J~) Bozeman, Montana February 27, 1980 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, February 27, 1980, at 1:15 o'clock p.m. Present were Mayor MacNab, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, City I Manager Gesko, City Attorney Planalp, and the Clerk. Commissioner Stiff opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday, February 20, 1980, were approved as submitted. Mandeville request for Zone Map Change The request from Mr. Mandeville for a Zone Map Change was again deferred. Consideration of Construction bids - SID 599, 611, and 613 Consideration of the construction bids for SID No. 599. 611, and 613 will be delayed for a period of sixty days in order that SID No. 605 may be created and the bonds sold. If and when that is accomplished, the construction bids will be awarded to Dugdale & Company. Fund Drive - Campfire Girls - April 1 A letter received from Vicki Frazier, Executive Director of the Camp Fire Girls, request- ing permission to conduct a fund drive on April 1, 1980, was presented. The event is an Apri 1 Fool 's Day project called Rent-A-Goat. Persons wishing to participate pay $10.00 to have a goat delivered as a joke to someone. That person in turn may pay $10.00 to have it sent to another person. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission grant permission to hold the fund drive on April 1, 1980. The motion was carried by the folow- ing Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commis- sioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Commission Resolution No. 2164 - Creating SID 620 - Paving Blackmore Place I Commission Resolution No. 2164, creating SID No. 620, paving Blackmore Place, as prepared by the City Attorney, was presented, entitled: COMMISSION RESOLUTION NO. 2164 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL I~1PROVEMENT DISTRICT NO. 620 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF A;~ ASPHALTIC- CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, STORM DRAIN INLETS, AND NECESSARY APPURTENANCES THERETO ON BLACKMORE PLACE, IN THE CITY OF BOZEMAN, MONTANA. It was moved by Commissioner Stiff, seconded by Commissioner Mathre, that Commission Resolu- tion No. 2164, creating SID No. 620 be passed and adopted. The motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting ~Io, none. Engineering contract - Thomas, Dean & Hoskins, - Water, Storm Drain & Paving A contract of services with the firm of Thomas, Dean & Hoskins, Inc., "Engineers", of Great Falls, for a five year period, was presented. The proposed contract is intended to cover engineering design and construction inspection services for water supply; water storage d.is.tntbution and treatment; wastewater collection and treatment; storm drainage and paving improvements; or any other engineering projects. The Engineer agrees to perform the above described services for a period of five years. Said con- tract is renewable at the end of the five year period by mutual agreement between the "Owner" l- and the "Engineer". The Owner is bound to the contract only for such services as may be direc- ted or authorized by said Owner. The City Manager recommended that the contract be brought back to the Commission for action on Wednesday, March 5, 1980. Commission Resolution No. 2165 - Intent to create SID 605, paving & storm drain Graf's 1st. Public hearing - March 19, 1980 Commission Resolution No. 2165, declaring it to be the intent to create Special Improvement District No. 605, for the purpose of paving and storm drain construction on Kenyon, Baxter, I,~ t::; 6 ' v Chambers and O'Connell Drives, all in Graf1s First Addition, as prepared by the City Attorney, was presented, entitled: COMMISSION RESOLUTION NO. 2165 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- I MENT DISTRICT NO. 605 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF AN ASPHALTIC-CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, STORM DRAINS AND NECESSARY APPURTENANCES THERETO ON KENYON, BAXTER, CHAMBERS, AND O.CONNELL DRIVES, ALL IN GRAF'S FIRST ADDITION, IN THE CITY OF BOZEMAN. It was moved by Commissioner Swanson, seconded by Commissioner Mathre that Commission Resolution No. 2165 be passed and adopted, and March 19, 1980 be the date set for the pub- lic hearing. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none. Request authorization to transfer $200.00 from Contract Services It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that $200.00 be transferred from contracted services of the City/County Planning Department and placed into the salaries account. This would cover the estimated cost for the secretary to take minutes of the City/County Planning Board minutes for the balance of the fiscal year. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. Bozeman United Methodist Church - re loading - zone/handicapped & sidewalk between City sidewalk and curb on Olive Street. The request from the United Methodist Church - re loading - zone/handicapped and sidewalk between City sidewalk and curb on Olive Street was referred to the staff for research and recommendation. The staff has no objections, and suggests the church be authorized an arrange- I ment which would provide for such zones during the needed periods. This would precede church services on Sunday, and specific other times when church services are scheduled--such as dur- i ng Lent. Following discussion, it was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission concur in the recommendation of the City staff, suggesting that the church be authorized an arrangement which would provide for such zones during the needed periods. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. Paul VanderJagt - request transferring 301 Orange Street Right-of-way A letter received from Attorney Edmund P. Sedivy, Jr., on behalf of Mr. Paul VanderJagt, requesting the City to consider tranSferring the southerly thirty feet of the former sixty feet right of way of Orange Street to Mr. VanderJagt, was presented. Following discussion, it was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the property be appraised before a decision is made. