The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, 28 July 1976, at 1:15 o'clock p.m. Present were Mayor
Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner
Vandeventer, City Manager Fryslie, Assistant City Manager Wolf and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following pro-
ceedings were had.
Minutes of the regular meeting held on Wednesday, 21 July 1976, were approved
as read.
Hearing, Commission Resolution No. 1803 - SID 567 - Phase 2 Figgin~ Sewer

This was the time and place set in Commission Resolution No. 1803, to hear
protests to the creation of Special Improvement District No. 567. Affidavit of
publication of Notice and the Clerk's mailing certtf~cate, stating all property
owners had been notified as required by law were presented.
There were no protests on file and no one appeared to protest verbally. It
was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that Commission
Resolution No. 1809 creating Special Improvement District No. 567 for the purpose
of construction of Sanitary Sewer in Figgins Addition, Phase II as prepared by the _
City Attorney be passed and adopted. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy,
Comm. Taylor, Comm. Vandeventer, and Mayor Vollmer: those voting No, none.

Commission Resolution No. 1810-Creating SID 568 - WatermalLn Constr., Figgins
This was the time and place set in Commission Resolution No. 1804, to hear
protests to the creation of Special Improvement District No. 568. Affidavit of
pUblication of Notice and the Clerk's mailing certificate, stating all property
owners had been notified as required by law were presented.
There were no protests on file and no one appeared to protest verbally. It
was moved by Commissioner Sedivy, seconded by Con~issioner Taylor, that Commission
Resolution No. 1810 creating Special Improvement District No. 568 for the purpose
of construction of watermains in Figgins Addition as prepared by the City Attorney

This was the time and place set in Commission Resolution No. 1805, to hear
protests to the creation of Special Improvement District No. 569. Affidavit of
publication of Notice and the Clerk's mailing certificate, stating all property
owners had been notified as required by law were presented.
There were no protests on file and no one appeared to protest verbally. It
was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that
Commission Resolution No. 1811, creating Special Improvement District No. 569 for
the purpose of construction of watermains and sanitary sewer in Summit Engineering
Annexation as prepared by the City Attorney, be passed and adopted.
The motion

Commission Resolution No. 1808 - Creating SID 565 - Establish Off-Street Parking
COMMISSION RESOLUTION NO. 1808
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE
KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 565 OF THE CITY
OF BOZEMAN FOR THE PURPOSE OF FINANCING THE ESTABLISHMENT
OF PUBLIC OFF STREET PARKING FACILITIES IN THE CITY OF
BOZEMAN, MONTANA.
as prepared by the City Attorney was presented. It was moved by Commissioner
Lehrkind, seconded by Commissioner Sedivy, that Commission Resolution No. 1808
creating SID 565 for the purpose of establishing off-street parking facilities be
passed and adopted. The motion was carried by the following Aye and No vote:

Commission Resolution No. 1813 - Creating a Special Sidewalk Curb and Gutter Fund

A RESOLUTION CREATING A SPECIAL SIDEWALK CURB AND GUTTER
FUND OF THE CITY OF BOZEMAN.
as prepared by the City Attorney for the purpose of creating a special sidewalk
curb and gutter fund from which the payment of special warrants issued for the
construction of sidewalk in the City of Bozeman together with interest shall be
annually paid, was presented.
Following a discussion, it was moved by Commissioner Sedivy, seconded by
Commissioner Taylor, that Commission Resolution No. 1813 be passed and adopted,
and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner
Lehrkind, and Mayor Vollmer; those voting No, none.

Fund to make good any deficiency in principal and interest account

A RESOLUTION PURSUANT TO STATUTORY PROVISIONS, SETTING OUT
THAT THE CITY COMMISSIDON UNDERTAKES AND AGREES TO ISSUE
ORDERS ANNUALLY AUTHORIZING LOANS OR ADVANCES FROM THE
REVOLVING FUND TO MAKE GOOD ANY DEFICIENCY IN PRINCIPAL AND
INTEREST ACCOUNT TO THE EXTENT FUNDS ARE AVAILABLE AND TO
PROVIDE FUNDS FOR SUCH REVOLVING FUNDS BY MAKING A TAX
LEVY AND LOANS AS THE COMMISSION DETERMINES NECESSARY.

that the City Commission undertakes and agrees to issue orders annually authorizing

loans or advances from the revolving fund to the project fund of said project in
amounts sufficient to make good any deficiency in the principal and interest
accounts thereof to the extent that funds are available, and hereby further under-
takes and agrees to provide funds for such revolving fund pursuant to the provisions
of Section 11-2270, R.C.M., 1947, by annually making such tax levy (or, in lieu
thereof, such loan from the general fund) as the Commission shall determine to be
required to provide the funds sufficient for the purposes herein expressed, subject
to the maximum limitations imposed by said Section 11-2270, was presented.
The Commission concurred in the recommendation of the City Manager, and it
was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that
Commission Resolution No. 1814 be passed and adopted, and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor
Vollmer; those voting No, none.

COMMISSION RESOLUTION NO. 1816
A RESOLUTION PURSUANT TO STATUTORY PROVISIONS, SETTING OUT

Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor
Vollmer; those voting No, none.
Commission Resolution No. 1815 - Intent to Create SID No. 571, Lateral Watermain
MSU Veterinary Research
Commission Resolution No. 1815 declaring the intention to create Special
Improvement District No. 571 as prepared by the City Attorney was presented.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN,
MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE
KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 571 FOR THE PUR-
POSE OF CONSTRUCTION AND INSTALLATION OF LATERAL WATERMAINS
AND APPURTENANCES TO SERVE THE ADJOINING PROPERTIES, MORE
SPECIFICALLY AS FOLLOWS: A TWELVE INCH WATERMAIN IN LINCOLN
STREET AND SIX INCH WATERMAINS ADJACENT TO THE CENTER FOR
VETERINARY RESEARCH. THE CONSTRUCTION AND INSTALLATION TO
INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIALS,
CAST IRON WATERMAIN, VALVES AND FITTINGS AND HYDRANTS, SER-
VICE LINES AND OTHER NECESSARY APPURTENANCES TO PROVIDE WATER
TO ALL LOTS IN THE DISTRICT.
Upon recommendation of the City Manager, it was moved by Commissioner Sedivy,
seconded by Commissioner Taylor, thatCommission Resolution No. 1815 be passed and

adopted and 18 August 1976, be the date set for public hearing. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and
Mayor Vollmer; those voting No, none.
Resignation of City Manager - Harold A. Fryslie
A letter received from City Manager Harold A. Fryslie, requesting that he
be relieved of his duties as City Manager and his employment be terminated effective
31 October 1976, was presented.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that
the Commission reluctantly accept the resignation of City Manager Fryslie at
his request. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner
Lehrkind, and Mayor Vollmer; those voting being Commissionetafa.yi:or.
Report: Director of Public Service
The City Manager commented on the report of the Director of Public Service
and recommended it be accepted and ordered filed.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer,
that the report be accepted and ordered filed. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner
Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those
voting No, none.
Adjournment
There being no further business to come before the Commission at this time,
it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that
the meeting be adjourned and the motion was carried by the following Aye and No
