HomeMy WebLinkAbout1976-07-21 I I 19 Bozeman, Montana 21 July 1976 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 21 July 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, City Manager Fryslie, Assistant City Manager Wolf, City Attorney Berg, and the Clerk. Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 14 July 1976, were approved as read. Continued Hearing - Ordinance No. 962 - Formula for SID No. 565 The hearing to consider action on Ordinance No. 962, establishing a formula for the method of assessment of property in Special Improvement District No. 565 for offwstreet parking facilities in the City of Bozeman,was brought before the Commission for continued discussion and a final decision. Raving no further discussion, the Mayor declared the hearing closed. The Commission concurred in the recommendation of the City Manager, and it was moved by Commis. sioner Lehrkind, seconded by Commissioner Sedivy, that Ordinance No. 962 establishing a formula for the method of assessment of property in Special Improvement District No. 565 for establishing offw street parking facilities in the City of Bozeman with the additions be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. .Hearing. Resolution No. 1802 - Intent to Create SID 565 - Establishing Off. Street Parking This was the time and place set in Commission Resolution No. 1802, to hear protests to the creation of Special Improvement District No. 565. Affidavit of publication of Notice and the Clerk's mailing certificate, stating all property owners had been notified as required by law were presented. The City Manager presented written protests filed with the Clerk of the Commission representing approximately 30% of the proposed district. The Mayor declared the hearing opened and invited all interested persons to express their opposi. tion to creating a Special Improvement District to be known as Special Improvement District No. 565 for the purpose of establishing off-street parking facilities. Approximately forty interested persons and property owners were present in regard to the off- street parking facilities. Several property owners protested the creation of the district verbally. Bill Bennett III, Attorney representing Mr. Dieruf and Mr. Bradford, inquired as to the number of additional parking spaces to be acquired through the off-street parking resolution and as to whether Resolution No. 1802 was for the limited purpose of acquiring the property. Jim Screener, Attorney representing the Bozeman Medical Arts Center, and Kenneth Slaght of the Griffin Apartments was interested in finding out h9w the distances of the assessments were figured. how much of the area was zoned B-2 zone and was advised that the entire area I He also inquired as to is zoned B-3. Don Lanphear, RDI Corporation (City Taxi), Ben Vail of Cass upholstery, Mr. DeGidio of Bozeman Sheet Metal, Mr. Cecil Badgley, Dave Vogel of Western Cafe and several other persons verbally prow tested the creation of the off-street parking facilities. They felt their place of business would not benefit by the creation of the district. 20 Following an extensive discussion, the Mayor declared the hearing closed. Upon concurrence of the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the 30% protest be declared insufficient and the City Attorney be instructed to draw up a resolution creating the district establishing off-street parking. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Call for Bids - ~,500 tons Crushed r,ravel - Open Bids 4. August 1972 The Street Department has need for 4,500 tons Crushed Gravel, (2,000 tons to be delivered to the City of Bozeman Recreation Complex, 500 tons to be spread on the parking area around Bogert Swimming Pool and 2,000 tons to be delivered for stockpile at the former land fill north of Bozeman) and the City Manager requested authorization to call for bids for the purchase of the 4,500 tons of Crushed Gravel. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the purchase of the Crushed Gravel be authorized, and the Clerk of the Commission be authorized and directed to issue a "Call for Bids" for the purchase to be opened on 4 August 1976. The motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Authority to Call for Bids - 24.000 C,allons Regular Gasoline - Open 4 August 1976 The City Manager requested authorization to "Call for Bids" for 24,000 gallons regular gasoline. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the request be approved and the Clerk of the Commission be directed to issue a "eall for Bids" to be opened on 4 August 1976. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor VoLlmer; those voting No, none. Ordinance No. 972 - Appropriation Ordinance for Provisional Adoption. Hearing 4 August (Budget FY 1977) The City Manager reviewed the proposed budget for the fiscal year ending 30 June 1976 and Ordinance No. 972 was presented, entitled: ORDINANCE NO. 972 AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITURES DEEMED NECESSARY AND IN ACCORDANCE WITH BUDGETARY REQUIREMENTS FOR MAINTENANCE, ETC., OF THE MUNICIPAL GOVERNMENT OF THE CITY OF BOZEMAN, MONTANA, FOR THE FISCAL YEAR ENDING 30 JUNE 1977. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that Ordinance No. 972 be provisionally passed and adopted and that 4 August 1976. be set as the date for the public hearing. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Petition to Close Portion of Ida Avenue A petition received from Mrs. Lawrence E. Townsend petitioning the City to close the alley between Mendenhall and Lamme Street which is an extension of Ida Street was presented. Mrs. Townsend was also present to discuss the area in question. Following a thorough discussion. it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the alley be closed and the motion was carried by the following Aye and No vote: I I I I I I those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No being Commissioner Sedivy. Authority to Attend National League of Cities Meeting in Denver 28 November to 1 December The fifty-third annual conference of the National League of Cities is scheduled to be held in Denver, Colorado, 28 November to 1 December, and the City Manager recommended that Commissioner Sedivy be authorized to attend the conference. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that Commissioner Sedivy be authorized to attend the conference and, it being in the public interest his expenses be paid out of the appropriate fund. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commis- sioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none.
