The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, 30 June 1976, at 1:15 o'clock p.m. Present were Mayor
Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Vandeventer,
Commissioner Taylor, City Manager Fryslie, Assistant City Manager Wolf, City
Attorney Berg and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following pro-
ceedings were had.
Minutes of the regular meeting held on Wednesday, 23 June 1976, were approved
as read.
Hearing Conditional Use Permit - R. P. Matzinger
This was the time and place set for a public hearing to consider the request
of Rudy Matzinger of Matzinger Electric for a Conditional Use Permit to allow him to
construct a prepainted metal building on the front portion of an existing lot on
Bridger Drive. The address being 907 Bridger Drive.

The Zoning Commission having had several questions concerning the .apptication /'
and the applicant not having been in attendance at the meeting, the" Zoning Commission
voted unanimously to table the application until such time as the applicant could be
present at the meeting to answer questions in regard to the requested building and
recommended to the City Commission that this item be tabled.
The Commission concurred in the recommendation of the Zoning Commission, and
it was moved by Commissioner Lehrkind, seconded by commissioner Sedivy, that the
Commission open the hearing and continue action on the hearing until a recommendation
has been received from the Zoning Commission. The motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner
Sedivy, commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those
voting No, none.
Hearing - Conditional Use Permit - George Wilson
This was the time and place set for a public hearing to consider the request
of Don Nell, Agent for George Willson, for a conditional use permit to build a
15,000 sq. ft. warehouse on Burlington Northern Railroad right of way on a triangular
piece of land located just south of Griffin Drive between the Exxon tank yards, the
main line of the Burlington Northern Railroad, and Interstate 90. The building
would house the offices and warehousing of Mountain County Coors, the new Coors
beer distributorship for the Bozeman area.
Having reviewed the staff's report and the comments of the applicant, the
Zoning commission voted unanimously to recommend approval of this conditional use
permit request with the following conditions attached:
1. That sewage disposal for the building be designed and constructed
to the satisfaction of the city Engineer.
2. That surface drainage requirements be worked out to the satisfac-
tion of the City and County Engineers.
3. That signing be strictly limited to the two anticipated pole
and building signs.

4. That landscaping (to include curbing requirements, to be worked
out between the Planning staff and the applicant) be done as
drawn and described on the site plan for the development.
5. That all landscaping, paving and screening be completed within
nine (9) months of building occupancy.
Following discussion, it was moved by Commissioner Sedivy, seconded by Com-
missioner Taylor, that the Commission concur in the recommendation of the Zoning
Commission and approve the Conditional Use Permit with the above conditions.
The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner
Lehrkind, and Mayor Vollmer; those voting No, none.
gallons Road Oil during the fiscal year 1 July 1976 to 30 JUne 1977, for use by
the street department in repairing pavement and for sealing certain sections of
existing pavement within the City, from the Montana Highway Department was
presented.
It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that
the resolution be passed and adopted for the purchase of not to exceed 25,000
gallons road oil. The motion was carried by the fOllowing Aye and No vote: those
voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Sedivy,
Commissioner Vandeventer, and Mayor Vollmer; those voting No, none.
Comm. Resolution No. 1802 - Intent to Create SID 565, Downtown Parking Hearing
21 July 1976
Amended Commission Resolution No. 1802, declaring the City Commission's
intention to create a Special Improvement District to be known as Special Improve-
ment District No. 565, for the purpose of establishing off-street parking facilities
and prepared by the City Attorney was presented, entitled:

MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF

TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 565 FOR
THE PURPOSE OF ESTABLISHING OFF-STREET PARKING FACILITIES,
AND CHANGING THE TIME OF HEARING PROTESTS.
The Commission concurred with the recommendation of the City Manager, and it
was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that Commission
Resolution No. 1802 be passed and adopted and 21 July be the date set for pUblic
hearing. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor,
Commissioner Vandeventer, and Mayor Vollmer; those voting No, none.
Hearing 1976 Sidewalk and Curb Program
This was the time and place set for a public hearing to hear and consider
the protests to the 1976 Sidewalk and Curb program.
The Mayor declared the hearing opened and invited all interested persons to
discuss the Sidewalk and Curb program.

Approximately 25 to 30 interested persons and property owners were present to
discuss the sidewalk and curb program and to register their protest~ and complaints.
The City Attorney's purpose for having this hearing was so that persons who
have received notice of intent to repair or replace sidewalks and curbs have an
opportunity to come before the Commission and express their objections and protests.
Following an extensive discussion, the Mayor declared the hearing closed and
stated the individual protests will be brought in next week for inspection.
Raffle License Application - Bridger Canyon Women's Club
The City Manager presented an application from the Bridger Canyon Women's
Club along with the required fee for a raffle license for the purpose of holding
a raffle on 28 July 1976.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that

Canyon Women's Club, and the motion was carried by the following Aye and No vote:

Contract Documents 1976 Sidewalk and Curb Construction - Taylor Construction
The Contract documents for the construction of 1976 Miscellaneous Walk and
Curbs were presented. It was moved by Commissioner Taylor, seconded by Commissioner
Lehrkind, that the contract documents be approved and the Mayor and Clerk be autho-
rized and directed to sign the contracts for the City, and that Robert A. Taylor
Construction, be authorized and directed to proceed with the construction of the
1976 Miscellaneous Walk and Curbs. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind,
Commissioner Sedivy, Commissioner Vandeventer, and Mayor Vollmer; those voting No,
none.
Adjournment
There being no further business to come before the commission at this time,
it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that
the meeting be adjourned and the motion was carried by the following Aye and No
