HomeMy WebLinkAbout1980-02-20 r ,- '; ,j 1- Bozeman, ~1ontana February 20, 1980 The Commission of the City of Bozeman met in regular session in the Commission Room Municipal Building, February 20, 1980, at 1:15 o'clock p.m. Present were Mayor MacNab, Commissioner Vollmer, Commissioner Stiff, 'Commissioner Swanson, Commissioner Mathre, City I Manager Gesko, City Attorney Planalp, and the Clerk. Commissioner Vollmer opened the meetin9 with a prayer whereupon the minutes of the regular meeting held on Wednesday, February 13, 1980, were approved as submitted. Mandeville request for Zone Map Change The City Manager advised the Commission that the City Attorney has drafted the conditions in legal form, for review by Mr. Mandeville. The City Manager suggested, that since Mr. Mandeville was not able to attend this meeting and has not reviewed the conditions in legal form, the request be held over until Wednesday, February 27, 1980. Public hearing - Commission Resolution No. 2159 - Town Pump Annexation During the regular meeting of the City Commission held on January 16, 1980, the Commission regularly passed and adopted Commission Resolution No. 2159 declaring its intention to extend the boundaries of the City of Bozeman so as to include certain contiguous tracts of land known as the Town Pump property and containing approximately 1.16 acres. This being the date for publiC hearing as set forth in said Commission Resolution No. 2159, affidavit of pUblication of Notice and the Clerk's mailing certificate stating all prop- erty owners had been notified as required by law was presented. There was no one present to protest the annexation of the property, and there were no written protests on file. There being no further discussion, the Mayor declared the hearing closed. The governing, body shall receive written protests for a period of twenty days, and a decision will be forth- I coming on March 12, 1980. Decision - SID No. 620 - paving on Blackmore Place The decision on Commission Resolution No. 2158, SID No. 620, paving and storm drain con- struction on Blackmore Place having been delayed for a week was brought before the Commission for a decision. The Commission concurred with the recommendation of the City Manager, and it was moved by Commi ss ioner Vollmer, seconded by Commi ss i oner Stiff, that the Commi ss i on approve the creation of Special Improvement District No. 620, and instruct the City Attorney to draft a resolution creating the district, to be brought in for action on February 27, 1980. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Proposed Water Rates The proposed water rates were again discussed. The City Manager and staff met with Attorney William O'Leary, and our consulting engineer, Tom Thomas, in Helena, on Tuesday, February 19, to discuss the water rates. The City Manager said that the new rate schedule would be finalized by Wednesday, February 27. The City Manager advised the Commission that even though it is not legally necessary, he wanted to give every Bozeman resident one final chance to voice his opinion on the increase. He, therefore, recommended that the Commission extend next weeks meeting to reconvene at 7:30 I in the evening to allow for public input on the proposed water rate increases. Ordinance No. 1048 - Amending ordinance to allow Electrical Sub-stations as Conditional Use in an AS zone Ordinance No. 1048, amending Chapter 18.72 of the Bozeman Municipal Code, allowing electrical sub-stations as a Conditional Use in the AS Zone, as prepared by the City Attorney, was presented entitled: ORDINANCE NO. 1048 AN ORDINANCE OF THE CITY OF BOZEMAN AMENDING CHAPTER 18.72 OF THE BOZEMAN MUNICIPAL CODE ALLOWING ELECTRICAL SUB-STATIONS AS A CONDITIONAL USE IN THE AS ZONE. lIS? l !.i..~ It was moved by Commissioner Swanson, seconded by Commissioner Mathre. that the Commission approve Ordinance No. 1048 allowing electrical sub-stations as a Conditional Use in the AS Zone. The motion was carried by the following Aye and No vote: those voting Aye being Commis- sioner Swanson, Commissioner Mathre, Commissioner Stiff, and Mayor MacNab; those voting No, none. Commissioner Vollmer abstained. Possible change - salary ordinance I The Commission discussed the possibility of amending the salary ordinance to provide an increase for the City Court Judge. The salary ordinance presently in effect authorized a $9,000 annual salary for this position which is less then he received while in the capacity of City Prosecutor. Following discussion, the City Manager recommended a salary of $11,000 per year for the City Court Judge. The City Attorney recommended delaying action on the request for a period of one week in order that dates of retroactive salary increases could be clarified. Inland Empire Shows, Inc. - fee waiver or reduction - grant program A letter received from Jane Jelinski, Director: Gallatin-Park Advocacy Program for Developmentally Disabled Adults, requesting the City Commission to waive or reduce the licens- ing fee of Inland Empire Shows, Inc., from $400 to $100 per day, was presented. . Reed Williams of Twin Falls, Idaho, Manager of Inland Empire Shows, was present to answer any questions that might arise. He said he would like to bring his carnival to Bozeman during the inclusive dates of June 19-22, 1980 and locate it at the New Daum Industries Shopping Cen- ter. Mr. Williams stated the licensing fee in Bozeman is too high for him to make a profit. He agreed that if the Commission waived or reduced the licensing fee, that he would donate either $500 or 10% of the gross from rides to the Gallatin-Park Advocacy Program for Developmentally Disabled Adults. In addition he agreed to open the carnival to all of the disabled clients in the program for one afternoon of free rides. Ms. Jelinski advised the Commission that the Advocacy program has been in Bozeman since I November 15, 1978. It was initially funded by a nonrenewable grant from the Developmental Disabilities Planning and Advisory Council in Helena and is sponsored by HRDC. The grant expired September 30, 1979. She stated the additional contribution from Inland Empire Shows would greatly enhance the chances for the Advocacy program to survive for another year and would give Ms. Jelinski the necessary time to secure a grant from a private foundation. The Commission concurred in the recommendation of the City Manager, and it was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the request to waive or reduce the license fee from $400 to $100 be denied. The motion was carried by the following Aye and No. vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No: Commissioner Mathre. Proclamation - Rotary International Week - 22-29 February Mayor MacNab proclaimed the week of February 22-29 as "Rotary International Week" in the City of Bozeman to encourage and foster the ideal of service as a basis of worthy enter- prise by the development of acquaintance as an opportunity for service, and by the advance- ment of international understanding, good will and peRce through world fellOWShip in the ideal of service. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission concur in the Mayor's proclamation. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commis- sioner Vollmer, and Mayor MacNab; those voting No, none. I The Ad Van -requests a "Blanket permit" - allow vehicle to utilize its self-contained remote broadcasting system in advertising throughout the community A letter received from Scott Shurain, sole proprieter of liThe Shining t10untains Ad Store" requesting a "blanket permit" allowing a vehicle to utilize its self-contained remote broad- casting system in advertising throughout the community was presented. Mr. Shurain was also present in regard to the request. He said it is his understanding that a City ordinance requires a permit be obtained prior to the use of a public address system in Bozeman. r .). 0 ,~l:~ The City Attorney is not aware of an ordinance that requires a permit for the use of a pUblic address system in Bozeman. The City Manager advised the Commission that a decision does not have to made on the above request, however, Mr. Shurain must stay out of the residential area with the broad- casting system. I Sullivan Photo - request a temporary Conditional Use Permit Steve Quayle of Sullivan Photo appeared before the Commission on behalf of Quest-Vest, Mojo Systems. This firm is presently engaged in a manufacturing process which produces vests and photographic bags. The firm has outgrown its present quarters which is located in the Bridger Center Industrial area. In searching for sufficient space to meet their product requirements, they have located a building immediately next door which has double the area and would accommodate their needs very nicely. In order to move the ten feet next door a conditional use permit is technically required. The need to move is extremely urgent, in order to meet production demands on hand. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the move be allowed contingent upon application by Mr. Quayle and his firm for a conditional use per- mit not later than Friday, February 22, 1980. This would assure that the permit be sought and considered as required by the "T" zoning designation. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre; those voting No, none. Mayor MacNab abstained. Negotiation - Bond sale SID No. 599 and 605 The City Manager recommended that the sale of the bonds for SID No. 599 in the amount of $300,000. be awarded to D.A. Davidson & Company, Great Falls, at an interest rate of 10.25%. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the sale of the bonds for SID No. 599 in the amount of $300,000.00 be awarded to D.A. Davidson & I Company, at an interest rate of 10.25%. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. The bid on the sale of the bonds for SID No. 605 was rejected in as much as the con- tract bid for 605 was over the created amount. Recycle solid waste for heat generation - University personnel The application prepared by the Montana State University personnel, recycle solid waste for heat generation, etc., was presented for further review. Mr. Dennis Blackketter, a mechanical engineer at Montana State University was present to answer any questions the Commission might have. Following discussion, it was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission approve the application to be submitted to the State Department of Natural Resources. The motion was carried by the followng Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none. Application for raffle license - Big Brothers & Sisters - February 22 The City Manager presented an application from Big Brothers and Sisters, along with the appropriate fee for the purpose of holding a raffle on February 22. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission approve the application for the raffle license. The motion was carried by the following Aye I and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. Application for raffle license - A.A.U. Wrestling Club The City Manager presented an application from the A.A.U. Wrestling Club, along with the appropriate fee for the purpose of holding a raffle. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission approve the application for the raffle license. The motion was carried by the following Aye I: 5't and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Accept and file Broad Valleys Federation of Libraries report for January The City Manager commented on the report of the Broad Valleys Federation of Libraries for January and recommended it be accepted and ordered filed. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the report I be accepted and ordered filed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Fire Department report for Calendar year 1979 The annual report of the Fire Department was presented for acknowledgement and filing on Wednesday, February 27, 1980. Authorization for Van't Hul to attend school - National Urban Runoff program - March 10-13, Denver, Colorado It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that City Engineer, Art Van't Hul be authorized permission to attend the National Urban Runoff school in Denver, Colorado, on March 10-13, 1980. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Recessed 4:00 p.m. - Executive session for collective bargaining Members of the Commission along with the City Manager, the City Attorney, and the Clerk of the Commission recessed at 4:00 p.m. for the purpose of going into an executive session to discuss collective bargaining strategy involving employees. Reconvened 4:25 p.m. Adjournment There being no further business to come before the Commission at this time, it was I moved by Commissioner Stiff, seconded by Commissioner Swanson, to adjourn the meeting.
