The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 23 JUne 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind,
Commissioner Taylor, Commissioner Vandeventer, City Manager Fryslie, Ass't. City Manager Wolf, City
Attorney Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were
had.
Minutes of the regular meeting held on Wednesday, 16 June 1976, were approved as read.
Absence of Commissioner Sedivy Authorized:
Upon recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by
Commissioner Taylor, that the absence of Commissioner Sedivy, from this meeting, be authorized in
compliance with Section 11-3245, R.C.M., 1947, and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Lehrkind, Commissioner Taylor, Commissioner Vandeventer,
and Mayor Vollmer; those voting No, none.
Commission Resolution No. 1796 - Intent to Create SID No. 566, Paving in Remington Addn. - Hear 14 July
Commission Resolution No. 1796 declaring the intention to create Special Improvement District
No. 566 as prepared by the City Attorney was presented, entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA ,
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO
CREATE A SPECIAL IMPROVEMENT DISTRICT NO. 566 FOR THE PURPOSE OF CON-
STRUCTION AND INSTALLATION OF AN ASPHALTIC CONCRETE TYPE PAVEMENT,
INTEGRAL CONCRETE CURB AND GUTTER, AND NECESSARY APPURTENANCES THERE-
TO, ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY STORM DRAINAGE
PIPE, INLETS, MANHOLES, DITCHES, AND APPURTENANCES NECESSARY TO STORM
DRAINAGE ON PORTIONS OF REMINGTON WAY SHOWN ON THE AMENDED SUBDIVISION
PLAT OF THE REARRANGEMENT OF LOT 2 AND LOT 6, REMINGTON ADDITION TO
THE CITY OF BOZEMAN, MONTANA.
The Commission concurred with the recommendation of the City Manager, and it was moved by Comm-
issioner Taylor, seconded by Commissioner Vandeventer, that CommissionResolution No. 1796 be passed
and adopted, and 14 July 1976, be the date set for public hearing. The motion was carried by the
following Aye and No vote: those votingaye being Commissioner Taylor, Commissioner Vandeventer, Comm-
issioner Lehrkind and Mayor Vollmer; those voting No, none.
Ordinance No. 963 - Creating Capital Improvement Fund
Ordinance No. 963, creating a Capital Improvement Fund for the replacement and acquisition of
property, plant or equipment costing in excess of $5,000.00 with a life expectancy of five years or
more, was presented.

AN ORDINANCE. OF THE CITY OF BOZEMAN, MONTANA, CREATING A CAPITAL IMPROVEMENT
PROGRAM TO PROVIDE FOR THE REPLACEMENT AND ACQUISITION OF PROPERTY, PLANT OR
EQUIPMENT.
Upon recommendation of the City Manager, it was moved by Commissioner Vandeventer, seconded by
Commissioner Lehrkind, that Ordinance No. 963, be passed and adopted. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind,
Commissioner Taylor and Mayor Vollmer; those voting No, none.
Authority to Hold Sidewalk Bazaar Friday, 23 July 1976
A letter received from the Bozeman Chamber of Commerce requesting permission to hold a sidewalk
bazaar on Friday, 23 July, was presented.
It was moved by Commissioner Lehrkind, seconded by Commissioner Taylor, that authority for the
merchants of Main Street to hold their annual sidewalk bazaar on Friday, 23 July 1976, be granted
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Lehrkind, Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none.
Proposal to Extend Building Inspection Services 3 miles beyond the City Limits
The Building official appeared before the Commission to discuss the proposal to extend the
building inspection program into the three miles jurisdictional area when the 1976 addition to the
Building Code becomes available.'
After some questions from the Commission, it was moved by Commissioner Taylor, seconded by
seconded by Commissioner Vandeventer, that the Commission approve the Building officials proposal to
proceed with the program to extend the building inspection services three miles beyond the City
Limits. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Taylor, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting No, none.

Gambling License Renewals: BPOE No. 463, The Scoop, The Montana Gold Dust
The City Manager presented an application from BPOE No. 463; The Scoop; and The Montana Gold
Dust along with the appropriate fee of $500.00 from each for a gambling license for the purpose of
operating two tables.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission
concur in the recommendation of the City Manager and approve the three applications for the issuance
of gambling licenses. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Taylor and Mayor Vollmer; those voting
No, none.

The City Manager presented Commission Resolution No. 1797, setting date, maturity date, and
principal amount of bonds issued in Special Improvement District No. 558, entitled:

It was moved by Commissioner Lehrkind, seconded by Commissioner Taylor, that Commission
Resolution No. 1800 be passed and adopted, and the motion was carried by the following Aye and No

and Mayor Vollmer; those voting No, none.

The City Manager presented Commission Resolution No. 1801, setting date, maturity date, and
principal amount of bonds issued in Special Improvement District No. 564, entitled:

Contract Documents - SID's 558, 559, 560, 563 and 564 for Signature
The Contract documents for the construction of Special Improvement Districts 558, 559, 560,
563 and 564 were presented.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the contract
documents be approved and the Mayor and Clerk of the Commission be authorized and directed to sign
the contracts for the City of Bozeman, and that Long Construction Company of Billings be authorized
and directed to proceed with the construction of SID's 558, 559, 560, 563 and 564. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner
Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting No, none.
Adjournment
There being no further business to come before the commission at this time, it was moved by
Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande-
