The Commission of the City of Bozeman met in regular session in the Commission Room, Muni-
cipal Building, January 9, 1980, at 1:15 o'clock p.m. Present were Mayor MacNab, Commissioner
Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Acting City Manager I
Murie, City Attorney Planalp and the Clerk.
Commissioner Vollmer opened the meeting with a prayer whereupon the minutes of the regular
meeting held on Wednesday, January 2, 1980, were approved as submitted.
Absence of City Manager Gesko
It was moved by Commissioner Vollmer, seconded by Commissioner Mathre, that the absence of
City Manager Gesko be approved, and that the Director of Finance be designated as Acting City
Manager. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor
MacNab; those voting No, none.
Continued hearing - Zone Code Amendment - Planning Staff - Chapter 18.84.040 - Off-Street parking
and loading
The hearing on the request of the Planning Staff for a Zone Code Amendment having been con-
tinued from December 5, 1979, was again presented.
The proposed amendment to the Off-Street Parking and Loadi~g Section of the Bozeman Zoning
Code would modify portions of Section 18.84.040 - Design. The modifications are being suggested
to allow for greater flexibility in these portions of the parking lot requirements.
The Planning Director presented the staff report, which recommended approval of the zone I
code amendment with four modifications.
There being no further expressions, the hearing was closed and a decision will be forth-
coming on Wednesday, January 16, 1980.
Public hearing - Comm. Res. 2153 - Intent to create SID 619 - Watermain construction Lea Avenue

This was the time and place set in Commission Resolution No. 2153, to hear the protests
to the creation of Special Improvement District No. 619, watermain construction on Lea Avenue
and located in the Gordon Mandeville State School Subdivision.
Affidavit of pUblication of Notice and the Clerk's mailing certificate stating all property
owners had been notified as required by law were presented.
There were no written protests on file and no one appeared to protest verbally.
The Mayor declared the hearing closed and a decision will be forthcoming on Wednesday,
January 16, 1980.

I Ordinance No. 1045 - Enacting IIUniform Fire Code 1979 Editionll
Ordinance No. 1045 adopting the IlUniform Fire Code, 1979 Editionll as copyrighted by the
International Conference of Building Officials and the Western Fire Chiefs Association, as
prepared by the City Attorney, was presented.

AN ORDINANCE OF THE CITY OF BOZEMAN ADOPTING UNIFORM FIRE CODE.
It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that Ordinance
No. 1045 be passed and adopted. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson,
Commissioner Mathre, and Mayor MacNab; those voting No, none.
Appointment to Recreation Board to December 31, 1982. - Joseph DiMarco
Mayor MacNab announced his appointment of Joseph DiMarco to the Recreation Board effec-
tive January 1, 1980 to December 31, 1982.
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission
concur in the Mayorls appointment to the Recreation Board. The motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commis-
I sioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none.
American Legion Baseball - City's policy regarding type of advertising to support program
A letter received from Joel A. Shouse, Chairman of the American Legion Baseball Committee,
regarding the possibility of selling advertising which would be displayed on signs attached
to the outfield fences at the baseball field, was presented.
Mr. Shouse said the major problem with maintaining a Legion Baseball Program in Bozeman is
raising sufficient funds, and the Committee felt selling advertising might be a pOSSibility.
He further stated this type of advertising is being done at many of the Legion Baseball fields
in Montana and represent a major share of the income for these teams.
The Commission aCknowledged receipt of the letter and referred it to the City engineering
staff for review and a recommendation on Wednesday, January 16, 1980.
Application for Kennel License - Dorothy S. Kenck - 1317 West Alderson
An application received from Mrs. Dorothy S. Kenck, 1317 West Alderson, requesting a kennel
license in accordance with Ordinance No. 1035, Section 5.61.040 of the Bozeman Municipal Code,
together with the required fee was presented.
The Acting City Manager stated the license is a renewal and there is no reason to deny the
I kennel license.
It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the application
be approved and the Director of Finance be instructed to issue a kennel license in accordance
therewith. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor
MacNab; those voting No, none.

Reports - Building Inspector and Library for December 1979
The reports of the Building Inspector and Library were presented for acknowledgement
and filing on Wednesday, January 16, 1980.
Adjournment
There being no further business to come before the Commission at this time, it was I
moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the meeting be adjourned.
