HomeMy WebLinkAbout1980-04-09 "~ Oi Bozeman, Hontana April 9, 1980 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, April 9, 1980, at 1:15 o'clock p.m. Present were Mayor MacNab, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, City Manager Gesko, I City Attorney Planalp, and the Clerk. Commissioner Stiff opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday, April 2, 1980, were approved as submitted. Masonic Temple - request for variance to building code A letter received from the Masonic Temple, Inc., requesting a variance to the building code to extend the outside walls of the Masonic building four inches, was presented. The property is located on the southeast corner of Main Street and Tracy Avenue. It is planned to put new brick arches and pilasters on the existing piers separating the six store fronts. This will necessitate a four-inch projection outside of the present building line, on these piers. Provision is being made to support the new brick facing of the piers on steel angles several inches above the sidewalk, so that no weight will rest on the walk. The Building Inspector has no objection to the above variance. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission approve the variance to the building code to extend the outside walls of the Masonic building four inches. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Decision - Zone Map Change - Howard Barrick - reclassify zoning on approximately 24.4 acres from RR to R-3. Area west of City limits approximately 1200' and south and adjacent to Durston Road Mr. Barrick's request for a Zone Map Change from RR to R-3, having been delayed for a I period of one week, was brought back for a decision. The City Manager advised the Commission that he had no quarrel with the zoning as pro- posed by the Planning Staff, and approved by the Zoning Commission. The Zoning Commission recommended approval of the Zone Map change from RR to R-3 with the addition of a T-H (Townhouse) zoning classification for the eastern parcel, owned by Mr. Barrick. It was moved by Commissioner Stiff, seconded by Commissioner S\I'!all"Son, that the Conmission approve the request for a Zone Map Change from RR to R-3 with the addition of a T-H zoning classification for the eastern parcel, and conditioned upon the successful annexation of the property to the City of Bozeman. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commis- sioner Vollmer, and Mayor MacNab; those voting No, none. The City Manager said he could not help but be concerned for the condition and adequacy of both Babcock Street and Durston Road. In addition, West College from Eleventh or Nineteenth to West 191 needs improving. The City Manager recommended approval of the Zone Map Change from RR to R-3 contingent I upon successful annexation to the City of Bozeman. The City Manager recommended approval of the Zone Map Change from RR to R-3 contingent upon successful annexation to the City of Bozeman. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission approve the request for a Zone Map Change from RR to R-3 subject to the successful annexation of the property to the City of Bozeman. The City Manager reiterated his concern for the condition and adequacy of both Babcock Street and Durston Road. He further stated West College from Eleventh or Nineteenth to West 191 needs improving. The City Manager concurred in the recommendation of the Planning Department and the Zoning Commission and recommended approval of the Zone Map Change from RR to R-4 contingent upon suc- cessful annexation to the City of Bozeman. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve the request for a Zone Map change from RR to R-4 subject to the successful annexation of the property to the City of Bozeman. " \' (' "\('uO The City Manager concurred in the recommendation of the Zoning Commission, and recommended approval of the Zone Map Change with the substitution of an R-3 Zoning Classification for the eastern part. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission approve the Zone Map Change form RR to R-3 subject to the successful annexation of the property to the City of Bozeman. Public hearing - Conditional Use Permit - Edward Allen - Conversion of 856 sq. ft. in existing residence to be used for medical offices - Durston This was the time and place set for a public hearing to consider the request of Edward A 11 en. The applicant seeks a Conditonal Use Permit which, if granted, would allow the con- version of 856 square feet in an existing residence that would be used for medical offices. Dr. Allen and his family will continue to occupy the remainder of the structure for residential use. The site is located south of and adjacent to West Durston Road. The Gallatin County Rest Home is across the road, while Bozeman Hgih School is south of the site. The Planning Director presented the staff report which recommended approval of the Con- ditional Use Permit subject to conditions. Dave Patterson of 1105 West Durston Road appeared to register his protest to the Conditional Use Permit. He was concerned about the traffic on Durston Road and said he would rather it remained a residential area than a development of that nature. There being no further discussion, the Mayor declared the hearing closed, and a decision will be forthcoming on Wednesday, April 16, 1980. Public hearing - Conditional Use Permit - Greenwood Plaza Apartments (Gene Todd) PUD - 3 struc- tures will provide 50 dwelling units - Tamarack Street This was the time and place set for a public hearing to consider the request of Greenwood I Plaza (Gene Todd). The applicant seeks a Conditional Use Permit which, if granted, would allow a Planned Unit Development in which three structures will prOVide fifty dwelling units for low income people. The total square footage for the structure is 44,272 square feet. The property contains 3.073 acres and is located south of West Tamarack Street, east of North Grand Avenue, north of North Grand Park, and west of the Senior Citizens Center. The Planning Director presented the staff report which recommended approval of the Con- ditional Use Permit with nineteen conditions. (see insert page no. 489A and 489B ****) Gene Todd of Great Falls appeared before the Commission to answer any questions that might arise. The City Manager recommended that the Architect and Mr. Todd meet with the City Engineer to work out any problems. The Mayor declared the hearing closed and asked that thp applicant and the City Engineer work things out, and the Commission waive the one week waiting time. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the one week waiting period be waived. Decision - regarding revision of loan/grant financial guidelines for rehabilitation program Having researched the grant guidelines for the Housi~g Rehabilitation Program, it was brought back for a decision. It was stated that, although HUD-dictated loan guidelines cannot be changed, the grant guidelines can be altered locally. A tabulation was presented as to how the grant guidelines might be revised at this time. '-\00 J '~,.I In addition, it was suggested that more funds be allocated for grants, and that perhaps the program would be more successful with that revision as well. In researching the program it was found that no ceiling was placed on the allocation for grants and loans, the total of which would be $375,000. It was stated that no grants would exceed $5,000 per family. If the staff suggested that $100,000 should be allocated to grants, this would allow twenty families at least to be recipients under that program. I The City Manager advised the Commission that something should be done to encourage the dissemination of these funds, and recommended that the gUidelines be revised and that $100,000 should be allocated to grants. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the grant guide- lines for the Housing Rehabilitation program be revised as set forth in full: According to HUD, the loan guidelines set for Montana (listed below) are unalterable - however, it is our understanding that grant guidelines can be set by the locality. It should be noted if such program amendments are not made and we are not successful in appro- priately expended the funds available to us ($353,000 balance), it will likely have to be returned to HUD. Our program termination date is December, 1980. We wish to advise the Commission of these circumstances and inform them of the need to go to a larger grant program in order to assist those for whom the benefit of the program was intended. Exit Conference - regarding 1978-1979 audit The City Manager said the Exit conference of the 1978-1979 Audit was scheduled for this date. However, a copy of the audit had been sent to Helena, and they immediately sent a copy to the news media and therefore, he did not know whether there was any point in having an Exit conference with the Auditors. Jim Brinkman of Holmes and Turner, and Dan Fenno of Veltkamp, Dore, and Company, appeared before the Commission, to answer any questions that might arise. Commissioner Stiff asked several questions in regard to the Audit which were answered by I the two firms. Discussion - regarding expanded functions of Auditing Committee At the last meeting of the Auditing Committee, it was discussed that perhaps the committee should function beyond the selection of an auditor. After an auditor is selected and retained, and the report is drafted, the committee suggested that perhaps it should meet with the auditors ------~ **** 1. An Improvements Agreement regarding improvement, development, operation and maintenance of the property be executed between the developer and the City of Bozeman before final site plan approval is given. The Agreement is to specifically include: all on-site improvements shown on all final plans and specifications: and off-site improvements to include required fire hyd- rants, sidewalks (north and west side) and boulevard landscaping. 2. Include on final site plans a Use Allocation and Density Distribution Table. I Among other items noted in the Planned Unit Development requirements, the table should indicate the percentage of property used for driveways and parking stalls, landscaping, building site and lot area. 3. Stop signs should conform to design specifications found in the Manual of Uniform Traffic Control Devices. 4. The submitted plans indicate only one (1) external light source centrally located in the parking lot. This appears to be an insufficient amount of light, specifically for areas near the structures, driveways and entries. Entries for handicapped units should be specifically reviewed for lighting requirements. Also, elevation drawings of the light structures need to be submitted. The drawings should indicate the direction and area of direct illumination. 