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none. Consideration of Auditor for Fiscal year 1979-1980 The consideration of an auditing firm to conduct the audit of the City.s present fiscal year was discussed. If a firm could be decided on soon, they would be ready to begin an audit I soon after July 1. Mayor MacNab designated Commissioner Stiff to work with City Staff members in prescribing a procedure which would allow for prompt designation of an auditing firm for fiscal year 1979- 1980. Application for Kennel License - Susan Copeland - 822 S. Fifth Avenue The City Manager presented an application from Susan Copeland, 822 S. Fifth Avenue, along with the appropriate fee for a kennel license. ,.. -.., ;'.:j i.. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission approve the kennel license application as presented. Application for Gambling License - Allan Dean Butler "Eagles Club" I The City Manager presented an application from Allan Dean Butler of the Eagles Club, along with the appropriate fee for the purpose of obtaining a gambling license for the year ending June 30, 1980. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve the application for the Gambling License as presented. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Gallatin Saddle Club - Parade Tuesday, June 17 - in connection with CNFR Finals A letter received from the Gallatin Saddle Club, requesting permission to sponsor a parade on the afternoon of June 17th in honor of the CNFR Finals was presented. The parade would begin at the Gallatin County Fairgrounds, proceed south on Black to Main, then west on Main to Eleventh and continue on Eleventh to the Fieldhouse, ending at the Field- house. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission approve the parade. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre,- Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none. Proclamation - "Save your Vision Weekll The Mayor proclaimed the week of March 2-8, 1980 as "Save your Vision Week" in the City of Bozeman, and urged all citizens, for their own well being and the good of our City, State, and Nation, to give special attention to their vision needs. I It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission concur in the Mayor's proclamation~ The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commis- sioner Swanson, and Mayor MacNab; those voting No, none. Salary Ordinance - Amendment of Salary Ordinance - Salary Ordinance No. 1052 It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission approve amending the Salary Ordinance to increase the Salary of the City Court Judge from $9,600.00 to $11,000.00 per year retroactive to January 1, 1980. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. ORDINANCE NO. 1052 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA AMENDING ORDINANCE NO. 1037 AND REVISING THE MONTHLY SALARY OF THE POLICE JUDGE. Claims The payroll claims and general claims for the month of February, 1980 were presented. The City Manager had checked the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be instructed to issue the warrants in payment. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve the claims. The motion was carried by the following Aye and No vote: those voting Aye I being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Accept & file - Fire Department Annual reports The City Manager commented on the annual report of the Fire Department and recommended it be accepted and ordered filed. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission accept the Annual report of the Fire Department and that Mr. Simpson be commented on his report. Report of Director of Public Service for January The report of the Director of Public Service for January was presented for acknowledge- ment and filing on Wednesday, March 5, 1980. I Absence of City Manager Gesko - Sioux City, S.D. - February 28-29, 1980 It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that City Manager Gesko be granted permission to attend the meeting in Rapid City, S.D. February 28 and 29, 1980. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Recess: 3:30 o'clock p.m. Meeting reconvened: 7:39 o'clock p.m. Public hearing - proposed water rate increase The City Manager advised the pUblic attending the meeting that the proposed water rate increases had been discussed for the past month. The Mayor declared the public hearing opened and advised all persons attending the meet- ing that the Commission was interested in public input on the proposed water rate increases. Mr. Penwell, attorney for Maurice Klabunde, was present to clear up questions in connec- tion with the rate increases. He advised the Commission that he had contacted the Public Service Commission in order to clear up some areas in connection with the proposed rates. Mary Van't Hul, 1115 S. Grand, appeared to discuss the rates. Gordon Pagenkoph of 2008 S. Tracy, Dalton Burkhalter, 1429 S. Fifth and Chester DuBois, 1217 W. Dickerson were also present to discuss the rates and register some objections. Following much discussion, the Mayor thanked everyone for their interest in the matter. I There being no further discussion, the Mayor declared the hearing closed. Commission Resolution No. 2166 - specifying water rate and water regulation modifica- tions to become effective at a specific date upon department of public service regulation of the State of Montana, was presented, entitled: COMMISSION RESOLUTION NO. 2166 A RESOLUTION SPECIFYING WATER RATE AND WATER REGULATION MODIFICATIONS TO BECOME EFFECTIVE AT A SPECIFIC DATE UPON DEPARTMENT OF PUBLIC SER- VICE REGULATION OF THE STATE OF MONTANA, PUBLIC SERVICE COMr~ISSION, APPROVAL; AND DIRECTING APPLICATION TO THE PUBLIC SERVICE COMMISSION FOR APPROVAL THEREOF. It was moved by Commissioner Stiff, seconded by Commissioner Swanson that Commission Resolution No. 2166 specifying water rate and water regulations modifications, be passed and adopted and the original and one copy be forwarded to the Mr. William E. OILeary, Attorney at Law, Helena, Montana. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none.
