directed to publish a "Call for Bids" with an opening date of 7 September 1976. The motion was carried by the following Aye and No vote~ those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, ~nd Maydr Vollmer; those voting No, none. Re.suest for Commercial Accesses - West Main -Street, A letter received from Mr. T. G. Haggerty of Western General Enterprises requesting a curb cut variance to Gibson's parking lot was presented. Following discussion, it was moved by Commissioner Taylor, seconded byCommis- sioner Vandeventer, that the request for the variance be tabled for a period of one week for further study. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Life of Montana - Letter Requesting Land Exchange A letter from Life of Montana submitting their written proposal as requested by the City Commission was presented as follows: Please~be advised that as President of Life of Montana Insurance Company I am authorized to propeee to the Bozeman City Commission the following land exchagge: 1. The Life of Montana Insurance Company proposes to purchase from the Bozeman Deaconess Hospital Association that certain parcel of real property located in the County of Gallatin, State of Montana and more particularly described on attached Exhibit A as tract #1, and to offer the same to the City of Bozeman free and clear of any and all liens and encumbrances of any type or nature, and to convey the same to the City of Bozeman by Warranty Deed, insuring merchantable title thereto; 2. I am further authorized to accept from the City of Bozeman in exchange for the herein above described real property that certain parcel of real property presently owaed by the City of Bozeman, which real property is located in the County of Gallatin, State of Montana and more particularly described in attabbed Exhibit B as tract #2 in exchange for the conveyance of thehecein described parcel by Life of Montana Insuranoe Company to the City of Bozeman; 3. I am further authorized to propose this certain land exchange based on the following terms and conditions: \'42 1. That Life of Montana Insurance Company obtain and pay for an appraisal of Tract 1 and Tract 2 by a competent, qualified appraiser and submit the same to the City of Bozeman for its consideration. 2. That a surveying firm licensed by the State of MOntana survey Tract 1 and Tract 2, the cost of said surveys to be born by Life of Montana Insurance Company. 3. That the proposed land eXQ~ange be approved subq.ect to concurrance of G.O.A. and legal counsel for the City Commission. 4. That the legal officer of the City of Bozeman prepare the necessary documentation to complete the proposed land exchange and submit the same to the City Commission for final review and approval. 5. That, the Deed of Conveyance of the City of Bozeman property to Life of Montana Insurance Company contain a reverter clause setting forth that "if Life of Montana Insurance Company has not conunenced construction within twenty-four (24) consecutive months from the date of execution of this Deed of Conveyance that the hee-ein above described real property shall revert, Tracts 1 and 2, to each of the parties -Lo the proposed trade free and clear of any and all liens and encumbrances of any type or nature. I herewith enclose for your information and review an appraisal report covering tracts land 2 prepared by Northwest Appraisal Service, Inc. I trust that you will consider the proposed land exchange expeditiously and favorably. Thank you for your consideration of my request. Yours truly, s/Herb Richards Following discussion, and upon recommendation of the City Manager, it was moved by Commissioner Taylor that the Commission deny the request for the land exchange with the Life of Montana Insurance Company. The motion died for lack of a second. It was then moved by Conunissioner Vandeventer, seconded by Commissioner Lehrkind, that the Conunission acknowledge receipt of the written proposal from Life of Montana Insurance Company and accept the land trade as set forth. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Conunissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer~ those voting No being Commissioner Taylor. Proposed A~eement and Related Easement - Harry Daum, Etal proposed Agreements by and between the City of Bozeman and Harry M. Daum and Kathleen Mary Ellen Daum, Etal for the purpose of construction of a trunk sewer line extending on a parcel of land in a northerly direction over and across lands owned by Gary L. and Joan W. Cook, George E. and Alice M. Cook, Lowell and Shirley E. Curtis, and Erwin and Eva Lachenmaier and extending on Durston Road east to connect with the present sewer system of the City of Bozeman, was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission ooncur in the recommendation of the City Manager and acknowledge receipt of the ageeements and take them under advisement until the City Engineer completes his study at which time they will brought back for approval. The motion was carried by the following Aye and No vote: those voting Aye being Conunissioner Lehrkind, Conunissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. ~eports. The City Manager co~mented on the report of the Librarian and ~ecommended acceptance thereof.