5. The final site plan's title block needs to include the legal description of the property. Also, the adjacent properties' (inCluding property across right-of-ways) zone classification and legal description need to be shown. 6. To clarify the type and physical characteristics of the exterior construction materials, a sample of the masonry veneer needs to be submitted. The specifi- cation book describes the masonry material as slump block concrete block, a plain grey color. Also, the elevation drawings for buildings #2 and #3 need to clearly label masonry veneer locations. 7. The plans indicate a four (4) foot wide sidewalk in the public right-of-way. The residential standard is five (5) foot wide. The standard width needs to appear on the final site plan. 8. Past reviews of this project have required a minimum number of parking spaces on two (2) spaces per dwelling unit, a total of one hundred (100). The pres- I ent plan has one hundred and one (101). The Zoning Commission and City Commis- sion should note that off-street parking requirements for apartments are now based on the number of bedrooms plus additional spaces for visitors. The new criteria requires one hundred and thirty-six (136) spaces. The Planning Staff, in preliminary review of the development, has indicated that the one hundred (100) figure would be used. 9. Storage areas for recreational vehicles (boats, snowmobiles, etc.) need to be provided on site. The storage areas need to be clearly marked for that pur- pose. The storage area should not decrease the present number of off-street parking spaces. 10. Parking lot design comments: a. The final site plan will need to clearly indicate that small car parking spaces will be identified with a sign permanently affixed immediately in front of each space containing the notation "Compacts Only". Elevation drawing of the sign is needed. b. The aisle widths shown are twenty-five (25) feet wide, the off-street parking regulations require twenty-six (26) feet wide aisles. c. Six percent (6%) of the gross interior parking area is to be landscaped. The percentage landscaped needs to be shown. d. One (1) tree per five (5) parking spaces is needed. The trees need to be located within the parking area, said area being founded by the extreme points of the curb line including landscaped extensions into parking lot but excluding approach driveways. Trees should be located within the park- ing lot islands, which will need to be curbed and irrigated. Locating trees within the islands may affect design and location of light fixtures. I e. Caliper width of deciduous trees need to be shown in the plant legend on sheet L-I. Mimimum size required is one and one-half (1.5) inch. II. City garbage trucks are eight (8) feet wide. To allow convenient backing maneuvering and prevent damage to the garbage enclosure, the width needs to be widened from ten (10) to twelve (12) feet. 12. The elevation drawings need to clearly show height of the structures. ~1ax i mum height allowed is thirty-two (32) feet. ~..- -~- - 489B 13. The Community Recreation Director and Planning Director need to review and approve the Architect's drawings of the total lot area. 14. Elevation drawings showing how the three (3) transformer sites will be screened need to be submitted. 15. Shrubs should be located near the structures as a landscape element. 16. All on-site and off-site improvements shall be completed by December 31, 1981. I 17. Three (3) copies of a final site plan containing all conditions, corrections, and modifications recommended and approved by the City Commission shall be reviewed and approved by the Planning Director prior to the issuance of a build- ing permit for the project. One (1) signed copy shall be retained by the Plan- ning Director; one (1) signed copy retained by the Building Official; one (1) signed copy retained by the applicant. 18. The final plans include specifically the energy-saving and low-maintenance design criteria sought by the City Commission. 19. The final plans include the changes required by the City Engineer and Fire Chief, as noted in this report, and that the revised site plans be reviewed and approved by the City Engineer and Fire Chief prior to issuance of a building permit. The City Commission expressly incorporates the fifteen (15) items contained in the Planning Staff's review list as part of the conditional approval. This would not eliminate or nullify the usual manage- ment discussion with the auditors--while the audit is in process or upon its completion. Commission Resolution No. 2180 - re purchase of Right-of-Way from Railroad for public access to Kack property Commission Resolution No. 2180 authorizing the purchase of the right-of-way from the rail- road, and which would allow public access to the Kack property as prepared by the City Attorney, was presented, entitled: COMMISSION RESOLUTION NO. 2180 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AUTHORIZING THE PURCHASE FROM BURLINGTON NORTHERN RAILROAD A PERMANENT EASEMENT AND RIGHT OF WAY LOCATED SOUTH OF GRIFFIN DRIVE TO PROVIDE ACCESS TO KACK IMDUSTRIAL PROPERTIES. