The issue is trucks using their jake brakes when going down Story Mill Road. The noise emitted when trucks flip on the Jake brakes is excessive and annoying, especially in a residential area like Bridge Creek Golf Course Subdivision. My address is 3377 Story Mill Road which is towards the north end of the golf course and just south of Caddie Court. From the old landfill site Story Mill Road slopes downhill toward town, and although the posted speed limit is 35mph, which should be manageable for any competent truck driver, nearly every day of the week you can hear trucks using their jake brakes to control their descent, when the use of their standard air brakes should be adequate to stay within the speed limit. Mark Carpenter, the compliance officer suggested contacting the county planning department. County planning directed me to the county road office, where Mr. Brownell's secretary stated the following: state statute says that when an area is subdivided, as in Bridger Creek Golf Course Subdivision, the annexing authority for that subdivision, which would be the city of Bozeman, assumes jurisdiction for the entire width of the road. Therefore, even though much of the east side of Story Mill Road has not been annexed into the city, she stated that the city of Bozeman has jurisdiction of, and is responsible for that segment of the road. Furthermore, she stated that since the city of Bozeman has title to the landfill property, which is contiguous to an annexed subdivision, the city of Bozeman's jurisdiction on Story Mill Road extends to the northern point of the landfill property. In short, she stated that the county's position is that the city has full control over the management of that portion of Story Mill Road. My grievance is that the noise cause by trucks using jake brakes should not be allowed in a residential area, and all it takes to manage the problem is a few signs along the road. If this is not self evident to anyone living within a residential area in Bozeman, I will be happy to hire a construction truck to throw on their jake brake while they are passing by your house.