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that Commission Resolution No. 2180 be passed and adopted. Montana Bank - vacating or closing alley - establish date for public hearing The Montana Bank requested the City to consider vacating the alley which runs east and west between North Grand and North Third Avenues. The matter was referred to the City staff for review of a site plan. Following discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Stiff, I that the Commission establish April 30, 1980, as the date for a public hearing for the vacation or closing of the alley which runs east and west between North Grand and North Third Avenues. Thomas, Dean & Hoskins - Engineering Contract - Master Urban Drainage Plan A Contract for Engineering Services for a master urban drainage plan by and between the City of Bozeman, and Thomas, Dean & Hoskins, Inc., Engineers, of Great Falls, Montana, was presented. Following discussion, it was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve Alternate 2, and award the contract to Thomas, Dean & Hoskins. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and t1ayor MacNab; those voting No, none. Algeria Shrine - permission to hold Ceremonial Parade May 3, 1980 The Algeria Shrine Club requested permission to hold a Ceremonial Parade on May 3, 1980 in conjunction with the Shrine Ceremonial. The Shrine Club also requested permission to install a banner across Main Street at the intersection of Main Street and Black Avenue from April 28 to May 5, 1980. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission grant the Algeria Shrine Club permission to conduct the Ceremonial Parade, and that they be I given permission to install the banner as stated above from April 28, 1980 to May 5, 1980. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none. EPA Grant/Agreement - plans and specifications for construction of Waste water treatment facility improvements and interceptor sewers Grant/Agreement No. C300208220 covering "preparation of Plans and SpeCifications for the construction of Waste Water Treatment Facility Improvements and Interceptor Sewers in accordance /, Q/ .., ....).^. with the Approved Facilities Plan" was presented. The funds allocated for the above purpose are $265,500.00 all of which is in accordance with the EPA procedure for expanding and refin- ing our Sewage Treatment Plant. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Grant/ Agreement be approved, and the City Manager be directed to sign the documents for the City of Bozeman. Discussion - County Allocation of funds - Blueberry Hill road improvements A discussion was held in regard to the County allocating $15,000 to improve Story Mill Road, from approximately south edge of the landfill property to the Grandview Heights Subdi- vision. The City Manager said such development and improvement at this time is unwarranted. The City staff would prefer to see such funds applied on Durston. He advised the Commission that the State Highway Department will jOin in this effort. FOllowing an extensive discussion, the Commission authorized and directed the City Manager to address a letter to the Gallatin County Commission, requesting that they consider re-allocat- ing the funds for Story Mill Road improvement to perhaps Durston Road, or failing such re- allocating, that expenditure of funds presently allocated be delayed until discussions have been conducted. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the City Manager be instructed to address the letter to the County requesting, that they delay the improvements of the road. Request to retain appraisal for land for Step 2 Sewage Treatment Plant - completion and expan- sion I The City must acquire additional land on which the detention ponds will be constructed, in conjunction with the tertiar treatment at the Sewage Treatment Plant. This involves par- cels owned by three different individuals. The city must have at least one independent apprai- sal of this property, paid for from grant/local funds, before such acquisition can take place. The City Manager requested authorization to interview several appraisers, receive estimates, and award the appraisal to the best bidder. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the City staff interview appraisers to find out what the cost would be. The motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commis- sioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Discussion - regarding public transit system in Bozeman The City Manager advised the Commission that federal funds have been set aside to provide for a feasibility study in Bozeman, to determine whether or not the City of Bozeman needs a public transit system. The City Manager said this matter was discussed at some length during the Technical Advisory Committee meeting. It was suggested that the City Commission should first consider this matter, and that perhaps a public information meeting be held later this month so that the general public could also provide their suggestions and comments. It was moved by Commissioner Swanson, seconded by Commissioner Stiff, that the City deny having an informational meeting on Public transportation. The motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Vollmer, Commis- sioner Stiff, and Mayor MacNab; those voting No, Commissioner Mathre. The City Manager had checked the claims and found them to be true and lawful claims against I the City of Bozeman and recommended they be approved and the Director of Finance be instructed to issue the warrants in payment. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the claims be approved, and the Director of Finance be instructed to issue warrants in payment thereof.
